I the undersigned City Attorney for the City of Georgetown, Texas, do
hereby certify that I have examined the attached extract ftim the regular
meeting of the Council of the City of Georgetown, Texas, held on February 9,
1970, and it is my opinion that the aforesaid meeting was ftly and legally
hbld and that the Resolutions contained therein were duly a regularly adopted
by such'governing body in compliance with the laws of the State of Texas, and
are not subject -to referendum or the time for filing a petildon for referendum
has expired.

JVNI ORDINANCE SUBMITTING THE PROPOISED HOME-RUL1, ClwtTLU TO
TTIE QUALIFIED VOTEILS OF THE CITY OF GEORGETOWN TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWNfl TEXAS:
That, whereas, the Charter commission hereto fore appoi,ated by the Mayor
of the City of Georgetown, and elected voters, have submitti.1 a proposed home -rule
charter for said city, to the city council, and have fixed—Alifte date for the
submission of said proposed home -rule charter to the qualifi:4.d voters of said City
on April 4, 1970, and have determined that it is not practijal to submit the
Charter by section, but as one question to the voters.
Therefore, be it ordained by the City of qeorgetown, thi At in comp Hance
with the date fixed by the Charter Commission, and under anq1by the virtue of the
of the Home Rule Amendment to the Constitution and the enabli ing Statute of Texas

1925, that an election be held on April 4, 19701 in said Cit i, f6ri,theepurpose
of having the qualified voters pass on said proposed Charter", and that at said
election thembe submitted to the qualified voters of said lity the propos-
ition: Shall the charter framed by the Charter Commission arl completed on
February 9, 1970, be adopted? The official ballot shall read as follows:

DIRECTIONS: to vote for the adoption of the Charter mark ou the word AGAINST:
to vote against the adoption mark out the word FOR. 11�
QUESTION: Shall the,Charter framed by the charter commissio be adopted?
�1) For the adoption of the charter.
2) Against the adoption of the charter.
Mrs. R. D. Riggs and Mrs. J. H. Montgomery are appointed judges of the
election, and Mrs. Tom C. McAferty and Mrs. N. R. Landry are appointed clerks
of said election. Said election shall be held at the City Fire Station, in
the City of Georgetown, between the hours of 8:00 a.m. and 7:00 p.m.,
on aid date of April 4, 1970. Sind election shall be governed by the election
laws of the State of Texas, and all qualified voters residing in the City
shall be entitled to participate therein. Said election officers shall make
their reture-,.,, of the result of said election to the City Council, showing
the total vote: affirmative, vote on sai&�proposed charter, and the negative
vote thereon, together with the Tally Sheet and Poll List, prior to the
April 13, 1970 meeting of the Council of the City.
Be it further ordained that a copy, of this order of election, duly
certified by the City Secretary, shall constitute notice of election, and
same shall be published for the time and in the manner required by law.
Be it further ordained that 30 days prior to said election, the City
Secretary shall mail to each qualified voter of the City, a copy of siad
proposed Charter.
Since there is no sufficient and adequate Charter for the City 6f
Georgetown, and since the lace creates a public necessity and emergency
therefore, it is imperative that all rules relative to delaying the passage
of this ordinance be waived and that it be passed upon the day of its introd-
uction.
