HomeMy WebLinkAboutRES 09.12.1966 - Royal Oaks Hill Estate29 AN ORDINANCE AUTHORIZING THE SALE OF LOTS 1 THROUGH 6, BLOCK 2, AND LOTS 15 THROUGH 20, BLOCK 1, HART ADDITION, CITY OF GEORGETOWN, TO HOUSING AUTHORITY OF THE CITY OF GEORGETOWN, FOR THE SUM OF $59500.'00 AND AUTHORIZING THE MAYOR OR MAYOR PRO-TEM TO EXECUTE AND DELIVER A PROPER DEED THEREFOR. WHEREAS the Mayor has heretofore granted unto the Housing Authority of the City of Georgetown, Texas, a valid option to purchase Lots 1 through 6, Block 2, and Lots 15 through 20, Block 1, Hart Addition, City of Georgetown, pursuant to proper authorization by the City Council, and WHEREAS the Housing -Authority of the.City of Georgetown, Texas, has exercised its option and desires to consummate the purchase, and WHEREAS, the said land is surplus and not needed for the future operations of the City -of Georgetown, and WHEREAS,.it is in the best interests of the City that the Housing Authority of the City of Georgetown, Texas, proceed with its redevelopment of the said lands, NOW THEREFORE BE IT RESOLVED that upon the delivery to him of the sum of $5,500.00 for the account of the City of Georgetown, Texas, less any closing or legal expense, the Mayor or Mayor Pro-Tem is hereby authorized to execute and deliver on behalf of the.City of Georgetown, Texas, a valid Warranty Deed conveying said property to the Housing Authority of the City of Georgetown, MTexas, in fee simple. O The enactment of this ordinance being necessary to the immediate (� preservation of public business and to provide for the usual daily operation of a municipal department, it is declared to be an emergency measure, which shall L.� have and take effect following its present reading and adoption. Sexton,,'of the County of Williamson and State of Texas, being the owner of the tract of land described in the foregoing certificate of W. F. Forest, Registered Public Surveyor, and the map or plat thereof accom- panying the same, do hereby adopt the said map and plat thereof under the name of Royal Oaks Hill Estates Addition to the City of Georgetown, Texas, said addition being described by metes and bounds as follows: BEING a part of the N. Porter Survey, Abstract No. 497 in Williamson County, Texas, and being a tract of 8.8 acres out of a tract of 20.81 acres described in a deed from Jay Wolf to Tom Sexton of record in Vol. 465, Page 169, Deed Records of Williamson County, Texas. BEGINNING at an iron pin at the South corner of the 20.81 acre tract, in the West ROW line of U.S. Highway No. 81. This point stands S 19 E 5701 feet and S 71 W 1497 feet from the NE corner of the'N. Porter Survey. THENCE N 26 deg. 50' W 683 feet to an iron pin; THENCE N 63 deg. 10' E 210 feet; THENCE N 59 deg. 20' E 117 feet to the Beginning of a curve to the left with a radius of 107 feet; 30 THENCE around the curve 80.5 feet to the end of the curve; THENCE N 16 deg. 15' W 224 feet; THENCE S 66 deg. 30' E 151.4 feet; THENCE N 34 E 90 feet,-" THENCE S 56 E 169 feet to a point on the west RAW line of U.S. Highway 81; THENCE around a curve to the right of 1 deg., whose central angle of 23 deg. 42', as follows: S 30 deg. 45' W 80.1 feet; S 31 deg. 35' W 80.1 feet; S 32 deg. 20' W 80 feet; S 33 deg. 10' W 80 feet; S 34 deg. W 100 feet; and S 38 deg. 15' W 150 feet to the POINT OF BEGINNING, AND I do hereby dedicate to public use forever the streets shown on said plat for the use of the public in ingress and egress from said addition. I hereby grant to the City of Georgetown, Texas, easements required as shown by the easement lines of said plat for the erection, maintenance and repair of water, sewer, gas, light and power and telephone lines thereon, together with and including the right of ingress and egress for the purpose of erecting, maintaining and repairing said utility lines. In granting this easement, it is the intention of the grantor that no street or alley shall be opened along and over said easement, but that pipes, lines and poles of said utilities shall be laid and buried or erected on this easement, and subject to this easement the owners of the lots shall keep said easement free and clear of buildings as set out above. In connection with the adoption of the map, plat and subdivision of said premises, I have made and imposed, and by these presents do make and impose thereon the following restrictions, covenants, conditions and limitations, which shall be covenants running with the land, to -wit: 1. All of the lots shown on said plat are dedicated under the zoning ordinances of Georgetown, Texas, as "R-1", One Family Dwelling District. 2. That no building or any part thereof shall be erected nearer than 25 feet to the property line of said lots adjacent to a street on which a lot faces, or nearer than 5 feet to the side line of said lot or of a building plot formed by two or more lots as indicated on said plat; no building shall be erected on the easement reserved for utilities. 3. No residence or dwelling unit shall be erected upon any lot or resubdivision thereof which shall contain less than one thousand, four hundred (1,400) square feet of area, excluding the basement area, outside porch or porches and the garage and the area of any outbuildings permitted pursuant hereto. This restriction shall not prevent the construction of a garage, garage apartment or other outbuildings where the main building conforms to the 1,400 square feet restriction. 4. That no lot or any part thereof shall be used for the keeping of cattle, hogs, sheep, goats, chickens and turdeys. 5. No trailer, basement, tent, shack, garage, barn or other out- buildings erected on the lot or lots shall at any time be used as a residence. The garage and outhouses must be built of a permanent nature and located at their permanent location when erected. All buildings shall be constructed of at least seventy-five (75) percent masonry construction and shall be painted with at least two coats of paint when erected unless of masonry construction. 31 6. The covenants and conditions set forth above, and each of them shall be covenants running with the title of any lot sold and every part thereof until January 1, 1977, and so long thereafter until the same may be changed, amended or cancelled as hereinafter provided. Invalidation of any one of these covenants by judgment or court order shall in no wise affect any of the other provisions hereof, which shall remain in full force and effect. 8. These covenants are to run with the land and shall be binding upon all parties. On, or at any time subsequent to the first day of January, 1977, by a majority vote of the then owners of the lots in said addition, the covenants hereby may be changed, amended or cancelled in whole or in part; and until the covenants herein contained are so changed or amended, then the same shall be continued in full force and effect. That the owner, Tom B. Sexton, of that certain tract of land desig- nated as "ROYAL OAKS HILL ESTATES ADDITION" to the City of Georgetown, Texas, is hereby authorized to file for record in the office of the County Clerk of Williamson County, Texas, the Map or Plat of said tract attached hereto, and the said County Clerk of Williamson County, Texas, is hereby authorized to accept for filing and to- record said Map of said Tract of Land. 2. In authorizing the filing and recording of said Map of said tract of land, the City Council of the City of Georgetown, Texas, does not assume any obli- gation to grade, improve or maintain the streets shown thereon.
