The Georgetown City Council will meet on Tuesday, August 22, 2006 at 06:00:00 PM at the City Council
Chambers, 101 E. 7th Street, at the northeast corner of Seventh and Main Streets, Georgetown, Texas.

Consideration and possible action to approve a contract between Alaska Native Broadband 1 License,
LLC, a Delaware limited liability company and the City of Georgetown for the lease of space on the Central
Ave. Elevated Storage Tank and a site for cellular antennas and related equipment for $24,000 per year.
ITEM SUMMARY:
Representatives for Alaska Native Broadband 1 License, LLC, (Cricket) are proposing the installation
of antenna arrays on the water tank catwalk railing and associated support equipment on the ground within
the fenced area of the tank.
Cricket was required to perform a structural assessment and an interference study to ensure that the
antennas could be supported by the tower railing and that the antennas would not interfere with the
operation of the existing RF equipment. The results of the studies indicate that the railings will support the
antenna loading and that no interference with existitlg equipment is expected. The City also utilized the
services of its current tank inspection vendor, Dunham Engineering, to review the plans submitted by Cricket.
The terms of the agreement require a one time payment of $1,000 upon contract execution and an
annual payment of $24,000 upon completion of construction and thereafter for an initial term of 5 years.
Cricket has the right to extend the contract for four (4) additional terms of five (5) years each with the lease
price to be escalated by 15% for each succeeding term.

ELEVATED TANK LEASE WITH OPTION
THIS ELEVATED TANK LEASE WITH OPTION ("Lease") is entered into this day of
200_ ("Effective Date") by and between City of Georgetown, Texas ("Lessor") and
Alaska Native Broadband 1 License, LLC, a Delaware limited liability company ("Lessee").
1.
Option to Lease.
(a) In consideration of the payment of One Thousand and Noi 100 Dollars ($1000.00) (the
"Option Fee") by Lessee to Lessor, Lessor hereby grants to Lessee an option to lease the use of a portion of the real
property, including space on an existing elevated tank (the "Tank") located upon such real property, as described in
the attached Exhibit A (the "Property"), on the terms and conditions set forth herein (the "Option"). The Option shall
be for an initial term of six (6) months, commencing on the Effective Date (as defined above) (the "Option Period").
(b) During the Option Period and any extension thereof, and during the term of this Lease,
Lessor agrees to cooperate with Lessee in obtaining, at Lessee's expense, all licenses and permits or authorizations
required for Lessee's use of the Premises from all applicable government and/or regulatory entities (including, without
limitation, zoning and land use authorities, and the Federal Communication Commission ("FCC") (the "Governmental
Approvals"), including appointing Lessee as agent for all land use and zoning permit applications, and Lessor agrees
to cooperate with and to allow Lessee, at no cost to Lessor, to obtain a title report, zoning approvals and variances,
and land -use permits, and Lessor expressly grants to Lessee a right of access to the Property to perform surveys, soil
stability tests, and other engineering procedures or environmental investigations on the Property, necessary to
determine that Lessee's use of the Premises as defined below will be compatible with Lessee's engineering
specifications, system design, operations and Governmental Approvals. During the Option Period, Lessee may
exercise the Option by commencing installation of the Communications Facility (as defined below).
(c) If Lessee exercises the Option, then, subject to the following terms and conditions, Lessor
hereby leases to Lessee the use of that portion of the Property and Tank sufficient for placement of a
Communications Facility (as defined below), together with all necessary space and easements for access and utilities,
as generally described and depicted in the attached Exhibit B (collectively referred to hereinafter as the "Premises").
The Premises is located at 202 West Central Avenue, Georgetown, Texas 78628 and comprises approximately 200
square feet. Lessee's location on the Tank shall be at 115 feet above ground level.
2. Term. The initial term of the Lease shall be five (5) years commencing on the date of the exercise
of the Option (the "Commencement Date"), and terminating at midnight on the last day of the initial term (the "Initial
Term").
3. Permitted Use. The Premises may be used by Lessee for the transmission and reception of radio
communication signals and for the construction, installation, operation, maintenance, repair, removal or replacement
of related facilities, and only those antennas, microwave dishes, global positioning system antennas, equipment
shelters and/or cabinets and related activities as identified on Exhibit C. The installation by Lessee of any other
equipment of whatever nature at the Premises or on the Tank must be pre -approved by Lessor prior to such
installation.
4. Rent. Lessee shall pay Lessor, as rent, Twenty Four Thousand and No/100 Dollars ($24,000.00)
per year ("Rent"). Rent shall be payable on the first day of the first month following the Commencement Date and
thereafter Rent will be payable annually to Lessor at the address specified in Section 12 below.
5. Renewal.
(a) Lessee shall have the right to extend this Lease for four (4) additional five (5) year terms
("Renewal Term"). Each Renewal Term shall be on the same terms and conditions as set forth herein, except that
Rent shall be increased by fifteen percent (15%) of the Rent paid over the preceding term.
(b) This Lease shall automatically renew for each successive Renewal Term unless Lessee
notifies Lessor, in writing, of Lessee's intention not to renew this Lease, at least sixty (60) days prior to the expiration
of the Initial Term or any applicable Renewal Term. If Lessee shall remain in possession of the Premises at the
expiration of this Lease or any Renewal Tenn without a written agreement executed by Lessor and Lessee, such
tenancy shall be deemed a month-to-month tenancy under the same terms and conditions of this Lease.
6. Interference. Lessee shall not use the Premises in any way which interferes with the use of the
Property or Tank by Lessor, or lessees or licensees of Lessor, with rights in the Property and Tank prior in time to
Lessee's (subject to Lessee's rights under this Lease, including without limitation, non-interference). Similarly, Lessor
shall not use, nor shall Lessor permit its lessees, licensees, employees, invitees or agents to use, any portion of the
Property or Tank in any way which interferes with the operations of Lessee. Such interference shall be deemed a
material breach by the interfering party, who shall, upon written notice from the other, be responsible for terminating
said interference. In the event any such interference does not cease promptly, the parties acknowledge that
continuing interference may cause irreparable injury and, therefore, the injured party shall have the right, in addition
to any other rights that it may have at law or in equity, either to bring a court action to enjoin such interference or to
terminate this Lease immediately upon written notice.
7. Improvements: Utilities: Access_ Tank Maimenance.
(a) Lessee shall have the right, at its expense, to install, erect and maintain on the Premises
improvements, personal property and facilities necessary to operate its communications system, including radio
transmitting and receiving antennas, microwave dishes, global positioning system antennas, equipment shelters and/or
cabinets and related cables, conduits and utility lines (collectively the "Communications Facility") as shown in Exhibit
C. Lessee shall have the right to replace or upgrade the Communications Facility at any time during the tens of this
Lease. Lessee shall cause all construction to occur lien -free and in compliance with all applicable laws and
ordinances. The Communications Facility shall remain the exclusive property of Lessee. Lessee shall have the right
to remove the Communications Facility at any time during and upon termination of this Lease. The installation by
Lessee of any other equipment at the premises or on the tank beyond the scope of that shown in Exhibit C must be
pre -approved by Lessor prior to such installation and may be subject to additional rent. All installations shall be
subject to noise restrictions as imposed by Lessor from time to time.
(b) The final plans and precise location of the Communications Facilities (the "Final Plans")
shall be subject to approval by Lessor, which shall not be unreasonably withheld, conditioned or delayed. Lessor's
approval will be deemed to have been given when Lessor signs and returns a copy of the Final Plans to Lessee.
Lessor agrees to provide such approval within five (5) business days after the Final Plans are delivered to Lessor.
(c) Lessee, at its expense, may use any and all reasonable means of restricting access to the
Communications Facility, including, without limitation, the construction of a fence; however, such restriction cannot
impede Lessor's access to the Tank, Lessor's related equipment at the Property or any authorized third party's access
to the Tank and Property.
(d) Lessee shall, at Lessee's expense, keep and maintain the Communications Facility now or
hereafter located on the Property or Tank in commercially reasonable condition and repair during the term of this
Lease, normal wear and tear and casualty excepted. Upon termination or expiration of this Lease, the Premises shall
be returned to Lessor in good, usable condition, normal wear and tear and casualty excepted.
(e) Lessee shall have the right to install utilities, at Lessee's expense, and to improve the
present utilities on the Property (including, but not limited to, the installation of emergency power generators)
reasonably necessary to provide service to the Communications Facility. Lessor agrees to use reasonable efforts to
assist Lessee to acquire such utility service. Lessee shall, wherever practicable, install separate meters for utilities
used on the Property. In the event separate meters are not installed, Lessee shall pay the periodic charges for all
utilities attributable to Lessee's use. Lessor shall diligently correct any variation, intenuption or failure of utility
service.
(f) As partial consideration for Rent paid under this Lease, Lessor hereby grants Lessee an
easement in, under and across the Property for ingress, egress, utilities and access (including access for the purposes
described in Section 1) to the Premises adequate to install and maintain utilities, which include, but are not limited to,
the installation of power and telephone service cable, and to service the Premises and the Communications Facility at
all times during the Initial Term of this Lease or any Renewal Term (collectively, `Basement"). The Easement
provided hereunder shall have the same term as this Lease.
(g) Lessee shall have 24 -hours -a -day, 7 -days -a -week access to the Premises at all times during
the Initial Term of this Lease and any Renewal Term.
(h) Lessor represents and warrants that its operation of the Tank, exclusive of Lessee's
Communications Facility, including the fighting system, meets and will be maintained in accordance with all applicable
laws, rules and regulations, including, without limitation, rules and regulations of the Federal Communications
Commission, Federal Aviation Administration and all applicable local codes and regulations. Lessor shall maintain its
lighting systems, Tank antenna, transmission lines, equipment and building (if applicable) in good operating condition.
The costs of maintaining the Tank shall be home by Lessor with the exception of Lessee's Communications Facility
and except for damage to the Tank caused by Lessee or Lessee's agents, employees, contractors or subcontractors,
which shall be home by Lessee. Lessee shall repair at Lessee's cost any such damage, within forty-eight (48) hours,
and to the extent that such damage cannot be repaired within forty-eight (48) hours, Lessee shall make all efforts to
begin such repair and finish that repair in a timely manner. Should Lessor fail to timely make repairs required by this
Lease, Lessee may, at Lessee's option, make such repairs and Lessor shall promptly reimbursed Lessee for its
reasonable costs and expenses incurred in such repair.
(i) In the event Lessor fails to maintain the Tank lighting systems, Tank, transmission lines,
equipment and building (if applicable) as provided herein, Lessee shall have the right to withhold Rent payments to
Lessor if Lessor fails to make said repairs or to provide maintenance after Lessee has given Lessor five (5) days
notice of the need to provide maintenance and repairs, or, shall at Lessee's option and upon notice to Lessor,
terminate this Agreement. Lessee shall have the right to apply such Rent withheld hereunder to make the necessary
repairs and provide the necessary maintenance and Lessee shall not thereafter be responsible to Lessor for the Rent
withheld for such maintenance and repairs. Lessee's activities and operations and Communications Facility shall not
interfere with Lessor's maintenance and repair of the Tank in its fighting system.
0) Periodically, Lessor will require maintenance to the Tank, including re -painting of the
Tank. At such times, Lessor shall work with Lessee to minimize the impact to Lessee. During such period of time,
Lessee shall have the right to place or operate a temporary cellular site on wheels (commonly referred to as a
"COW") on the Property in a location reasonably acceptable to Lessor.
8. Termination. Except as otherwise provided herein, this Lease may be terminated, without any
penalty or further liability as follows:
(a) upon thirty (30) days written notice by Lessor if Lessee fails to cure a default for payment
of amounts due under this Lease within that thirty (30) day period;
(b) upon thirty (30) days written notice by either party if the other party commits a non -
monetary default and fails to cure or commence a cure of such default within that thirty (30) -day period and diligently
pursues such cure, or such longer period as may be reasonably required to diligently complete a cure commenced
within that thirty (30) -day period;
(c) immediately if Lessee notifies Lessor of unacceptable results of any title report,
environmental or soil tests prior to Lessee's installation of the Communications Facility on the Premises, or if Lessee
is unable to obtain, maintain, or otherwise forfeits or cancels any license (including, without limitation, an FCC
license), permit or Governmental Approval necessary to the installation and/or operation of the Communications
Facility or Lessee's business;
(d) upon thirty (30) days written notice by Lessee if it determines that the Premises are not
appropriate or suitable for its operations for economic, environmental or technological reasons;
(e) immediately upon written notice by Lessee if it is unable to occupy and utilize the
Premises due to a ruling or directive of the FCC or other governmental or regulatory agency, including, without
limitation, a take back of channels or change in frequencies;
(f) immediately upon written notice by Lessee if the Premises or the Communications Facility
are destroyed or damaged so as in Lessee's reasonable judgment to substantially and adversely affect the effective use
of the Communications Facility and such Communications Facility has been removed from the Premises and Tank. In
such event, all rights and obligations of the parties shall cease as of the date of the damage or destruction, and Lessee
shall be entitled to the reimbursement of any Rent prepaid by Lessee, except that any rent paid for the current year in
accordance with paragraph 4 shall not be considered prepaid. If Lessee elects to continue this Lease, so long as such
election is made within thirty (30) days of the written notice required by this paragraph, then all Rem shall abate until
the Premises and/or Communications Facility are restored to the condition existing immediately prior to such damage
or destruction; or
(g) at the time title to the Property or Tank transfers to a condemning authority, pursuant to a
taking of all or a portion of the or Tank sufficient in Lessee's determination to render the Premises unsuitable for
Lessee's use. Lessor and Lessee shall each be entitled to pursue their own separate awards with respect to such
taking. Sale of all or part of the Property or Tank to a purchaser with the power of eminent domain in the face of the
exercise of the power shall be treated as a taking by condemnation.
9. Taxes. Lessee shall pay any personal property taxes assessed on, or any portion of such taxes
directly attributable to, the Communications Facility. Lessor shall pay any real property taxes or other fees and
assessments attributable to the Property or Tank. In the event that Lessor fails to pay any such real property taxes or
other fees and assessments, Lessee shall have the right, but not the obligation, to pay such owed amounts and deduct
them from Rent amounts due under this Lease.
10. Insurance and Subrogation.
(a) Lessee shall provide Commercial General Liability Insurance in an aggregate amount of
One Million and No/100 Dollars ($1,000,000.00). Lessee may satisfy this requirement by obtaining the appropriate
endorsement to any master policy of liability insurance Lessee may maintain. Lessee shall provide Lessor with a
certificate of insurance within sixty (60) days after the Commencement Date or any renewal period thereafter.
(b) Lessor and Lessee hereby mutually release each other (and their successors or assigns)
from liability and waive all right of recovery against the other for any loss or damage covered by thew respective first -
party property insurance policies for all perils insured thereunder. In the event of such insured loss, neither party s
insurance company shall have a subrogated claim against the other.
11. Hold Hamdess.
(a) Only to the extent permitted by law, Lessee hereby agrees to indemnify, defend and hold
Lessor and its agents, contractors, employees, officers, and directors, harmless from and against any and all
claims, damages, losses and expenses, including but not limited to attorneys' fees and disbursements, arising
out of or resulting from any claim, action or other proceeding (including without limitation any proceeding
by any of Lessee's employees, agents or contractors) that is based upon 1) Lessee's breach of this Lease, 2)
the conduct or actions of Lessee within or outside the scope of this Lease, or 3) any negligent act or
omission or intentional misconduct of Lessee.
(b) Lessor hereby agrees to indemnify, defend and hold Lessee and its agents, contractors,
employees, officers, and directors, harmless from and against any and all claims, damages, losses and
expenses, including but not limited to attorneys' fees and disbursements, arising out of or resulting from any
claim, action or other proceeding (including without limitation any proceeding by any of Lessor's
employees, agents or contractors) that is based upon 1) Lessor's breach of this Lease, 2) the conduct or
actions of Lessor within or outside the scope of this Lease, or 3) any negligent act or omission or intentional
misconduct of Lessor.
(c) Notwithstanding anything to the contrary in this lease, the parties hereby confirm that the
provisions of Section 10 section I 1 shall surviv the expiration or termination of this lease.
(d) The terms of this section, or any other section in the Agreement do not alter Lessor's status as
an entity to assert its sovereign immunity, and Lessor does not waive its rights to assert its sovereign
immunity if allowed by law.
12. Notices. All notices, requests, demands and other communications hereunder shall he in writing
and shall be deemed given if personally delivered or mailed, certified mail, return receipt requested, or sent by for
next -business -day delivery by a nationally recognized overnight carrier to the following addresses:

13. Quiet Enjoyment. Title and Authority. Lessor covenants and warrants to Lessee that (i) Lessor has
full right, power and authority to execute this Lease; (ii) it has good and unencumbered title to the Property and Tank
free and clear of any liens or mortgages, except those disclosed to Lessee and which will not interfere with Lessee's
rights to or use of the Premises; and (iii) execution and performance of this Lease will not violate any laws,
ordinances, covenants, or the provisions of any mortgage, lease, or other agreement binding on Lessor. Lessor
covenants that at all times during the term of this Lease, Lessee's quiet enjoyment of the Premises or any part thereof
shall not be disturbed as long as Lessee is not in default beyond any applicable grace or cure period.
14. Environmental Laws. Lessor represents that it has no knowledge of any substance, chemical or
waste (collectively "Hazardous Substance") on the Property that is identified as hazardous, toxic or dangerous in any
applicable federal, state or local law or regulation. Lessor and Lessee shall not introduce or use any Hazardous
Substance on the Property in violation of any applicable law. Lessor shall be responsible for, and shall promptly
conduct any investigation and remediation as required by any applicable environmental law, with respect to all spills
or other releases of any Hazardous Substance not caused solely by Lessee, that have occurred or which may occur on
the Property. Each party agrees to defend, indemnify and hold harmless the other from and against any and all
administrative and judicial actions and rulings, claims, causes of action, demands and liability (collectively, "Claims")
including, but not limited to, damages, costs, expenses, assessments, penalties, fines, losses, judgments a td reasonable
attorney fees that the indemnitee may suffer or incur due to the existence or discovery of any Hazardous Substances
on the Property or the migration of any Hazardous Substance to other properties or the release of any Hazardous
Substance into the environment (collectively, "Actions"), that relate to or arise from the indemnitor's activities on the
Property. Lessor agrees to defend, indemnify and hold Lessee harmless from Claims resulting from Actions on the
Property not by Lessor or Lessee prior to and during the Term and any Renewal Term of this Lease. The
indemnifications in this section specifically include, without limitation, costs inured in connection with any
investigation of site conditions or any cleanup, remedial, removal or restoration work required by any governmental
authority. This Section 14 shall survive the termination or expiration of this Lease.
15. Assignment and Subleasing.
(a) Lessee may assign this Lease and any Easement granted herein upon thirty (30) days
written notice to Lessor so long as the person or business entity is (1) FCC licensed to operate a wireless
communication business; 2) a parent, subsidiary, or affiliate of Lessee or Lessee's parent; 3) merged or consolidated
with Lessee; or, 4) acquires more that fifty percent (50%) of either an ownership in Lessee or the assets of Lessee in
the "Metropolitan Trading Area" or "Basic Trading Area' (as those terms are defined by the FCC) in which the
Property is located. Upon such assignment, Lessee shall be relieved of all liabilities and obligations hereunder and
Lessor shall look solely to the assignee for performance under this Lease and all obligations hereunder. Lessee may
sublease the Premises, upon written notice to Lessor. Lessee may assign or sublease this Lease and any Easement
hereunder at any time to Cricket Communications, Inc upon written notice to Lessor.
(b) Additionally, Lessee may, upon notice to Lessor, mortgage or grant a security interest in
this Lease and the Communications Facility, and may assign this Lease and the Communications Facility to any
mortgagees or holders of security interests, including their successors or assigns (collectively "Mortgagees"),
provided such Mortgagees interests in this Lease are subject to all of the terms and provisions of this Lease. In such
event, Lessor shall execute such consent to leasehold financing as may reasonably be required by Mortgagees. Lessor
agrees to notify Lessee and Lessee's Mortgagees simultaneously of any default by Lessee and to give Mortgagees the
same right to cure any default as Lessee or to remove any property of Lessee or Mortgagees located on the Premises,
except that the cure period for any Mortgagees shall not be less than thirty (30) days after its receipt of the default
notice, as provided in Section 8 of this Lease. All such notices to Mortgagees shall be sent to Mortgagees at the
address specified by Lessee. Failure by Lessor to give Mortgagees such notice shall not diminish Lessor's rights
against Lessee, but shall preserve all rights of Mortgagees to cure any default and to remove any property of Lessee
or Mortgagees located on the Premises as provided in Section 17 of this Lease.
16. Successors and Assigns. This Lease and the Easement granted herein shall run with the land, and
shall be binding upon and inure to the benefit of the parties, their respective successors, personal representatives and
assigns.
17. Waiver of Lessor's Lien. Lessor hereby waives any and all Gen rights it may have, statutory or
otherwise concerning the Communications Facility or any portion thereof which shall remain Lessee's personal
property for the purposes of this Lease, whether or not the same is deemed real or personal property under applicable
laws, and Lessor gives Lessee and Mortgagees the right to remove all or any portion of the same from time to time,
whether before or after a default under this Lease, in Lessee's and/or Mortgagee's sole discretion and without
Lessor's consent.
18. Miscellaneous.
(a) The prevailing party in any litigation arising hereunder shall be entitled to its reasonable
attorneys' fees and court costs, including appeals, if any.
(b) Each party agrees to furnish to the other, within twenty (20) days after request, such
truthful estoppel information about the Lease as the other may reasonably request.
(c) This Lease constitutes the entire agreement and understanding of the parties, and
supersedes all offers, negotiations and other agreements. There are no representations or understandings of any kind
not set forth herein. Any amendments to this Lease must be in writing and executed by both parties.
(d) Each party agrees to cooperate with the other in executing any documents (including a
Memorandum of Lease in substantially the form attached as Exhibit D) necessary to protect its rights or use of the
Premises. The Memorandum of Lease may be recorded in place of this Lease by either party. In the event the
Property or Tank are encumbered by a mortgage or deed of trust, Lessor agrees, upon request of Lessee, to obtain
and famish to Lessee a non -disturbance and attornment agreement for each such mortgage or deed of trust, in a form
and content reasonably acceptable to Lessee. Lessee may obtain title insurance on its interest in the Premises. Lessor
agrees to execute such documents as the Title Company may require in connection therewith.
(e) This Lease shall be construed in accordance with the laws of the state of Texas.
(f) If any term of this Lease is found to be void or invalid, such finding shall not effect the
remaining terms of this Lease, which shall continue in full force and effect. The parties agree that if any provisions
are deemed not enforceable, they shall be deemed modified to the extent necessary to make them enforceable. Any
questions of particular interpretation shall not be interpreted against the draftsman, but rather in accordance with the
fair meaning thereof. No waiver by either party of any provision of this lease shall be deemed a waiver of such
provision with respect to any subsequent matter relating to such provision.
(g) The persons who have executed this Lease represent and warrant that they are duly
authorized to execute this Lease in their individual or representative capacity as indicated.
(h) This Lease may be executed in any number of counterpart copies, each of which shall be
deemed an original, but all of which together shall constitute a single instrument.
(i) All Exhibits referred herein and any Addenda are incorporated herein for all purposes.
The parties understand and acknowledge that Exhibit A (the legal description of the Property), Exhibit B (the
Premises location within the Property, including the location of the Tank), and Exhibit C (Description of
Communications Facility), may be attached to this Lease and the Memorandum of Lease, in preliminary form.
Accordingly, the parties agree that upon the preparation of final, more complete exhibits, Exhibits A, B or C, as the
case may be, which may have been attached hereto in preliminary form, may be replaced by Lessee with such final,
more complete exhibit(s). The terms of all Exhibits are incorporated herein for all purposes.
0) If Lessor is represented by any broker or any other leasing agent, (collectively, "Broker")
Lessor is responsible for all commission fee or other payment to such Broker, and agrees to indemnify and hold
Lessee harmless from all claims by such broker or anyone claiming through such broker. If Lessee is represented by
any broker or any other leasing agent, Lessee is responsible for all commission fee or other payment to such Broker,
and agrees to indemnify and hold Lessor harmless from all claims by such broker or anyone claiming through such
broker.
19. Cricket Acting Solely on Behalf of Lessee. Lessee and Lessor recognize and acknowledge that Lessee and
Cricket Communications, Inc. ("Cricket") have entered into a management services agreement providing for Cricket
to manage the build -out and operation of Lessee's network systems and facilities within the Austin market, subject to
Lessee's oversight, control and approval. In connection with this build -out, Lessee and Lessor recognize and
acknowledge that Cricket enters into this Lease on behalf of and for the benefit of Lessee. Accordingly, Cricket
represents and warrants that it has full power and authority to enter into this Lease on behalf of and for the benefit of
Lessee. Lessee and Lessor acknowledge that Cricket is acting solely as an agent for Lessee in connection with
leasing the Premises and, as such, agree that any obligations or liabilities arising hereunder shall be the sole
responsibility of Lessee, and that Cricket shall have no obligations or liabilities hereunder.

Consideration and possible action to approve the purchase of Bioxide chemicals from U.S.
Filter/Davis Process Products, of Sarasota, Florida, in an amount not to exceed $65,000.00.
ITEM SUMMARY:
In May 1998, Camp, Dresser and McKee, Inc performed a wastewater odor control study.
This study was performed as a result of Hydrogen Sulfide (1-12S) odor complaints in certain areas of
the City. The study evaluated different methods to mitigate the H2S problem with a
recommendation being made to use Bioxide, a product patented by U.S. Filter. Since July 1999, the
City has successfully used Bioxide to control odor problems.
City Council approved the purchase of Bioxide chemical in an amount not to exceed $50,000
on September 27, 2005. This item provides for additional purchases of $15,000 for a new total of
$65,000 for this fiscal year.
SPECIAL CONSIDERATIONS:
U.S. Filter is a sole source provider of Bioxide. The U.S. Filter/Davis Process Products is the
only location that bids will be received and processed for Bioxide.
FINANCIAL IMPACT:
Funds in the amount of $50,000.00 will be paid from the Wastewater Operations Fund (650-
110 -5303 -OC).
GUS BOARD RECOMMENDATION:
GUS Board recommended approval at the August 17, 2006 meeting. Approved 4-0 (Smith,
Eason & Hunnicutt absent)
STAFF RECOMMENDATION:
Staff recommends purchase of Bioxide from US Filter/Davis Process in the amount of
$65,000.

ITEM SUMMARY
Bids were received to provide the City with electric metering material for a twelve-month period
beginning September 1, 2006. The staff recommendation is to award this bid to the low bidder for each
line item, as designated on the attached bid tabulation.
Items on this bid are stocked in the City warehouse and are used by the Automatic Meter Reading
Department and the Electric Department for new meter installations and meter maintenance. The total of
this bid was based on an estimated quantity from the previous year.
