Analysis•
This house and lot were purchased from the builder, Carl Luzius,
in its present configuration with the northwestern most corner of
the structure encroaching upon the 7 foot building line and 5'
PUE to within 2.9' of the northern side lot line. This
encroachment was not discovered until the sale of the house,
making apparent the necessity of a variance to prevent any
further difficulties in refinancing or selling of the applicant's
property. The Building Official has recommended approval,
affirming adequate clearance between the applicants home and that
of the neighbor next door. The Director of Public Works has
further confirmed that there are no utility services in the
aforementioned Public Utility Easement and that the Department
has no "objection to a variance being permitted in this
instance.
Planning Staff Recommendation:
Approval of this variance as requested.

Dear Sirs:
I am writing to request approval from the Planning and Zoning
Commission and the City Council of Georgetown for a variance
in regard to the encroachment of our house on the Building
Line and Public Utility Easement along the north side of our
lot (Lot No. 9, Block: B, Addition: Turtle Bend, street
address: 112 Turtle Bend, Georgetown, Texas 78628).
I have been advised that by obtaining your approval, we would
be able to avoid any further difficulties in refinancing or
selling our property. Attached is a copy of the letter
required by our current lender from Yr.Allyn Moore, Director
of Public Works, stating that the City of Georgetown does
not have any utility service in said easement and that the
Department of Public Works does not have any objection to
a variance being permitted in this instance. Also attached
is a copy of the request for variance from tea. Frank `dineinger,
Building Official, detailing the reason for this request.
Today I have paid the $250.00 fee and the deposit on the required
sign, which will be displayed as instructed .

Request•
Final plat and Site plan approval for Crystal Knoll Terrace PUD,
Unit Three, a 28.86 acre subdivision out of a part of the Antonio
Flores Survey being part of a 100 acre tract of Cecil M.
Schneider, et ux, recorded in Vol. 517, page 245. Variances are
requested to:
1. reduce minimum lot size from 6000 square
feet to 4500 square feet,
2. eliminate building line and PUE on one side
of lots
3. exceed maximum depth to width ratio,
4. allow placement of lots at right angles,
and
5. increase in density requirements
Farts -
Location: This tract comprises the Northeast corner of
Crystal Knoll Terrace PUD, which is located at
the northeast corner of the intersection of
County Roads 151 and 152. This subdivision is
within the E.T.J. and within the Edwards
Aquifer Recharge Zone.
Surrounding Uses: Agricultural use exists to the north and east;
a row of 10 duplexes adjoins the property on
the southeast. Single family use is proposed
in the approved final plat of Unit One to the
south; and multifamily use is proposed to the
west in the preliminary plat of Crystal Knoll
Terrace PUD.
Proposed Use: 156 Single family units on 4500 square foot
lots at a density of 5.4 units per acre.
Development Plan: District 5C recommends normal residential.
Utilities: City water service has been requested with
applicant providing an alternate source in
conformance with current City policy. Sanitary
sewer and electric service (underground) are
also requested of the City.
History: Preliminary plat was conditionally approved on
April 9, 1985. Final plat and Site Plan were
conditionally approved on October 1, 1985 for
119 duplex lots.

Analysis•
Land Use- The only significant change in the current plat
over that previously approved is the land use.
Applicant is requesting that 156 small lot
single family units be approved in lieu of 233
two-family units. The proposed units are to be
detached on a minimum lot of 4500 sq, ft. and
off -set to one side of the lot (zero -lot line)
so as to maximize the utility of reduced yard
area. As it appears that this request is due
to a change in market conditions and whereas a
part of the intent of the PUD ordinance is to
provide affordable, market responsive housing,
planning staff have no objection to this
change. However, the building department has
objected to the small lot concept as being out
of character with Georgetown and more conducive
to a more urban setting. This proposal has
been reviewed by criteria established with
previous projects of this type, such as
Raintree, and University Park and substantially
conforms to same. The variance to eliminate
the one side building line and PUE are
necessary to make a project of this type more
functional if the variance to reduce the
minimum lot size from 6000 sq. ft. to 4500 sq.
ft. is granted. The request to vary the
density limit allowing an increase in density
from 5 d.u./acre to 5.4 d.u./acre (is. 8% or 11
dwelling units) seems reasonable given the
proposed reduction in total number of dwelling
units from that previously approved. It should
be noted however that the elimination of five
units near the park site (Block 3 Lots 33-37)
would help to open up the open space portion of
the facility and provide additional parking.
Also the selective elimination of one lot from
side of Blocks 7 & 8 and redistribution of this
area would help to eliminate some lots which
are too narrow at the rear yard area.
Streets/Drainage- There are no significant changes in these areas
and thus they meet ordinance requirements.
However, the City Engineer has raised some
questions which can be addressed during
construction plan review.
Utilities- Some additional utility easements will be
required along the front of several lots to
accommodate the revised sanitary sewer layout.

Knoll has not yet been executed and thus the
full extent of improvements necessary including
the adequacy of the "alternate" water source to
serve this project will remain to be finalized
during construction plan review. Another issue
is how to tie this proposed distribution system
into the existing City system.
Miscellaneous- Since no variance was requested it is assumed
the parking requirements have been met to
provide two off-street spaces behind the front
building line.
The By-laws and Covenants of the Homeowners
Association must be revised and approved by the
City Attorney prior to the recordation of the
plat.
A revised landscape plan is needed and should
be included with the site plan in the
construction drawings. Some provision for
assuring the completion of the recreation areas
is needed.
The survey review by City Engineer indicated
several needed corrections. A revised plat
must be reviewed prior to recordation.
Staff Recommendation:
Approval of the revised final plat and site plan of Crystal Knoll
Terrace PUD Unit Three conditional upon the approval of
construction plans and the following:
1. All ordinance requirements shall be met
2. Drainage requirements shall be met and
Homeowners Association Covenants shall
include maintenance for Drainage facilities
3. Utilities being adequate, the Water
Availability Note shall apply and the
Utility Service Agreement shall be approved
prior to plat recordation
4. The landscape plan and plans for
improvements to the recreational areas
shall be revised and resubmitted for review by staff
and shall, along with the final site
development plan, be included in the
construction plans
5. A letter of credit to the City shall be
established for the recreational
improvements and these improvements must be
substantially complete by the time 50% of
the residential units are issued
building/utility permits.

6. Variance from the density limits of the PUD
ordinance shall be granted as requested.

Approval of Preliminary/Final plat for College Place, a 1.165
acre tract in the Nicholas Porter Survey, Abstract No. 497 and in
the William Addision Survey Abstract No. 21, recorded in Vol.
1190 page 568 deed records of Williamson County, Texas.
Variances are requested from the Drainage Ordinance Section 5.10
stormwater detention requirements and from the filing fee
requirements for the plat.
College Place - 2
Facts•
Location: The southwest corner of 2nd and College
Streets. It is within the City of Georgetown
and within the Edwards Aquifer Recharge Zone.
Surrounding Uses: To the west and south are single family
residences. The VFW Park lies to the north
across 2nd Street and a single family residence
is to the east across College.
Proposed Use: Twenty rowhouse type condominium units are
proposed for this 1.165 acre lot, yielding a
density of 17.2 units/acre.
Existing Zoning: RM -3 Multi -family residential
Development Plan: District 6a. Normal residential use. Proposed
use not in strict conformance with Master Plan,
but does conform to existing zoning.
Utilities: Proposed source of electric, water and sanitary
sewer service is City of Georgetown.
History•
By action of City Council on February 11, 1986 this tract was
declared to be a legal lot and thus platting is not required.
However, the applicant has elected to plat the property upon the
request of the Planning Staff.
Analysis•
Land Use: The density of these condominium units is
permitted by the RM -3 zoning designation it has
been given. The adjacent single family uses to
the south and west should be buffered by either
a fence and/or landscape screen. A standard
privacy fence has been proposed for the south
line while landscaping is shown for the west.
Entrance signs are not explicitly allowed by
Ordinance (section 6.106) within the required
front yard. Therefore the sign indicated
should be relocated a minimum of 15 ft. from
the last property line.
Restrictive covenants are required by Ordinance
Section 9.1 for condominium projects. They
have not yet been submitted.

Streets: The driveway width and turning radii, although
minimal, have been approved by the Fire
Marshall.
Drainage: The following issues must be addressed before
the final approval of construction plans:
a. Calculations should be provided on the
sizing of the grated inlet and stormsewer.
The Q25 appears too small and the grate
inadequately sized.
b. The drainage area between the north
curbline and the town houses drains toward
the structure. This practice is not
acceptable.
C. The aerial section of sanitary sewer
through the concrete lined ditch is not an
acceptable practice within the City of
Georgetown.
d. The drainage easement shall be 2 ft.
minimum outside the existing concrete
drainage channel or design water surface
elevation whichever is wider.
Utilities: The proposed "aerial" crossing of both the
water and wastewater lines over the existing
concrete drainage channel is not a desirable
situation. The preferable crossing would be
beneath the existing channel. The close
proximity of a proposed 8" wastewater/12" storm
sewer line crossing also necessitates safeguard
measures to ensure the prevention of seepage
and contamination. Currently the City Engineer
and the Public Works Department are not in
agreement on this issue which can be addressed
during construction plan review.
At least one additional fire hydrant will be
required according to guidelines established by
the City Fire Department, and the one indicated
on the utility layout must be shifted to
improve accessibility.
The Master Wastewater Plan indicates that the
interceptor line just downstream of this
development needs additional capacity to

accommodate demands anticipated by 1990. The
level of participation in these improvements by
this development must be determined.
Miscellaneous: Applicant has requested a waiver of the normal
platting fees associated with this project.
Since City Council has declared this property
to be a "grandfathered" legal lot under the
ordinance a plat is not required. However, it
is the policy of the Planning Department to
encourage platting of property whenever
possible, especially when utility and drainage
easements are to be dedicated. This is due to
an increase in efficiently administering future
City involvement with the property by various
functions including the tax collection, zoning,
utility maintenance, etc. Therefore, staff has
no objection to the granting of this waiver.
However, the following costs should not be
exempt:
1. Recording Fees
2. Fees associated with site plan and
construction plan review
3. City engineers fees for drainage review
Staff Recommendation
Approval of the plat and site plan with the following conditions
1. Ordinance requirements shall be met
2. Utilities being adequate
3. Drainage requirements shall be met; A
variance from the Drainage Ordinance (sec.
5.10) stormwater detention requirements be
granted
4. A fence and/or landscape screen shall be
required along the tracts west and south
sides
5. Restrictive covenants shall be submitted
and approved by the City Attorney prior to
recordation
6. A variance to allow the waiving of platting
fees shall be granted
7. Variance from Subdivision Ordinance Section

use and lies approximately 1.2 miles west of IH -35 on the north
side of FM Rd. 2243.
Recommendation:
Granting of request and extending Final Plat approval for three
months. The new expiration date shall be August 27, 1986.

Location: Abutting the east side of Park Lane; south of
Clay Street. Within the City Limits.

Existing Use: Undeveloped
Surrounding Use: Multi -family Residential use to the north and
west. A motel is adjacent to east. Northside
Elementary and Office use to south.
History•
This area has undergone several resubdivisions the last of which
was shown on a plat signed by the Mayor of Georgetown on August
10, 1976. However, according to County records this plat was
never filed. The current zoning district status has also been
difficult to establish due to insufficient legal description
provided in the ordinance which apparently rezoned the property
from RS to RM -3 IN 1970.
Analysis•
The rear property line of this tract is adjacent to a driveway
belonging to the Georgetown Inn. Thus, access to the rear side
of the proposed office building would be possible for emergency
vehicles in the event of fire. It should also be noted that if
the property were rezoned from RM -3 to C-1 District, then the
requested variance would not be needed. A rezoning of this type
would however permit commercial uses with far less compatibility
to existing residential uses north and west of the site. The
reduction by one space from parking requirements was made at the
suggestion of the Planning Department in order to preserve an
existing significant tree and to improve maneuverability in the
parking/driveway area.
Since the plat was not recorded, this property is not a legal lot
under the Subdivision Ordinance. Thus, the reapproval of the
resubdivision plat and filing of an approved plat will be
required prior to the issuance of building permits on the lot.

Additionally, the applicant should be put on notice that there
appears to be a drainage problem on the site and an existing
power line crosses the lot in the general vicinity of the
proposed building. These issues must be addressed during
plat/plan review.
Recommendation
1. The variance to reduce the required rear building setback

2. The variance to reduce the required parking spaces form
10 to 9 should be granted

Discussion•
The plat of Southside Addition was recorded in 1895 (see attached
copy). This plat does not indicate the use for the 10' strip
between the north and south halves of Block 5. Nor is there a
specific dedication statement associated with the plat. However,
historically the City has considered many of the streets and
alley" areas to be public right-of-way. Thus, in order to clear
up possible title problems the requested action is warranted.
Planning and Public Works staff have reviewed the request and
find no existing public use nor future public need for this 10'
strip of land. Applicant should be put on notice that typically
an abandoned R.O.W. reverts to adjacent owners to the center line
i.e. 5 ft.) of the R.O.W. being abandoned.
Recommendation:

Facts:
Location: On the east side of FM 1460 at Smith Branch Creek. Is
within the City of Georgetown city limits and on the
Edwards Aquifer Recharge Zone.

Commercial Park to the south and east, vacant
City of Georgetown property to the north.
Proposed Use: Commercial/light industrial
Development Plan: Development Plan district 8b, does not conform
to plan but has been previously approved.
History•
The final plat for Hygeia was recorded March 25, 1986. Site was
annexed on December 21, 1984.
Analysis•
Amended Plat—The existing recorded plat is a one lot subdivision
designated for Commercial industrial use which is bisected by the
Smith Branch Creek flood plain. The only change proposed from
the plat of record is the reduction in width of the Road Widening
Easement along FM 1460 at the northwest corner of the
subdivision from 40 ft. to 20 ft. (See plat to be vacated
attached) The only justification presented for this request was
to maximize the usable area of the lot to increase its value for
future sale. The ultimate intent would be to resubdivide the
property into two lots separated by the creek. As shown on the
attached letter from T.D.P.T., the future need for this easement
is uncertain. This is due to the lack of a firm plan for the
future road widening. It should also be noted that a 20 ft.
easement would conform to the recommendation of the Thoroughfare
Plan. However, this Plan is very general in nature and does not
include site specific evaluations or unusual conditions such as
the major bridge structure which will be required if this road is
ever upgraded.
A worst case scenario from the City's perspective is that at some
future date this 20 ft strip will be needed for road widening and
utility relocation and the City would be obligated to purchase
the easement. Also, if this occurs, a commercial building may be
constructed within 5 ft. of this new R.O.W. due to the new
building setback line which will be created.
The subject 20 foot area has already been given over for road
widening. The applicant is merely asking that it be returned.
Thus the primary decision regarding this request is a
determination of what is fair and reasonable relative to two
apparently conflicting interest; that of the applicant as opposed
to that of the community.

WHEREAS, an application has been made to the City Council for

AND WHER:AS, the City Council has submitted the proposed change
in the Zoning Ordinance to the City Planning Commission for its
recommendation and report; and,
WHEREAS, the City Council, before adopting this amendment to
the Zoning Ordinance, gave notice of such hearing by publishingsameinaweeklynewspaperintheCityofGeorgetown, Texas,
which notice of such matters as required by law including the
time and place of hearing and which time was not earlier than
fifteen days from the day of such publication; and
WHEREAS, written notice of such matters as required by law was
given to all the owners of the land within 200 feet of the above
described property as required by law; and
WHEREAS, the City Planning Commission has recommended the
changing of said Zoning Ordinance on the above described propertyfromRSresidentialSingleFamilyDistricttoI
Industrial District which said meetingwas
held on the 6 day of May , 1986
NOW THEREFORE, BE IT ORDAINED by the City Council of the City
of Georgetown, Texas, that the Zoning Ordinance,and the Zoning
