The Georgetown City Council will meet on Tuesday, November 8, 2005 at 06:00:00 PM at City Council
Chambers, at the northeast comer of Seventh and Main Streets, Georgetown, Texas.

Environmental Quality (TCEQ) for annual wastewater plant assessment fees in the amount of
$27,108.40.
ITEM SUMMARY:
Each year the City receives invoices from the TCEQ for state mandated wastewater plant
assessment fees. Payment of these fees is required for all entities operating wastewater treatment
plants in the State of Texas.
The assessment fee for Georgetown's wastewater treatment plants is as follows:
San Gabriel WWTP $12,525.00
Dove Springs WWTP $ 7,053.00
Pecan Branch WWTP $ 5,315.00
Berry Creek WWTP $ 1,415.40
Cimarron Hills WWTP $ 800.00
The total of all assessment fees for FY05/06 is $27,108.40.

Second Reading of an Ordinance of the City of Georgetown, Texas denying ATMOS Energy Corp.,
Mid -Tex Division's request authorizing the compliance tariffs for the Annual Gas Reliability Infrastructure
Program rate adjustment in this municipality.
ITEM SUMMARY:
In December, 2004, ATMOS Energy filed an application requesting approval of the companys Annual
Gas Reliability Infrastructure Program (GRIP) rate adjustment for the customers in Georgetown. In March,
2005, the Railroad Commission of Texas approved Docket No. 9560, the company's same adjustment for
the pipeline components within the ATMOS system. As a part of this process, the Commission changed a
couple of items in the Company's original filing. The first item was to allocate the revenue to be collected
through the interim rate adjustment along the companys customer classes in the same manner as the cost
of service was allocated among customer classes in the company's most recent rate case. The second item
was to calculate the adjustment to the monthly meter charge by dividing the total interim rate revenue per
customer class by the number of customers or meter charges per year per customer class. The Commission
did this so that system -wide tariffs would be consistent.
Included in your packet is an example of the proposed compliance tariff that composes these rate
changes.
Provided to staff were two options for Council consideration to approve the tariff or to deny the tariff.
Staff has reviewed this with representatives at ATMOS Energy and considered it internally along with other
cities and recommends that the City or Georgetown approve the Ordinance to deny the rate adjustment going
into effect A denial vote for this rate adjustment simply temporarily suspends the Railroad Commission action
for implementation of this rate for approximately 45 days. Even though a vote of denial delays implementation
of this rate, if the Railroad Commission of Texas and its staff determines that it is an appropriate rate and an
appropriate filing, then this rate will go into effect since the Railroad Commission does have ultimate authority
for the gas system rates of ATMOS Energy. Therefore staff recommends Council denial of the
implementation of this rate ultimately knowing that the Railroad Commission has final authority and will more
than likely approve the rate to be applied, but at a later time.

AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS
DENYING ATMOS ENERGY CORP., MID-TEX DIVISION'S
REQUEST AUTHORIZING THE COMPLIANCE TARIFFS FOR THE
ANNUAL GAS RELIABILITY INFRASTRUCTURE PROGRAM RATE
ADJUSTMENT IN THIS MUNICIPALITY
WHEREAS, The City of Georgetown ("City") as a regulatory authority,
has previously approved by ordinance or operation of law the Atmos Energy
Corp., Mid -Tex Division's ("Company") application requesting the annual gas
reliability infrastructure program rate adjustment for customers on the
Company's system -wide distribution system; and
WHEREAS, the City has original jurisdiction to evaluate the Company's
request as it pertains to customers of the Company served from the distribution
facilities located within the City, pursuant to Texas Utilities Code §§ 102.001 (b)
and 103.001;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
GEORGETOWN, TEXAS:
SECTION 1. That the Company's request to authorize the compliance
tariffs for an annual gas reliability infrastructure program rate adjustment with
respect to customers served from the Company's distribution facilities located
inside the City, as part of the Company's system -wide gas utility system, is
denied in all respects.
SECTION 2. That this Ordinance shall become effective immediately
from and after its passage, as the law and charter in such cases provide.
SECTION 3. That is it hereby officially found and determined that the
meeting at which this Ordinance is passed is open to the public as required by
law and the public notice of the time, place, and purpose of said meeting was
given as required.
SECTION 4. That a copy of this Ordinance, constituting final action on
the Company's request for an annual gas reliability infrastructure program rate
adjustment , shall be forwarded to the Company's designated representative
within 10 days at the following address: Richard Reis, Atmos Energy Corp.,
Mid -Tex Division, 300 South St. Paul Street, 8"' Floor, Dallas, Texas 75201.

City to approve or deny the filing by November 19, 2005 in order to allow coordinated handling
at the Railroad Commission of any appeals.
