Monday, July 12, 2004
The City Council of the City of Georgetown, Texas, met in Regular Session on the above date with Mayor
Gary Nelon presiding.

Policy Development/Review Workshop
A Social Service Funding Applicant Presentations — Paul Brandenburg, City Manager
Representatives from the following organizations made presentations to the Council regarding their requests for
Social Service Funding

Donald Hale Capital Area Rural Transportation Systems requested funds to support program. Described program
and funding structure. CARTS is requesting $8,000 in funding. He confirmed that they are the only public
transportation in Georgetown. Fares are nationally set and subsized by government. Ridership from Georgetown in
2003 was 10,761 riders.
Joyce Haag, Family Eldercare, Inc. requested continued continued funding and described services to the Council.
Clarified the cost of guardianship is about $2,000 per year per guardianship.
Janet McTigue, Georgetown Area United Way - provided a presentation to Council regarding a home repair program
for low income housing that the United Way has partnered with several other organizations to provide. Habitat,
Knights of Columbus, see funding book. She discussed home repair programs in other cities, as well as affordable
housing and low income housing.
Discussion as to how the program is run should the funding become available. Purchasing home repair supplies at a
reduced rate and the labor is volunteer.
Sansing - Question as to whether or not a portion of HOT can go to Habitat - can we do that here?
Tax Code - Trish Carts will find out.
Jack Hunnicut and Pete Perry Ellis with the Georgetown Community Clinic discussed the history of the Clinic and its
role in the community. Clinic should be able to qualify as a FQHC clinic by the end of the year.
Holly Doggett, Georgetown Community Service Center (The Caring Place) - talked about the history of the Caring
Place and the services it provides to the community.

Roger Herrin, Georgetown Interfaith Caregivers - described the services the organization provides the elderly.
Requested $15,000 in funding from the City.
Barbara Pearce - Georgetown Project, The - introduced board members of the Georgetown Project. She gave a
brief overview of the needs of the youth in the community and the services that the Georgetown Project offers to
those youth at risk.
Bill Peel - Habitat for Humanity of Greater Georgetown, TX. Thanked Council for past support. He told Council that
they for the first time have sufficient land to build affordable homes and therefore would like to request that Council
award funding to help build 6 homes in the next 12 months.
Executive Director - Literacy Council of Williamson Co. only non-profit agency in Williamson County that provides
literacy for adults.
Deanne Schiffler - Project Graduation/Parents for Pride - described the purpose of Project Graduation.
Get Name R.O.C.K., Ride On Center for Kids talked to Council about the $5,000 to help with their budget - in kind
donation of water.
Harold McGrath - Stonehaven Senior Center - described the services provided by the center. Requests continued
support of the City.
Mona Bartosh - Williamson Co. & Cities Health District - Requesting $1.65 per capita. She told council that they
need this level of funding to maintain level of service and that they are facing cuts at the state and federal level. She
asked that the City use its current/updated population numbers when determining its funding level. She told Council
that all other cities increased their per capita rate to the $1.65 level.
Theresa Leftwich - Williamson Co. Crisis Center - described the services provided by the Center. She told the
Council that they are facing cuts at the state and federal level and need the funding to keep providing services.
Williamson Council on Alcohol and Drugs dba Lifesteps - No one addressed the council.
Robert Howard and Carolyn Livennan - Williamson-Bumet County Opportunities, Inc. - told council about the
services provided by WBCO.
Discussion regarding the types of services that fall under the Council's criteria for funding and the need for agencies
to be sensitive of the criteria when they fill out their funding applications.

B Budget Reviews
1. Public Safety (Police & Fire) -- David Morgan, Police Chief; Anthony Lincoln, Fire Chief; and
Micki Rundell, Director of Finance and Administration
Paul Brandenburg told Council that staff thought that it was important to have several separate
stand-alone meetings to discuss the cost of growth on this community, staffing, equipment, facilities, etc. and how
that impacts the budget. He also talked about how Scenario "H" impacted the public safety budgets. Chief Lincoln
and Chief Morgan addressed the Council regarding service delivery in the community, as well as the types of calls
that are coming in. There was further discussion regarding staffing requirements for both the police and fire
departments. There was also a brief discussion regarding joint dispatch with Williamson County in the future. There
was further discussion regarding budetary impacts historically and in the future. Kevin Russell provided an overview
of compensation issues relating to public safety and the competitiveness. Brandenburg gave council an overview of
what to expect in the budget with regard to public safety staffing. Council was also told that the Fire and Police are
preparing 5 year strategic plans.
There was further discussion regarding turnover and the indicators that are starting to show up that we need to plan
for. There was additional discussion regarding projecting revenues into the future possibly as much as 10 years to
help with our planning and to really focus on long range planning.
There was further discussion regarding the service contract the City has with the County to provide services outside
the City Limits, and the need for an Emergency Service Districts.

2. Parks & Recreation — Randy Morrow, Director of Community Services and
Mick! Rundell, Director of Finance and Administration
Paul Brandenburg told Council that staff was trying to clarify council's priorities with regard to
Randy discussed with Council the different types of parks that the City has and told Council how the City has
partnered with Home Developers to build park facilities in the subdivisons. He also discussed the Parks MasterPlan
and the trail system. He told Council how the Home Depot paid to have their retention pond look natural. He went on
to discuss future park development, including a 100 acre park on the west side of IH35, construct a community room
at the Parks & Recreation Administration Building, San Gabriel Park renovation, add new or replace unsafe
playgrounds as needed, first phase of a Skateboard park. He also discussed the results of the Parks Survey and the
Citizen Survey. He told Council that staff needs some direction from Council as to what they want to concentrate on
- neighborhood parks, community parks, trails, all of the above, etc. He also discussed ways to fund park
development.
There was some additional discussion as to the need to possibly look at developers or neighborhood associations
contribute to the maintenance of the park system. There was further discussion as to how this discussion ties in to
the FY 2004-05 Budget.
There was further discussion as to how the Parks Board can work with Council to ensure that the green space/river
corridor is preserved in the future. Randy explained to Council that the TP&W grants had conditions that the land
would always be park space.
Eason requested that we have a separate workshop on the whole philosophy of the Parks Department.
3. Affordable Housing -- Tom Yantis, Assistant City Manager and
Micki Rundell, Director of Finance and Administration
Tom Yantis told Council that Affordable Housing has been a priority of the Council for several years, but a defined
program has never been defined over the years and that we have fallen short. He went on to discuss household
income vs. the availability of housing in that income range. He showed Council that there is very little available
housing in the lower income levels. He told council that affordable housing is a problem in Georgetown. He told
Council that we to establish an Affordable Housing Task Force to review ........ (see Tom's presentation) and then
work with Council to develop an affordable housing program for the City of Georgetown.
He also gave the Council an overview of what the City has done to this point with regard to Affordable Housing.
Discussion regarding the need to look at livable as well as affordable housing under the perview of the Task Force.
He told Council that the success of some of the affordable housing programs a lot of times depends on local
governments being flexible in the development codes.

Policy Development/Review Workshop
Called to order at 5:00 p.m.
A Presentation and discussion regarding a 4A sales tax initiative for the City of Georgetown — Mark Thomas,
Economic Development Director
Nelon noted that this workshop was requested by the Council on April 27, 2004.
Rundell gave a presentation on sales tax, saying $0.0625 goes to state, and the city receives $0.01, the
Georgetown Transportation Enhancement Corporation (GTEC) receives $0.005, with $0.0025 to street
maintenance with a sunset provision in 2006. She noted that $0.0025 is currently available and not being
collected at this time.
Thomas introduced Jeff Moore of Brown & Hofmeister, consultants to the State for training regarding 4A
sales tax, and George Gomez, new member of the City Economic Development staff. With a slide
presentation, Moore reviewed 4A sales tax, generally, and gave examples of how it has been used by other
cities. He provided a handout and a slide presentation to define "project" for Sections 4A and 4B, as
amended by Texas House Bill 2912, effective June 20, 2003. There were questions from the Council.

Mayor Nelon welcomed the audience and gave a brief overview of meeting procedures.
H Announcements and Comments from City Manager
Brandenburg announced:
The Brazos River Authority will conduct a Stakeholder Forum on Tuesday, July 20, at Lake
Georgetown. He asked the Council to contact Shirley if they wish to attend.
Reminder about ethics training for Councilmembers at a special meeting on Wednesday, July 21,
at 5:00 p.m. in the Council Chamber, along with information for board/commission/committee
members who are encouraged to attend.
Public Wishing to Address Council
- Keith Peshak regarding City law enforcement matters
Peshak was not in attendance.
Marcell Ellison regarding renewal of the closed contract for roll -offs on construction sites.
Ellison noted that when a contractor negotiates a bid, they bid to have the site clean and safe, and
even on city projects they should be able to use the company of their choice. She said TDS can
charge more because they are the only vendor. She said surrounding school districts are paying
less for their sanitation collections than GISD pays.
Michael Schwartz regarding renewal of the closed contract for roll -offs on construction sites.
Schwartz said it would be in the City's best interest to allow open contracts for disposal within the
city limits and put out a new RFP for only residential, curbside service. He said currently,
commercial waste is subsidizing residential waste. He gave statistics that the rates in Georgetown
are higher than in other communities. He urged the Council to open the competition.
Sansing asked and Schwartz responded that both speakers are with Sentinel Waste.
Action from Executive Session on Monday, July 12, 2004
Motion by Snell, second by Sensing to authorize the City's lawyers to respond to the counter
offers received from landowners affected by the purchase of right of way and easements for
improvement of State Highway 29 and County Road 265 in a manner consistent with the direction
that Council gave to its lawyers last night at executive session. Approved 5-0. (Oliver abstained,
Smith absent)

Eason asked about the location of Corporate Express. Rundell said bids are solicited from local vendors
and a 5% advantage is given to them, but Corporate Express was able to provide the lowest bid.
P Consideration and possible action to approve the purchase of Electric System Mapping Software from
Utility Sciences Corporation, an Autodesk OEM Partner in the amount of $32,950 — Michel W. Mayben,

O Consideration and possible action to approve an amendment to the Municipal Wastewater Treatment Plant
Operations, Maintenance, and Management Services Contract between the City of Georgetown and the

Legislative Regular Agenda
Consideration and possible action to approve a contract with Williamson County in the amount of
$60,000 for rural fire protection service — Anthony Lincoln, Fire Chief
Lincoln explained the item and offered to answer any questions. Nelon asked and Brandenburg explained
the history of the rural fire protection contract. He noted that the calls have increased but the cost has
remained the same. He said the cost is based on square footage rather than on the number of calls
handled outside the city limits. He explained the options, including future pursuit of an Emergency Service
District (ESD) and potential leases to Williamson County Emergency Services for the space they occupy at
the fire stations. He said, based on the number of calls, the City should be receiving $400,000 rather than
$60,000. Brandenburg suggested that this year remain the same, but to take an aggressive look at
financing the fire department in the future. Carr pointed out that the $60,000 was due at the beginning of
the current fiscal year. Carr asked and Lincoln gave statistics on the number of times other departments
have assisted Georgetown. It was pointed out that mutual aid agreements could be negotiated with other
cities in the County rather than through the interlocal agreement with Williamson County. Snell asked and
Lincoln explained that an ESD is a taxing entity with a board to oversee a rural contract with a fire
department, not necessarily Georgetown, but it would be beneficial for the board to contract with
Georgetown because Georgetown has a good ISO rating. Brandenburg suggested adding language to the
agreement regarding charging rent to Emergency Services. Motion by Snell, second by Kirby to approve
the contract and add language regarding charging rent to the County at Fire Stations 3 and 4. Approved
6-0. (Smith absent)
T Consideration and possible action on an award of bid in the amount of $699,000.00 to Royal Vista
Construction for the construction of the Animal Shelter — Terry Jones, Purchasing Director and Micki
Rundell, Director of Finance and Administration
Jones explained the project. There were questions. Sensing asked that the item go before the Animal
Shelter Board before it comes to the Council for consideration. He also said he would like to see the project
re -bid. He said he thinks the price is "out of line." It was determined that the contract price is good until
August 8. Carr asked and Ken Finn explained the current status of the shelter, saying the biggest issue is
that the kennels are currently completely outdoors. Brandenburg noted that there are a number of animals
that have to be destroyed due to lack of space. Carr asked about construction during the winter. Yantis
said that was a driving force, to be able to bring the animals indoors before winter. Carr said he agreed with
Sansing to involve the Board and take a better look at the project. Yantis said he is concerned that
re -bidding it will cause the price to go higher and come in over the budget. Motion by Snell, second by
Eason to approve the contract. Oliver asked and was told there is room to add more kennels at a later

U Consideration and possible action to approve an amendment to the City's Wholesale Power Agreement
with the Lower Colorado River Authority (LCRA) — Michael W. Mayben, Energy Services Manager and Jim
Briggs, Assistant City Manager for Utility Operations
Mayben explained the item, saying this amendment is required annually. Motion by Kirby, second by Carr
to approve the agreement. Approved 6-0. (Smith absent)
V Item forwarded by Georgetown Utility System Advisory Board
Consideration and possible action to enter into an agreement for offsite utility construction cost sharing
between the City and Cottonwood Creek Development, LLC at a total cost of $463,440.00 — Glenn
Dishong, Water Services Manager and Jim Briggs, Assistant City Manager for Utility Operations
With a slide presentation, Dishong gave an overview of the improvements included in the agreement, and
explained that this is the Pinnacle Development. He said this is the first time to use the cost sharing
agreement for line extensions since adoption of the Unified Development Code. He noted that the
developer has certain line size requirements, but the City requires that the lines be larger for future
developments. Dishong noted that the Georgetown Utility System Board (GUS) recommends approval with
a difference in the caluclation of the line sizes required. Kirby asked and Dishong said the City could
require the developer to build to the current Master Plan, but the line sizes would not be the additional size
to be needed by the City. Kirby asked and Dishong explained that there is some risk, but the Master Plan
shows the infrastructure to be built by the City to handle the TerraVista Development and other areas to be
built in the future. Motion by Sensing, second by Eason to approve the agreement. Kirby said he will vote
for this cost sharing, but he still believes that development must pay its own way, and suggested that in the
future, the Master Plan be revised to ensure that developers pay for this type of future infrastructure.

W Consideration and possible action on an Interlocal Agreement with Williamson County to implement
Local Government Code Chapter 242 providing for regulation of subdivision plats in ETJ (HB 1445) —
Amelia Sondgeroth, Director of Planning and Development Services and Trish Carls, City Attorney
Sondgeroth explained the agreement, saying the plats would be governed under the Unified Development
Code, and the City Planning Office would be the shop for approval. She said the County Commissioners
Court approved unanimously. Motion by Snell, second by Oliver to approve the agreement. Approved
6-0. (Smith absent)
X Consideration and possible action to approve the selection of GX Creative Communications to develop a
new City of Georgetown brand and to authorize staff to negotiate and execute a contract in an amount not
to exceed $44,000 -- Tom Yantis, Assistant City Manager
Yantis explained that the brand will be used in marketing efforts and economic development. He said the
$44,000 is to cover the cost of creating the brand, and "rolling our the brand will come from individual
department budgets in the future. He said a Committee has been formed of staff and members of the Main
Street Advisory Board and the Economic Development Commission. He said proposals were received and
three businesses were interviewed. He introduced Chris Damon of GX Creative Communications who
explained the process to be used to create the brand. He said there will be focus groups made up of
members of the community to collect and provide input and the hope is to have the process complete by
the new year. Motion by Sensing, second by Eason to approve the contract. Snell asked and Yantis noted
that the Council will be kept aware of the progress of the process. Carr asked if Damon could explain what
is wrong with our current "brand." Damon said currently others decide "who we are." Approved 6-0.

Y Consideration and possible action to amend Resolution 060804-N, calling a Special Election on
Proposition 13 on September 11, 2004, to allow approval of the officials for said election and to revise
the ballot language — Sandra D. Lee, City Secretary and Trish Carls, City Attorney
Carts explained the amendments represented by this resolution. Motion by Cart, second by Sensing to
approve. Approved 6-0. (Smith absent) Sansing asked that there be another polling place on the east
side of town and an early voting location in Sun City.
Z Consideration and possible action on a Public Review Final Plat of 21.86 acres out of the J. Sutherland
City Council Meeting Minutes/July 13, 2004

Survey, to be known as Estates of Westlake, Phase 2, located along Whispering Spring Lane, with
variances to the Subdivision Regulations — Carla Benton, Development Planner and Amelia Sondgeroth,
Director of Planning and Development
Benton explained the item, saying the developer is requesting a change in right of way width from 60 to 50
feet, consistent with previous approvals, and a lower minimum lot width on specific lots due to karst
features. She noted that the Planning and Zoning Commission has approved. Motion by Sansing, second
by Carr to approve the Public Review Final Plat. Approved 6-0. (Smith absent)
AA Consideration and possible action on a resolution setting public hearing dates for the ordinance
annexing into the City 16.2540 acres, more of less, out of the Leroy B. Lord Survey, more particularly
described as Georgetown Village Section 5 — Ed Polasek, Chief Long Range Planner and Amelia
Sondgeroth, Director of Planning and Development
Polasek noted that several years ago this area was annexed without the formal public hearing process. He
said this would be involuntary annexation, but is exempted from the annexation plan process because there
are less than 100 tracts in the area. He said no tax bills have been sent to the homeowners in this area.
Motion by Snell, second by Oliver to approve. Approved 6-0. (Smith absent)
BB Second Readings
1. Second Reading of an ordinance amending Section 6.16.070(A)(3) of the Code of Ordinances of
the City of Georgetown pertaining to the denial of peddler and solicitor permits for applicants
convicted of certain offenses — Captain Robert Hernandez, Police Support Services and Trish
Carts, City Attorney
Carls explained the item and read only the caption of the ordinance on second reading. Motion by
Carr, second by Oliver to approve Ordinance No. 2004.40. Approved 6-0. (Smith absent)
2. Second Reading of an ordinance amending Section 2.36.020 of the Code of Ordinances,
pertaining to the qualifications for board, commission, and committee members, to add
provisions prohibiting service on more than one permanent board, committee or commission, and
making city employees ineligible for service as board, committee or commission members — Trish
Carls, City Attorney
Carts read only the caption and asked Council to make sure the language she added captures the
change requested by the Council on first reading. Snell said he isn't sure the language exactly
covers his intent. He asked that the word "on" in the phrase "on another (ward" be changed to
"from" another board. Motion by Snell, second by Kirby to approve Ordinance 2004-41 with the
change in language. Approved 6-0. (Smith absent)
CC Public Hearings/First Readings
1. First Reading for a Century Plan Amendment from Intensity Level 1 to Intensity Level 3 and 4 for
1,022.66 acres situated in the J. Thompson Survey, known as the Weir Tract, located on RR

Polasek explained the item, saying the owners of the Weir Tract note there is a need to address all
the competing interests adjacent to the Weir Tract to be consistent with the overall Transportation
Plan and Master Plan, saying the mining activities will cease within seven or eight years. He said
the City staff recommends approval.
Paul Linehan of Land Strategies, representing the owners of the Weir Tract, demonstrated with a
slide the issues to be considered regarding future roadways and park systems.
Speaker, James Bryant Boyd, resident of River View Estates, a representative of River View
Homeowners Association, said the residents are happy about the proposed development and are
only concerned about one small area to the southeast of the development. He asked that a mixed
use area be allowed as a buffer.

Speaker, Fran Bongiovanni, added the residents think the plans look great, but the commercial
portion will effect her home, and she asked the Council to approve the buffer of a greenbelt or
parkway to protect those seven houses.
Polasek said the buffer is 50 to 60 feet from the pipeline and there would be a required setback of
a minimum of 25 feet of vegetative buffer between residential and commercial.
Speaker, Jack Abraham, yielded his time to Bryant Boyd. Boyd said he realizes there are buffers
and setbacks, but those are not delineated on the plan at this time. He said he wants to make it
known that they want to maintain a buffer zone between commercial and residential.
Linehan said he has no problem putting a 100 -foot mixed-use buffer along the edge. Sensing
commended Linehan for his forward thinking. Eason said she also favors the buffer. Polasek
explained the way to accomplish the buffer. He said the ordinance will require a change in the
exhibit to show the mixed-use buffer. He read only the caption of the ordinance on first reading
after having satisfied the requirements of the City Charter.

We received and understood your letter of June 14, 2004 pertaining to Right Of Way acquisition of
some of our property on Highway 29. We look forward to working with the City and TxDOT in the
improvement of Highway 29 and County Road 265W.
We must however take issue with the appraisals that accompanied your letter. It is our opinion that the
Land Sale Comparables supplied in the appraisal for comparative values are not all current and are not
representative of land values in our immediate vicinity.
Our land is situated across the street from what is becoming the largest, most modem retail Shopping
Mall in this part of the county. This property is strategically located in an extremely desirable area and
will be a premier retail site. We currently have offers to back up our valuations of this site.
We are enclosing for your review several Land Sale Comparables that we think are more representative
of land values at this location (attachment A). These show that a more realistic value for the land in
question is at least $6.00 - $8.00 per square foot as compared to the $5.00 and $5.50 per square foot
shown in your appraisals.
We are also aware that this development process is bringing value to our property and other
neighboring properties in the form of improvements in utilities and storm water management. It is,
therefore, our intent to discount the value of the land you need for R.O.W. acquisition in a cooperative
effort to help facilitate and expedite this development process. This offer is based upon information
discussed in our meeting of June 21, 2004, the details being summarized in attachment B.
You are requiring 0.226 acres in Parcel No. 1 and 0.593 acres in Parcel No. 2 for R.O.W. acquisition
totaling 0.819 acres. We are prepared to offer this property to you for the RO.W. at $5.50 per square
foot or a price of $196215.02. We are also prepared to accent your combined offer of $110,154.00 for

1. The new Kohl's department store located on Lakeline Drive, a short distance
northeast of the intersection of Hwy. 183 and R.R. 620 in Williamson County.
The total property reportedly was right at 10 acres in size, all of which reportedly
was usable for development. Kohl's reportedly paid approximately
$3,000,000.00 ($6.90 per square foot) for this property.
2. The new Lowe's home improvement store located on the west side of IH -35
between Parmer Lane and Howard Lane in North Austin, Travis County. The
total size of this piece of property was 13.92 acres, all of which was apparently
usable. Lowe's reportedly paid $4,700,000.00 ($7.74 per square foot) for this
tract of land in November, 2002.
3. The Wal-Mart store on the west side of IH -35 between Parmer Lane and
Howard Lane in North Austin, Travis County. The total size of this piece of
property was 13.37 acres, all of which was apparently usable. Wal-Mart
reportedly paid $3,529,000.00 ($6.00 per square foot) for this tract of land in
November, 2002. Wal-Mart apparently had previously purchased the adjacent
(to the south) 23.795 acre property for $6,219,000.00 ($6.00 per square foot) in
February, 2002.
4. The new Home Depot home improvement store located on the southeast
corner of IH -35 and Howard Lane in North Austin, Travis County. The total size
of this piece of property was 12.2. acres, all of which was apparently usable.
Home Depot reportedly paid $4,385,000.00 ($8.25 per square foot) for this tract
of land in January, 2001.

Water shall be accessible to the property from the 12" water line along CR 265
on the north side of property.
The City of Georgetown shall not require the extension of water lines along Hwy.
29 frontage to serve the property.
From the fall line of the property where topography slopes west to east, storm
water shall be allowed to flow, without retention or filtration, offsite and will be
retained and filtered within the Simon Wolf Ranch Development.
The City of Georgetown shall provide access to the waste water line at the
southeast corner of subject land at property line of Doug Trainer and Lot 1,
Bonnett Subdivision, a subdivision of Record in Cabinet Q, Slide #119-120, Plat
Records, Williamson County Texas.
The City of Georgetown shall make waste water lines available to serve the
remainder of 5.23 -acre tract and the western half of Lot 1, Bonnett Subdivision a

I have reviewed the counter offer by WestinghouseRoad Ventures and the
response from Jimmy Vick concerning Parcels 4 & 15. While Jimmy's appraisal
is technically correct, a case can be made from the landowners point of
view. The sales used in the report range from $6.79 PSF to $9.00 PSF before
adjustments. After adjustments were made to the comparable sales, the
indicated adjusted price ranged from $6.79 PSF to $8.10 PSF. Giving the
landowner the "benefit of the doubt" I believe that a settlement of $8.00 to
$9.00 PSF is reasonable for the take. This dollar figure is clearly in the
range of the comparable sales utilized within the appraisal report.

Per your request I have reviewed the counter offer prepared by Westinghouse
Road JV on Parcels 4 and 15. The counter offer was made at $9.00/SF as
opposed to my appraised value of $7.00/SF.
Sales one and two presented by the land owner were purchased for assemblage
by the Wolf Family and were properties required for their future
development plans. These sales do not meet the definition of market value
for a willing buyer/seller. sale three is a pad lot in front of the new
HEB Center. The subject site is not a "pad" lot at 6.54 acres and is not
associated with any significant retail development. I certainly considered
this sale in my selection of land comparable but did not believe it was a
comparable to the subject tract. Sales 4 and 5 are "pad" lots in the
Lakeline Mall area and are not considered comparable.
The land owner disagreed with my selection of sales due to date of sale and
not representative of immediate market area. The sales he selected ranged
in date from 2001 to 2004 and two are extreme distances from the property.
A key sentence from the land owner is "will be a premier retail site". They
appear to be looking at the future when the site actually has utility
services and is subdivided into platted "pad" lots.

ITEM SUMMARY:

to SH 29 W by the Texas Department of Transportation and the associated improvements
to CR 265, it may be necessary to exercise the City's eminent domain rights to complete
the acquisition process.
The attached resolution formally documents the City's determination that public
convenience and necessity do indeed require acquisition of the various parcels and
easements, sets out the purposes for which the parcels will be used, and authorizes staff
to proceed with acquisition of the necessary right-of-way and easements by condemnation,
in the event agreement for compensation can not be reached with the landowners through
good faith negotiations.

1. That in order to promote the public health, safety, and welfare, public convenience
and necessity require the construction, reconstruction, improvement, operation and
maintenance of a public roadway and extension of water, wastewater, electric, or
other public utility lines on the real property described in the attached Exhibits 1, 2, 3,
4, 5, 6, 7, 8, 9, 14 and 15.
2. That public convenience and necessity require the acquisition of fee title to the
Property and other properties for the purposes of construction, reconstruction,
improvement, operation, and maintenance of a public roadway facility, and extension
of water, wastewater, electric, or other public utility lines, and appurtenances thereto.
That public convenience and necessity require the acquisition of a utility easement in
the real property described in the attached Exhibits 1E, 2E, 3E, 4E, 5E, 6E, 7E, 8E
and 9E for purposes of the construction, extension, improvement, operation and
maintenance of water, wastewater, electric, or other public utility lines.
4. That the City's agents, representatives, or employees are hereby authorized to:
a. Lay out the exact location of the land needed from the Property or other
properties;
b. Hire such engineers, surveyors, appraisers, title companies, architects, and
other persons or companies needed to effect the laying out of the facilities,
the establishment and acquisition of fee title to the required properties, and
the construction of the roadway facility, utility lines, and appurtenances
thereto;
C. Enter upon any property necessary for the purpose of surveying and
establishing the title, to determine adequate compensation for fee titles,
and to conduct tests;
d. Negotiate with the owners of any such properties for the purchase thereof,
e. To purchase fee title to the Property for the purposes stated herein, and to
purchase easement title to the Utility Easement, and execute all documents
necessary to acquire such properties and easements, all subject to express
approval of the specific, negotiated terms by the City Council;
f. Initiate eminent domain proceedings against the owner(s) of the Property
for fee simple title to the Property and for easement title for the Utility
Easement in the event the owner(s) fail to accept a bona fide offer to
purchase the Property and Utility Easement; and
g. Take whatever further actions deemed appropriate to economically effect
the establishment of the roadway facility, utility lines, and appurtenances
thereto.

5. That all previous acts and proceedings done or initiated by the City's agents,
representatives, or employees for the establishment of the roadway, including the

Utility Easement are hereby authorized, ratified, approved, confirmed, and validated.
This resolution shall take effect immediately from and after its passage.
6. The Mayor is hereby authorized to sign this resolution and the City Secretary to attest
thereto on behalf of the City of Georgetown.
7. This resolution shall be effective immediately upon adoption.

$24,000.00.
ITEM SUMMARY:
The BRA WWTP Operations contract provides for the City to directly
pay for "Pump and Haul" treatment for the Cimarron Hills Wastewater
Treatment Plant. The Council had previously approved the purchase of
CAPTEX pumping services to allow us to evaluate other operational
strategies.
The BRA conducted an evaluation of potential operations strategies
and determined that the continuation of "Pump and Haul" treatment was the
most cost efficient operational method. The BRA uses CAP-TEX, the most
economical hauler, for its hauling needs at the Wastewater Treatment
Plants. The item provides for the necessary contract amendment for the
BRA to directly pay for these services at an estimated cost of
$24,000.00.
SPECIAL CONSIDERATIONS:
None
FINANCIAL IMPACT:
Funds in the amount of $24,000.00 are currently available and will
be paid from the Wastewater Plant Operations budget.

Staff recommends amending the contract to allow BRA to coordinate

for
MUNICIPAL WATER TREATMENT PLANT OPERATIONS, MAINTENANCE
AND
MANAGEMENT SERVICES
for the
CITY OF GEORGETOWN, TEXAS
THIS AGREEMENT is made to be effective on the day of
2004, between the City of Georgetown, Texas (hereinafter "City"), a Texas home rule
municipality, the Brazos River Authority, (hereinafter "BRA"), a river authority of the state
of Texas. City and BRA are collectively referred to herein as "the Parties."
WHEREAS, City is the owner of a municipal wastewater treatment system that
presently consists of five wastewater treatment plants and the associated appurtenances;
and
WHEREAS, City selected BRA to operate, manage, maintain and repair City's
municipal wastewater treatment system; and
WHEREAS, this Agreement is an amendment of a prior Agreement between BRA
and City for the operations, management, maintenance and repair of City's wastewater
treatment facilities, titled "Agreement for Municipal Water Treatment Plant Operations,
Maintenance and Management Services for the City of Georgetown, Texas", with an
effective date of October 31, 2003, (hereinafter "Original Agreement'); and
WHEREAS, Section 3.8 of the Original Agreement provides that City shall, "Pay
directly for or conduct sludge transport from the Cimarron Hills and Berry Creek Plants to
the San Gabriel or Dove Springs plant for normal sludge wasting operations, including, the
cost of `Pump and Haul' treatment for the Cimarron Hills Plant"; and
WHEREAS, City has requested that BRA pay for "Pump and Haul" treatment for
the Cimarron Hills Plant and has agreed to reimburse BRA for the actual costs to BRA as a
result of providing this service to the City; and
NOW THEREFORE, in consideration of the mutual covenants and agreements set
forth herein, the Parties agree as follows:
GENERAL:
1.1 This Agreement is an amendment of a prior Agreement between BRA and
City for the operations, management, maintenance and repair of City's
wastewater treatment facilities, titled "Agreement for Municipal Water
Treatment Plant Operations, Maintenance and Management Services for the
City of Georgetown, Texas", with an effective date of October 31, 2003,
(hereinafter "Original Agreement').
1.2 Throughout this Agreement, the words and phrases contained in this
Agreement shall have the same meanings as set forth in the Original
Agreement, unless a different definition is set forth herein.
2. AMENDMENT FOR PUMP AND HAUL SERVICES:
2.1 Section 3.8 of the Original Agreement is hereby deleted.
2.2 Section 2.15 of the Original Agreement is hereby revised to read as follows:
Throughout the term of this Agreement, BRA shall:
2.15 Provide for the disposal of sludge to approved disposal sites.
Should the disposal costs for sludge increase to an amount in excess
of the amount indicated on Exhibit F, City and BRA agree to meet
and negotiate an increase in the Volumetric Fee for such sludge
disposal services. City agrees that it is the Generator of all sludge,
biosolids or other material produced at the Project.
In addition, BRA or a City -approved subcontractor shall conduct
sludge transport from the Cimarron Hills and Berry Creek Plants to
the San Gabriel, Dove Springs, or Pecan Branch Plants for normal
sludge wasting or "Pump and Haul" operations. BRA shall
separately invoice the City for the actual costs of such sludge
transport services and the City shall pay such invoices within thirty
(30) days of receipt.
At City's option, for sludge transport services occurring between the
dates of May 26, 2004, and the effective date of this Amendment,
City may forward unpaid invoices for those services to BRA, and
BRA shall pay the invoices and invoice the City for those services,
in the manner set forth above.
Both parties indicate their approval of this Amendment to the Agreement by their
signatures below, to be effective on the day of 2004.

ITEM SUMMARY:
The design and engineering of the Smith Branch Wastewater
Interceptor Phase III has been completed by Camp, Dresser & McKee,
Inc (CDM). The project replaces the existing 12" wastewater main
with a 21" main to allow for increased flows from areas developing
to the west of IH 35. Sealed bids for the construction of the
wastewater line were received June 3, 2004. Six bids were received.
The design engineer (CDM) has reviewed the bids and has
recommended the award of the bid to McLean Construction, Ltd.
McLean's bid was $319,856.20. Staff recommends that a total budget
be set for the project at $367,834.00 to include a contingency of
15%.

Systems, bids were received and opened for the Smith Branch Wastewater Interceptor,
Phase 3. The project includes 2,615 linear feet of 21 -inch wastewater line and 468 linear
feet of 12 -inch wastewater line, which provides improved overall wastewater system
capacity in order to serve Wolf Ranch. Six bids were received as shown in the summary
