The Georgetown City Council will meet on Tuesday, August 26, 2008 at 06:00:00 PM at City Council
Chambers, at the northeast corner of Seventh and Main Streets, Georgetown, Texas.

Public Wishing to Address Council

ITEM SUMMARY:
In 2004, the City acquired a 0.0411 -acre portion of Lot 1, Industrial Park North, as
described above, for purposes of constructing the northeast segment of the Georgetown
Inner Loop from CR 151 to N. Austin Ave. at its intersection with Lakeway Drive.
Subsequently, Austin Title Company, inadvertently recorded a deed from the
subsequent owner, Lar -Lo, L.P., of the remaining portion of Lot 1, to the City, at the
same time the property was purchased by Lar -Lo, L.P.
The Texas Department of Transportation ("TxDOT") recently acquired, through
condemnation, the subject remainder of Lot 1 from the Lar -Lo, L.P., as part of its
realignment of the Lakeway Drive Bridge. In order for TxDOT to obtain clear title to
the property and release funds to Lar -Lo, L.P., the City is being asked to issue a
Quitclaim Deed and Disclaimer of Interest to confirm it has no interest in the remainder
of Lot 1. It is Staffs understanding that the City has no interest in the subject remainder
of Lot 1, nor any objection to the execution of a Quitclaim Deed or Disclaimer of Interest
with respect thereto and, therefore, recommends Council approval.

ITEM SUMMARY:
The Brazos River Authority manages, maintains, and operates the City's Wastewater
Treatment facilities under a 5 -year contract ending September 30, 2008. The contract provides
for the City to pay a constant rate of $799.11 for each million gallons of wastewater treated
based upon a sludge disposal maximum of $14.50 per cubic yard.
The cost of sludge disposal has increased to $30.75 per cubic yard throughout the current
fiscal year and the contract provides for reimbursement of the additional cost either through
amendment of the volumetric rate or other unspecified means. The City and BRA have agreed
to direct reimbursement of the additional costs on a quarterly basis. This item is required to
increase the total appropriated funds authorized for this contract by $155,000.00.

CITY OF GEORGETOWN, TEXAS
THIS AGREEMENT is made to be effective on the11 tk day of
2007, between the City of Georgetown, Texas (hereinafter "City"), a Texas home rule
municipality, the Brazos River Authority, (hereinafter "BRA"), a river authority of the state
of Texas. City and BRA are collectively referred to herein as "the Parties."
WHEREAS, City is the owner of a municipal wastewater treatment system that
presently consists of five wastewater treatment plants and the associated appurtenances;
and
WHEREAS, City selected BRA to operate, manage, maintain and repair City's
municipal wastewater treatment system; and
WHEREAS, the parties entered into the "Agreement for Municipal Wastewater
Treatment Plant Operations, Maintenance and Management Services for the City of
Georgetown, Texas", effective October 31, 2003, ("Original Agreement'), and the
Original Agreement has been amended five times since the effective date ("Amended
Agreement"); and
WHEREAS, Article 4.0 of the Original Agreement provides for the annual revision
of the Original Agreement each Contract Year, with such revision to be accomplished by
updating and revising certain appendices to the Original Agreement as necessary; and
NOW THEREFORE, in consideration of the mutual covenants and agreements set
forth herein, the Parties agree as follows:
1. GENERAL
1.1 This Agreement, referred to herein as the Sixth Amendment, is an
amendment of the Original Agreement, as amended by the First, Second,
Third, Fourth, and Fifth Amendments. Except as expressly modified herein,
the terms of the Original Agreement shall remain in full force and effect.
1.2 Throughout this Sixth Amendment, the words and phrases contained in this
Agreement shall have the same meanings as set forth in the Original
Agreement, unless a different definition is set forth herein.
2. AMENDMENT FOR THE FIFTH CONTRACT YEAR
3.1 Appendix F of the Amended Agreement "Cost and Payment Summary for
Contract Year Oct 31, 2006 — Sep 30, 2007' is hereby deleted and
replaced with the revised Appendix F attached to this Sixth Amendment.
Both parties indicate their approval of this Sixth Amendment to the Agreement by the
signatures of their duly authorized representatives below, and agree that the terms of this
Sixth Amendment shall be effective on October 1, 2007.

Buchanan. The City has experienced a very limited response to the advertisements attempting to
recruit applicants for this position, and to date, only one qualified applicant has applied. This
applicant had already accepted a position with another employer when we contacted him about his
application. Efforts continue to fill the position; however, it appears that it may be some length of

City Provided Information or Work: The City shall provide the following services or perform the
following work (describe):
• Current version of the MilSoft Windmil Map of GUS Electric System
• Current copy of the MilSoft Windmil engineering analysis model of GUS Electric System
• Access to GUS Electric System facilities upon request
• Access to GUS Electric System operating parameters on a frequent, regular basis
• Preliminary Design information for both CIP and Developer requested modifications to the GUS
Electric System
• Scheduling and facilities for necessary meetings
Any documents or information related to the Work/Services provided by the City to the Professional,
including, without limitation, engineering studies, maps, reports, filed data, notes, plans, diagrams, sketches,
or maps (the "Information") is and shall remain the property of the City, and Professional shall have no
ownership or other interest in same. The Professional shall deliver to the City, if requested, a written
itemized receipt for the Information, and shall be responsible for its safe keeping and shall return it to the
City, upon request, in as good condition as when received, normal wear and tear excepted.

o Estimate labor/cost to proceed with detail design work upon receipt of such drawings,
load calculations, and other detail information required to design a complete construction
package for each project
General Electrical Distribution System Engineering work to include;
o Evaluating system modifications and load additions to determine impact on the overall
electric distribution system, fault current changes and load balancing on feeder circuits
o Recommending operating changes and system upgrades to accommodate system
modifications and load additions along with phase balancing and conductor loading
o Monitoring electric distribution system parameters, such as substation transformer
loading, feeder circuit loading, relay settings, fuse ratings, power factor
o Recommending operating changes to improve and maintain system efficiency, quality,
and load -handling capabilities
o Recommending feeder re-conductoring, voltage -conversions or other circuit upgrades,
additional feeder ties, feeder circuit tie and switching locations to maximize feeder
performance and reliability
Schedule: (describe in detail using additional or separate sheets ifnecessary):
This task is intended to cover approximately six (6) months, beginning on September 1, 2008,
however, depending on the amount of work assigned, this time period may be shorter than
anticipated. The items under the scope of work above shall be completed as directed by city staff
within this time period. Renewal of this task will be evaluated when the funding reaches 90% of
the appropriation for this task, and/or at the end of the six-month time estimation, whichever
comes first.
Statement Regarding Non -Collusion; Prohibited Financial Interests; Prohibited Political
Influences: (Per Article 36 in the Master Service Agreement): Professional hereby represents and
warrants to City that Professional shall not perform any work or services for a third party that is
potentially or actually related to, connected to, a part of, or integral to the work or services that it has
performed is or is performing for the City under this Task Order. Professional shall have the affirmative
duty to bring all such conflicts or potential conflicts to the attention of the City, and Professional agrees
that the City shall be the sole judge as to whether a conflict or potential conflict of interest with work for
private parties or Developer work exists. If in the judgment of the City such a conflict or potential
conflict between City work and Developer work exists, then Professional agrees to terminate all work
under the affected Task Order(s) immediately and that it shall not be eligible for payment for such
services.

ITEM SUMMARY -
South Church Street between University Avenue and 21ft Street was designated as no
parking zone prior to the Texas Department of Transportation releasing jurisdiction and
maintenance to the City of Georgetown. Church Street is narrow and carries considerable traffic
serving as a neighborhood collector. Staff feels the prohibited parking is necessary for the free flow
and expeditious handling of traffic and the safety of persons and property along Church Street.
Many of the original No Parking signs are still in place from the time when this roadway was
designated as FM 1460. Staff is proposing to replace old and missing signs with the passing of this
ordinance. This ordinance and official signage will allow the enforcement of this zone and
prosecution of violators.

WHEREAS, South Church Street between University Avenue and 2P, Street was
designated as a no parking zone prior to the Texas Department of Transportation
("TxDOT") releasing jurisdiction and maintenance of South Church Street to the City of
Georgetown and realigning FM 1460 to the west thereof, and
WHEREAS, this portion of South Church Street is narrow and well -traveled serving
as a neighborhood collector, and
WHEREAS, any parking of vehicles along this narrow roadway would slow or
prevent the movement of emergency response vehicles, and
WHEREAS, the City finds it to be necessary for the free flow and expeditious
handling of traffic and the safety of persons and property to restrict parking along certain
portions of South Church Street, and
WHEREAS, this ordinance, along with the installation of official signage in
accordance with the Texas Manual on Uniform Traffic Control Deviceswill promote the
safe movement of traffic and emergency vehicles along South Church Street and aid in the
enforcement of this zone and prosecution of violators.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, that:
SECTION 1. The facts and recitations contained in the preamble of this ordinance
are hereby found and declared to be true and correct, and are incorporated by reference
herein and expressly made a part hereof, as if copied verbatim. The City Council hereby
finds that this ordinance implements Transportation Policy 12.0 of the Century Plan - Policy
Plan Element, which states: "Georgetown's transportation system provides for the safe and

efficient movement of traffic, promotes the economic interests of the community, and
adequately serves the needs of individuals.'; and further finds that the enactment of this
ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required

SECTION 2. The City Council of the City of Georgetown hereby establishes a no
parking zone along both curb lines of Church Street between the south curbline of
University Avenue north to its intersection with 21s' Street.
SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions,
in conflict with this Ordinance are hereby repealed, and are no longer of any force and
effect.
SECTION 4. If any provision of this ordinance or application thereof to any person
or circumstance, shall be held invalid, such invalidity shall not affect the other provisions,
or application thereof, of this ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this ordinance are hereby
declared to be severable.
SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This ordinance shall become effective and be in full force and effect in
(10) ten days on and after publication in accordance with the provisions of the Charter of
the City of Georgetown.

(TxDOT) consider extending the 45 mph zone on RM 2243 (Leander Road) to a point
west of Riverview Drive. TxDOT has determined upon the basis of an Engineering and
Traffic investigation that the prima facie maximum Speed Limit on RM 2243 could be
adjusted. The 45 MPH Zone will now be extended to the west to include the intersection
of Riverview Drive. The Ordinance will also include the recently annexed portion of the
55 MPH Zone allowing enforcement by Georgetown Police Department to the new City
limit line.
The attached proposed Ordinance modifies the speed limit pursuant to
TxDOT's engineering and traffic study.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GEORGETOWN:
SECTION 1. The facts and recitations contained in the preamble of this ordinance
are hereby found and declared to be true and correct, and are incorporated by reference
herein and expressly made a part hereof, as if copied verbatim. The City Council hereby
finds that this ordinance implements the following elements of the Century Plan Policy
Plan and that the enactment of this ordinance is not inconsistent or in conflict with any
other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter the
Policy Plan:
Transportation Policy 10.00 of the Century Plan - Policy Plan
Element, which states: "Citizens and commercial goods move
safely and efficiently throughout all parts of the City."
SECTION 2. It is hereby determined upon the basis of an engineering and traffic
investigation that the prima facie maximum speed limit on those portions of RM 2243
routed in the City of Georgetown is hereby stated and shown on the diagram attached
hereto as Exhibit "A", which prima facie maximum speed limit shall be effective at all

times and signs will be erected giving notice of the prima facie maximum speed limit so
declared to wit:
SPEED ZONE
Eastbound:
On RM 2243 from mile point 15.806 (at the west Georgetown city limit) to mile point
19.331 (at Riverview), a distance of 0.960 miles, a prima facie maximum speed limit of 55
miles per hour.
On RM 2243 from mile point 19.331 (at Riverview) to mile point 20.685 (at IH 35), a
distance of 1.354 miles, a prima facie maximum speed limit of 45 miles per hour.
On RM 2243 from mile point 20.685 (at IH 35) to mile point 21.286 (at FM 1460), a
distance of 0.601 miles, a prima facie maximum speed limit of 40 miles per hour.
School Zone:
On RM 2243 from mile point 19.609 to mile point 20.245, a distance of 0.636 miles, a
prima facie maximum speed limit of 30 miles per hour when flashing.
Westbound:
On RM 2243 from mile point 21.286 (at FM 1460) to mile point 20.685 (at IH 35), a
distance of 0.601 miles, a prima facie maximum speed limit of 40 miles per hour.
On RM 2243 from mile point 20.685 (at IH 35) to mile point 19.331 (at Riverview), a
distance of 1.354 miles, a prima facie maximum speed limit of 45 miles per hour.
On RM 2243 from mile point 19.331 (at Riverview) to mile point 18.371 (at the west
Georgetown city limit), a distance of 0.960 miles, a prima facie maximum speed limit of
55 miles per hour.
School Zone:
On RM 2243 from mile point 20.245 to mile point 19.609, a distance of 0.636 miles, a
prima facie maximum speed limit of 30 miles per hour when flashing.
SECTION 3. That all of the streets of this city, and all portions of any such
streets, are hereby declared to be public streets and that the driving or operating of any
motor vehicle on or along any portion of any street of this city at a rate of speed that is
greater than the maximum rate of speed for said portion of said street, as fixed by this
ordinance shall be guilty of a misdemeanor, which is named "The Offense of Speeding'

and that the said offense is punishable by a fine in any sum not to exceed two hundred
dollars ($200.00). That the use of the word "Speeding" shall be sufficient to designate
the said offense, and shall mean that a motor vehicle has been driven upon a public
street at a greater rate of speed than fixed by City Ordinance for the street and for the
zone thereof, that such motor vehicle was so being driven upon, if zoned.
SECTION 4. That in prosecutions under this ordinance, for the offense of
speeding, the complaint, if in other respects sufficient in form, shall as to the portion
thereof seeking to acknowledge the offense, be sufficient if it in substance alleges that
the defendant did while driving a motor vehicle in said city commit the offense of
"Speeding".
SECTION 5. That should any section or any portion of any section hereof be
decreed to be void, the invalidity of such section or such portion thereof shall not affect
the validity of the remaining portions of this ordinance; and that each section and each
portion thereof not decreed to be invalid shall remain valid and enforceable.
SECTION 6. That all ordinances and parts of ordinances that are in conflict with
this ordinance are hereby repealed, including, but not limited to:
Sec. 10.12.070. R.M. 2243 (Leander Road).
SECTION 7. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This ordinance shall become effective in accordance with the
provisions of state law and the City Charter of the City of Georgetown.

ITEM SUMMARY
Booty's Crossing Road is a rural two-lane roadway with segments in the City and the County. The
existing speed zone configuration had three different posted speed limits varying between 30 and 40 MPH
posted along this relatively short roadway. Citizen reports indicate the signs to be confusing and not
applicable with the actual vehicle speeds or roadway conditions. City Staff gathered data of speeds and
traffic volumes. The roadway was visited and driven to study vertical and horizontal curves, driveway
spacing, intersections and other roadway conditions.
The Transportation Services Department has determined upon the basis of an Engineering and Traffic
investigation that the prima facie maximum Speed Limit on the portions of Booty's Crossing Road within the
City limits of Georgetown should be set at 35 miles per hour.
The attached proposed Ordinance modifies the speed limit pursuant to the City engineering and traffic
study.

FINANCIAL IMPACT:
None.
COMMENTS:
The findings of the investigations were shared with the County's Engineer. The County Engineer
was in agreement with the findings.

WHEREAS, a recent engineering and traffic investigation of Booty's Crossing
Road indicates that the prima facie maximum speed limit on a portion thereof should be
set at 35 miles per hour; and
WHEREAS, the City Council of the City of Georgetown, Texas, deems it
necessary and proper to amend Section 10.12.090(C.) of the Code of Ordinances of the
City of Georgetown, Texas, entitled "35 Mile Per Hour Zones', to add a portion of
Booty's Crossing Road lying within the corporate limits of the City of Georgetown.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, that:
SECTION 1. The facts and recitations contained in the preamble of this

of this ordinance is not inconsistent or in conflict with any other Century Plan Policies,
as required by Section 2.03 of the Administrative Chapter of the Policy Plan.
SECTION 2. Section 10.12.090(C.) of the Code of Ordinances of the City of
Georgetown, Texas, entitled "35 Mile Per Hour Zones", is hereby amended to add the
following as the next consecutively numbered paragraph:
"Booty's Crossing Road: Beginning at a point four hundred twenty (420) feet
south/west of the southern/western edge of the pavement of RM 2338 (Williams
Drive) and continuing along the remaining segment of Booty's Crossing Road

south/west approximately nine thousand (9,000) feet to the point of beginning of
a 10 -mile -per -hour speed zone three -tenths (311011) of a mile west of the City limit
(500 feet from the west curbline of Tortoise Lane) and continuing west along
Booty's Crossing Road through the Stilling Basin parking lot; said 10 -mile -per -
hour zone being further described in Section 10.12.090.A.1. hereof.
SECTION 3. This ordinance shall be and is hereby declared to be cumulative of
all other ordinances of the City of Georgetown, and this ordinance shall not operate to
repeal or affect any of such other ordinance(s), except insofar as the provisions thereof
might be inconsistent or in conflict with the provisions of this ordinance, in which event
such conflicting provisions, if any in such other ordinance or ordinances are hereby
superseded.
SECTION 4. If any provision of this ordinance or application thereof to any
person or circumstance, shall be held invalid, such invalidity shall not affect the other
provisions, or application thereof, of this ordinance which can be given effect without
the invalid provision or application, and to this end the provisions of this ordinance are
hereby declared to be severable.
SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This Ordinance shall become effective and be in full force and effect
ten (10) days on and after publication in accordance with the provisions of the Charter
of the City of Georgetown.
