Greer 1105 Ranch Road Georgetown, Tx Request: Current owner has requested a variance from Section 2.0203 (1) (b) of the City Zoning Ordinance to allow the construction of a detached accessory building some two feet inside the required seven foot side yard. Facts: Location: 1105 Ranch Road in the Country Club Estates Section Five, just west of Williams Dr. Existing Zoning: R -S Residential Single Family District Land Use: Subject property and all adjacent lots are single family residential use. Variance - Building Setback Line - 1105 Ranch Road - paae 2 Analysis: Section 2.0203 Area Regulations, Subsection l.b. Side Yard and Rear Yard of the City Zoning Ordinance reads: No structure shall be closer to a side or rear lot line than seven (7) feet or a distance equal to thirty-five (358) percent of the height of the structure, which- ever distance shall be greater. A detached accessory building may be located within three (3) feet of the rear lot line provided that the rear lot line is also a right-of-way line for a public alley or a public utility easement, provided such easement has a width of not less than ten (10) feet." Section 11.2 of the City of Georgetown Zoning Ordinance allows special exceptions provided that the applicant has not contributed to the hardship of which he complains. Modification of yard requirements are allowed if the parcel is of such restricted area or the shape of the lot is such that it cannot be appropriately developed without such modification. The applicant has not indicated any hardship to the staff. Planning Staff Recommendation: Denial of variance request unless some hardship can be illustrated. University Park - page 2 Facts: Location: South of Hwy 29 and northeast of Hutto Road. SurrOUhdinq Areas: Undeveloped land and proposed average and small lot single family residential. History: Plat was recorded August 5, 1985. Reference: Section 3.05 of Subdivision Ordinance reads: "The City of Georgetown will not furnish any City service temporary or permanent, or issue any plumbing, electric or building permits until all subdivision utility, street and drainage construction has been completed and accepted by the City of Georgetown." (No Exceptions) Analysis: Section 5.10 Variances of Subdivision Ordinance states that the City Council may approve variance to the street enforcement of the Georgetown Subdivision Ordinance when in its opinion the variance will not substantially violate the legislative intent. Applicant has offered the following conditions to secure variance: The following criteria will be met prior to issuance of a building permit: 1. A performace bond issued to the City of Georgetown will guarantee the completion of all unfinished improvements necessary for City acceptance of sub- division. 2. The public streets fronting the lots on which the model parks are to be built will be paved such that the lots will have access to exisiing public streets. 3. The City will not issue Certificates of Occupancy until all subdivision improvements have been completed and accepted by the City of Georgetown Public Works Department. 4. All other criteria the City of Georgetown has for issuance of building permits will be met. L University Park - page 3 The acceptance of surety agreements in lieu of completed construction is common practice for many Cities. Williamson County requires the posting of surety in conjunction with recordation for plats in the ETJ. This issue is also being considered by the Citizens Advisory Committee in the process of revising the City Subdivision Ordinance. Both the Public Works Division and the Building Department have indicated no objection to the requested variance. The Planning Department has concern about the precident which may be set by granting this variance. If a substantial number of projects are granted variance, it will significantly increase the demand on staff time to administer and coordinate this program. Also without clear, written procedural guidelines for administration the potential for error is high. Planning Staff Recommendation: Planning Department does not recommend granting of variance. City Council Action: (5-0) Granting of variance subject to the following conditions: The following criteria will be met prior to issuance of a building permit: 1. The following are staff recommendations relative to P & Z conditions 7 and 9 above which were to be negotiated prior to Council submittal: 1) Variances for street design as indicated by items 1,2, and 3 of the "Request" section of this report shall be granted with the following conditions: a) All roadways shall be designated as "Public Utility Easement and Safety Lane" on the plat and a note added to specify that they will be maintained by the Homeowners Association, provide access to City personnel, and prohibit any and all parking. b) The restrictive convenants shall be amended to prohibit on -street parking. c) The construction plans shall indicate that all curbs shall be clearly and permanently designated as "Safety Lane". 2) Variances regarding the size of parking spaces shall University Park - page 7 be granted conditional upon all spaces used to satisfy Ordinance requirements shall conform to the dimensions shown on sheet 8 of 8 of the submittal plans. 3) Variance allowing the proposed curb designs shall be granted conditional upon resolution to satisfaction of City Engineer during construction plan reveiw that drainage impacts have been mitigated.
