ITEM SUMMARY:
On July 2, 2004, the City extended the enclosed offer to Tom N. Pilgrim on behalf of San Gabriel
Storage Systems Venture (Parcels 6 & 7) for the purchase of right-of-way and easements for the
planned improvements to SH 29 and CR 265. On July 22, 2004, Mr. Pilgrim responded with the
attached counter-offer(s). The City's appraiser, review appraiser and condemnation attorney have
provided comments via email addressing the counter-offers.
Staff is seeking Council's direction and authority to proceed with negotiations for the purchase of
Parcel(s) 6 & 7 as recommended by the City's appraisers and legal counsel.

As you are aware, the Texas. Department of Transportation ("TxbOT") will be•making
highway improvements to SH 29 West from IH -35 to River Chase Blvd. to, accommodate
existing and anticipated increased traffic demands along this section of SH 29. The City of
Georgetown ("City") will be acquiring the necessary •right-of-way on behalf of TxDOT, as well
as related utility easements on behalf of local utility providers.
In acquiring property for highway systems on behalf of TxDOT, the City must follow a
defined process set out in Title III of the Uniform Relocation and Real Property Acquisition
Policies Act of 1970.
As mentioned in my April 26,'2004 informational letter, the City needs to abquire a
portion of your property described above for right-of-way and easement(s). The proposed new
right-of-way tract(s) are identified by Parcel number with the corresponding easement tract(s)
being identified with the letter "Ell.
The City employed a qualified appraiser to determine the fair market value of your
property. Based on the appraisal, a copy of which is enclosed_ herewith, the City is authorized to
make the following offer for purchase of -your property.

For Parcels 6 and 7, 'a total of $134,906.33. This amount represents $83,853.60 for the
feesimple acquisition of 0.14 acres of right-of-way, $32,61/7.73 for a 0.104 -acre utility easement

The above offer is based on the difference between the fair market value of your whole
property before the taking without consideration of -the taking and effects of the construction
project, and the fair market value of your remaining property after the taking, considering any

The partners who own the above captioned property have studied the proposal made by
the City and the Appraisal, which was the supporting document. We have some
reservations concerning the City's proposal, which are outlined below.
1. No comparable values on land sales (which are readily available) in the
immediate area were considered in the appraisal. Some of these values were of a
significantly higher per square foot cost than those used, and one adjoins the
subject tract.
2. The costs necessary to deconstruct and then re -construct the buildings in order to
continue their use in a manner as close as possible to their current use is probably
lower, by a factor of 3, than what we anticipate our costs will be. This issue can
be resolved quickly and easily simply by obtaining bids for the necessary work.
To that end, the Owners have already requested a bid from F.T. Wood
Construction and would be happy to have the City ask other contractors to
provide estimates or bids.
3. The largest concern the Owners have is in the value of the taking. The appraisal
contemplates the value of the land to be $54,885.60 and the value of the land
affected by the utility easement to be $32,617.73. Therefore, the appraised value
of the land taken in full or in part is $87,503.33. The appraiser's estimated cost to
repair the buildings and site adequately to bring it back into similar condition was
$18,435.00. This produces a total of $105,938.33. The Appraiser determined that
the improvements had a value of $28,968.00 That value was derived, according
to the appraisal, by the Cost Approach method.
The Owners of this property are not holding it for the purpose of re -building the
structures. In fact, it is not really being held for resale. This property is being held
for the production of income. It has produced income for these Owners for
approximately twenty years and is anticipated to continue doing so for many years to
come. Therefore, an Income Approach method of valuation is appropriate and
necessary.
Under the current rental rates and given the current average operating expenses, the
units lost to the Owners produce the following:
Gross Annual Rents $12,060
Annual Operating Expenses 3,618
Net Operating Income $ 8,442
Mini -Storage or Self Service Storage Units are selling with capitalization rates as low
as 7 and as high as 9. Given the location of these units, the Owners believe that a
capitalization rate of 8 is extremely viable. That would indicate a value of
$105,525.00. That amount added to the land value would produce a total value of the
property taken equal to $193,02833. Tbat, plus the actual costs to repair the
buildings and site, as close to their current condition as possible, is the amount the
Owners believe the City should be paying for this taking.
There are some other issues pertaining to the taking of this property, which also need
to be clarified
1. Access. Driveways and exclusive usage
2. Utilities. Water and wastewater services
3. Stone water detention/filtration requirements
4. Future development requirements
While the Owner, anticipate many years of continued operation in its current use, the
above information would be helpful.

Response to letter from the property owners:
1. The comparable sales used are considered the best available for comparison to the subject
property. Two sale transactions have occurred in the immediate neighborhood, with both
tracts being purchased by a Wolf Family member for assemblage. The value paid for
these properties may or may not be similar to market value but the transaction does not
meet the definition of market value based on a willing buyer and seller. As a matter of
fact the property next door sold for +/-$8.70/SF without allocating any value to the
improvements. I estimated the land value of the San Gabriel Storage at $9/SF. The
property owner appears to be misinformed about the neighborhood sales.
2. The owner indicates cost to "deconstruct and reconstruct", however, the only cost I
provided as damages was the cost to reconstruct. The highway contractor will be
responsible for the removal per the cities instruction. The reconstruct estimates are based
on data from the Marshall and Swift Cost Service. Every contractor solicited to give a
cost estimate will be different. The damages estimate provided attempts to provide a
"reasonable" estimate. This could be an area where an on-site contractor will discovery
unknown conditions or requirements for the completion of the repairs resulting in
increased or decreased costs. Without specific engineering/architectural plans the repair
costs are just estimates.
3. I have estimated the total property "take" to be $116,471. Per the owners own capitalized
income estimate he estimates the total "take" to be $105,525. My estimate of the take is
above the owners own estimate.
The owner the improperly adds his estimate to the land value. In the income approach the
generation of income or the loss of income is attributed to the whole property not just the
improvements. Thus, the capitalized loss of income value is for the whole property not
just the lost improvements.

I have reviewed the counter offer by Tom Pilgrim for the San Gabriel Storage property. I am addressing
his outlined concerns.
1. The land value seems reasonable and supported based on the sales used in Jimmy Vick's appraisal.
Mr. Pilgrim stated there were sales at a higher price psf, however, he did not include any sales to support
his claim.
2. Costs to Cure should be obtained by estimates from local contractors. While the Marshall & Swift
cost estimates are utilized by many appraisers in the Cost Approach, for cost to cure items I suggest
estimates from local contractors are more suited. Therefore, additional cost information will be needed.
3. The owner suggests that the compensation for the taking should be arrived via the Income Approach.
In theory, all 3 approaches to value should yield similar results. In addition, in order to arrive at the
Income Approach the owner will need to provide the appraiser with the current rent roll and
Income/Expense Statement for the previous 12 months. The appraiser can't accurately determine the Net
Operating Income of the subject without this information. As such, more information is needed from the
owner in regards to this.

Sorry, Terri -- I was tied up with other stuff yesterday and couldn't get to
them. I'll get you those drafts today.
On Parcels 6&7, I've still not received any income or expense information
from Tom Pilgrim to analyze his $105,525 proposed income loss. He did say
we were free to have someone else do a reconstruction cost estimate, so if
Jimmy had someone lined up to do it, I would propose that we authorize that
so that we have something to compare to the bid Pilgrim's getting from F.T.
Wood.
With regard to parcels 6 & 7, my opinion remains that the owners are
entitled to the difference in fair market value before and after the taking,
based on an income approach, plus the cost to restore the buildings to a
usable state after the taking.
Until Pilgrim gives us his cost estimate from F.T. Woods construction, or we
get Jimmy's cost estimator to give us a bid, we will be unable to
specifically identify a cost to cure number.
I called Tom this morning to remind him to send me some income and expense
information by fax as he promised so we can more accurately evaluate his
lost income analysis.

SUBJECT:
Consideration and possible action to approve additional
project budget of $31,300.00 for the Airport Road Rehabilitation
project.
ITEM SUMMARY:
Council awarded the bid for the Airport Road Rehabilitation
project in the amount of $626,077.00 at the July 27, 2004 City
Council meeting. Staff's recommendation for the additional 5%
amount was placed in the item summary, but was not posted in the
required "subject caption". It was agreed that staff would present
this additional amount of $31,300.00 at the August 10, 2004 Council
meeting.
Therefore, staff recommends approval of the additional 5% to
the contract bid award for the Airport Road Rehabilitation Project
in the amount of $31,300.00.
SPECIAL CONSIDERATIONS:
None.
FINANCIAL IMPACT:
$31,300.00 will be encumbered to cover any additional or
incidental costs (if any) and will be paid from Account Number:
100-134-5801-00 General Fund Maintenance.
GUS BOARD RECOMMENDATION:
GUS Board recommended to Council award of the bid, (including
the 5% additional amount) for a total project budget of $657,377.00
at their July 22, 2004 meeting. Approved 5-0. (Patty Eason and
John Gavurnik absent).
STAFF RECOMMENDATION:
Staff recommends approval of the additional 5% in the amount
of $31,300.00 and a project budget of $657,377.00.

Consideration of an award of the annual bid for water and wastewater pipe and fittings to
various bidders in the estimated amount of $108,019.00.
ITEM SUMMARY
Bids were received for the purchase of water and wastewater pipe and fittings for a one-
year period beginning August 1, 2004 The staff recommendation is to award this bid to the low
bidder for each item, as designated by the star on the attached bid tabulation. For those items
grouped into lots, we are recommending an award be made to the overall low bidder for each lot.
These fittings are stocked in the City warehouse and are used primarily on the maintenance
of the water distribution and wastewater collection systems. Quantities shown on the bid
tabulation are estimates based on prior year usage and are not guaranteed amounts. Material will
be ordered on as needed basis.
SPECIAL CONSIDERATIONS
This bid was approved by the GUS Board at the July 22, 2004 meeting.
FINANCIAL IMPACT (cost of item, fund and division name, budgeted amt.)
Estimated total for this bid is $108,019.00. Funds for this expenditure were budgeted in
Water Maintenance of Utilities and Wastewater Maintenance accounts.

SUBJECT:
An ordinance of the City Council of the City of Georgetown amending
Chapter 10.04 of the Code of Ordinances by adding Section 10.04.070 establishing
lane use restrictions for trucks upon the portion of IH -35 lying within the
corporate limits of the City of Georgetown; declaring certain conduct to be
unlawful and containing findings and other provisions relating to the foregoing
subject; providing a conflict clause; providing a severability clause; providing
for publication and setting an effective date. (Second Reading)
ITEM SUMKARY=
The Texas Legislature passed Senate Bill 773 in 1997 allowing municipalities
to establish lane use restrictions for trucks on certain portions of controlled
access highways. The Texas Transportation Commission adopted rules for
implementation of this law which would require a city considering the adoption
of such an ordinance to hold a public hearing on the proposed draft ordinance to
establish the lane use restrictions. During the process of Austin, Round Rock and
Georgetown preparing ordinances and scheduling public hearings to adopt the lane
use restrictions, the legislature passed another Bill in 2003 allowing The
Transportation Commission, in addition to municipalities, the authority to create
truck lane restrictions. To simplify the process, The Texas Department of
Transportation asked the municipalities to allow the State to create the
restricted truck lanes.
An engineering study was conducted evaluating operation simulations and
crash records analysis. Stakeholder meetings and interviews were also conducted
as part of the study. The initial study was conducted evaluating the
restrictions during peak traffic hours (morning and evening). Austin, Round Rock
and Georgetown were in agreement that 24-hour restrictions would simplify the
restriction and make it easier to enforce. At the request of the municipalities,
a second study was performed evaluating 24-hour restrictions. The study found no
significant impact to making the lane use restrictions effective 24 hours a day.
The study found little, if any, travel time difference with the left lane
restrictions.
The real benefit to truck lane use restrictions was shown in Houston, where
a 68W reduction in crashes resulted from truck lane restrictions and enforcement.
TxDOT plans to have signs in place by the end of Summer 2004. Each City will be
responsible for enforcing the lane use restrictions. Staff recommends passing
the truck lane use restrictions ordinance for an additional safety measure for
vehicular traffic on IH -35.
