ITEM SUMMARY: The Water Service, Water Rights, and Facility Ownership Contract between the City of Georgetown and Chisholm Trail Special Utility District (CTSUD) dated February 23, 1999 allows CTSUD to continue to service customers in the Highway 195 service area until the City extends water lines into the area. The agreement also allows CTSUD to provide service to new customers in the area with the City's approval. This item describes the terms and conditions for the collection of impact fees in the Highway 195 area. In general, CTSUD will collect the City's water impact fee for new customers in the Highway 195 service area on the City's behalf and submit the fee to the City. Fees other than impact fees will be retained by CTSUD. ' • i c� �`M�f='fl None ATTACHMENTS: Agreement. tted By: Glenn Dishong, Water Services City Manager y Operations r STATE OF TEXAS § § AGREEMENT REGARDING § THE COLLECTION OF IMPACT FEES COUNTY OF WILLIAMSON § This Agreement Regarding the Collection of Impact Fees ("Agreement') between the City of Georgetown, Texas ("Georgetown"), a Texas home rule municipal corporation, and Chisholm Trail Special Utility District ("Chisholm Trail"), a political subdivision of the State of Texas, organized and operating under Chapters 49 and 65 of the Texas Water Code, is for the purposes and consideration set forth herein. RECITALS WHEREAS, Georgetown and Chisholm Trail entered into a contract entitled, "Water Service, Water Rights, and Facility Ownership Contract Between the City of Georgetown and Chisholm Trail Special Utility District" ("the Contract") on or about February 23, 1999; and WHEREAS, Georgetown and Chisholm Trail amended the Contract on or about February 22, 2000, and again amended the Contract on or about ; and WHEREAS, Article III of the Contract provides that Chisholm Trail will continue to provide water service to existing customers within an area described therein as the "Highway 195 Service Area" until such time as Georgetown completes construction of the necessary water system improvements for Georgetown to make service available to customers with the area; at which time Chisholm Trail will transfer the Highway 195 Service Area to Georgetown; WHEREAS, Article III of the Contract further provides that Georgetown is responsible for water service to all new customers in the area unless Georgetown and Chisholm Trail mutually agree that Chisholm Trail will provide interim water service to specific new customers; WHEREAS, Georgetown has not yet installed the necessary water system improvements to make water service available to the Highway 195 Service Area, and Chisholm Trail has received, and may receive additional, requests for water service from new customers within the Highway 195 Service Area prior to the time Georgetown installs the necessary water system improvements to make service available; and Agreement Regarding The Collection of Impact Fees City of Georgetown and Chisholm Trail SUD Page 1 of 4 I WHEREAS, Georgetown and Chisholm Trail desire to enter into this Agreement to set forth the terms and conditions pursuant to which Chisholm Trail will collect Georgetown's water impact fees from new customers served by Chisholm Trail on an interim basis until such time as the Highway 195 Service Area is transferred to Georgetown in accordance with the Contract. NOW THEREFORE, Georgetown and Chisholm Trail enter into this Agreement for purposes and consideration set forth herein as follows: 1. Collection of Impact Fees. (a) In the event that Georgetown and Chisholm Trail mutually agree that Chisholm Trail will provide interim water service to specific new customers in the Highway 195 Service Area prior to the date that such area is transferred to Georgetown in accordance with Section 3.4 of the Contract, then Chisholm Trail agrees to collect Georgetown's water impact fee from such customer as a condition of service, and to promptly remit such fee to Georgetown. Chisholm Trail will collect and retain all other fees, charges, and rates applicable to new customers of its water system. (b) Georgetown agrees that the impact fee to be collected by Chisholm Trail and remitted to Georgetown is a charge of Georgetown. Chisholm Trail assumes no obligation to defend such fee as to its validity, amount or method of calculation, and in the event that such fee is ever invalidated for any reason, Georgetown shall be responsible for all refunds and other costs, expenses or obligations that may arise under Chapter 395, TEx. LOCAL Gov'T CODE, or otherwise. (c) At the time of transfer of the Highway 195 Service Area from Chisholm Trail to Georgetown, Chisholm Trail will also furnish to Georgetown upon request the name of each new customer in the service area from whom Chisholm Trail has collected Georgetown's impact fee and other available account information so that Georgetown may properly account for such fees in accordance with the requirements of Chapter 395, TEx. LOCAL Gov'T CODE. 2. Effect on Contract. This Agreement shall not amend or revise the Contract in any way, and the Contract, as amended, shall remain in effect as written for all purposes. 3. Miscellaneous Agreement Regarding The Collection of Impact Fees City of Georgetown and Chisholm Trail SUD Page 2 of 4 (a) Execution. This Agreement may be simultaneously executed in any number of counterparts, each of which will serve as an original and, will constitute one and the same instrument. (b) Governing Law. This Agreement will be governed by the Constitution and laws of the State of Texas. (c) Successors and Assigns. The assignment of this Agreement by any party is prohibited without the prior written consent of the other party. (d) Headings. The captions and headings appearing in this Agreement are inserted merely to facilitate reference and will have no bearing upon its interpretation. (e) Partial Invalidity. If any of the terms, covenants or conditions of this Agreement, or the application of any term, covenant, or condition, is held invalid as to any person or circumstance by any court with jurisdiction, the remainder of this Agreement, and the application of its terms, covenants, or conditions to other persons or circumstances, will not be affected. (f) Waiver. Any waiver by any party of its rights with respect to a default or requirement under this Agreement will not be deemed a waiver of any subsequent default or other matter. (g) Amendments. This Agreement may be amended or modified only by written agreement duly authorized by the parties. (h) Cooperation. Each Party agrees to execute and deliver all such other and further instruments and undertake such actions as are or may become necessary or convenient to effectuate the purposes and intent of this Agreement. (i) Venue. All obligations of the parties are performable in Williamson County, Texas and venue for any action arising hereunder will be in Williamson County. 6) Third Party Beneficiaries. Nothing in this Agreement, express or implied, is intended to confer upon any person, other than the parties, any rights, benefits, or remedies under or by reason of this Agreement. 4. The Effective Date of this Agreement shall be as of February 1, 2005 Except as set forth above, all provisions of the Contract, as amended, shall remain in effect as written. ITEM SUMMARY Bids were received to provide the City with cold pour crack sealer for a one-year period beginning March 1, 2005. The staff recommendation is to award this bid to the low bidder responding, EZ Seal, LLC of Van Alstyne, Texas. This cold pour crack sealant will be used asphalt street repair and is ordered in 150 pound drums on an as needed basis. SPECIAL CONSIDERATIONS None FINANCIAL IMPACT Total estimated amount of this bid is $33,892.00. Funds were budgeted for this expenditure in Maintenance -Streets and Overlay-CIP. AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS, AMENDING SECTION 10.12.080 OF THE CODE OF ORDINANCES RELATING TO RATE OF SPEED AND SCHOOL SPEED ZONES ON F.M. 2338 IN THE CITY LIMITS OF THE CITY OF GEORGETOWN; DEFINING SPEEDING AND FIXING A PENALTY THEREFORE; PROVIDING A SEVERABILITY CLAUSE; REPEALING CONFLICTING LAWS; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Georgetown, Texas, deems it necessary and proper to amend Section 10. 12.080 of the Code of Ordinances of the City of Georgetown, Texas, to revise the speed zones and speed limits on FM 2338; and WHEREAS, the Council finds that it is necessary and proper and in the best interest of the citizens of Georgetown to adopt the changes hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following elements of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter the Policy Plan: Transportation Policy 10.00 of the Century Plan — Policy Plan Element, which states: "Citizens and commercial goods move safely and efficiently throughout all parts of the City. " SECTION 2. The existing text contained in Section 10.12.080 of the City of Georgetown Code of Ordinances is hereby amended to provide as follows: SECTION 10.12.080 F.M. 2338 It is hereby determined upon the basis of an Engineering and Traffic investigation that the prima facie maximum speed limit on those portions of FM 2338 routed in the City of Georgetown, is hereby stated, which prima facie maximum speed limit shall be effective at all times and signs will be erected giving notice of the prima facie maximum speed limit so declared to wit. Beginning at the West city limit of Georgetown at milepoint 10.491 to milepoint 13.468, a distance of 2.977 miles, a prima facie maximum speed limit of 50 miles per hour. 2. From milepoint 13.468 to milepoint 14.010, a distance of 0.542 miles, a prima facie maximum speed limit of 45 miles per hour. 3. From milepoint 14.010 to milepoint 14.337, a distance of 0.327 miles, a prima facie maximum speed limit of 40 miles per hour. 4. From milepoint 14.337 to milepoint 15.455, a distance of 1.118 miles, a prima facie maximum speed limit of 35 miles per hour. B. REDUCED SPEED SCHOOL ZONE From milepoint 15.055 to milepoint 15.174, a distance of 0.119 miles, a prima facie maximum speed limit of 20 miles per hour when flashing, 35 miles per hour at all other times. C. FOR WESTBOUND TRAFFIC 1. From milepoint 15.455 to milepoint 14.337, a distance of 1.118 miles, a prima facie maximum speed limit of 35 miles per hour. 2. From milepoint 14.337 to milepoint 14.010, a distance of 0.327 miles, a prima facie maximum speed limit of 40 miles per hour. 3. From milepoint 14.010 to milepoint 13.468, a distance of 0.542 miles, a prima facie maximum speed limit of 45 miles per hour. 4. From milepoint 13.468 to milepoint 10.491, a distance of 2.977 miles, a prima facie maximum speed limit of 50 miles per hour. D. REDUCED SPEED SCHOOL ZONE From milepoint 15.174 to milepoint 15.055, a distance of 0.119 miles, a prima facie maximum speed limit of 20 miles per hour when flashing, 35 miles per hour at all other times. E. That all of the streets of this city, and all portions of any such streets, are hereby declared to be public streets and that the driving or operating of any motor vehicle on or along any portion of any street of this city at a rate of speed that is greater than the maximum rate of speed for said portion of said street, as fixed by this ordinance shall be guilty of a misdemeanor, which is named "The Offense of Ordinance No. Speed Zones on F.M. 2338 Sec. 10. 12.080 Page 2 of 3 Speeding" and that the said offense is punishable by a fine in any sum not to exceed Two Hundred dollars ($200.00). That the use of the word "Speeding" shall be sufficient to designate the said offense, and shall mean that a motor vehicle has been driven upon a public street at a greater rate of speed than fixed by city ordinance for the street and for the zone thereof, that such motor vehicle was so being driven upon, if zoned. That in prosecutions under this ordinance, for the offense of speeding, the complaint, if in other respects sufficient in form, shall as to the portion thereof seeking to acknowledge the offense, be sufficient if it in substance alleges that the defendant did while driving a motor vehicle in said city commit the offense of .'Speeding„ SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown. Mark Miller, Transportation Services Manager and Jim Briggs, Assistant City Manager for Utilities.(First Reading) ITEM SUMMARY The Texas Department of Transportation (TxDot) has determined upon the basis of an Engineering and Traffic investigation that the prima facie maximum Speed Limit on those portions of FM 1460 lying within the City of Georgetown, should be modified. Item No. W action to approve a change order to the Deck Construction to increase the scope of water line replacement on Church Street at an ITEM SUMMARY: The original scope of the Church Street Project included sewer main repairs for EARZ, drainage improvements, and a complete street overlay. The original scope did not include replacement of the existing 2" and A" water line due to capital budget constraints and no indication of line deterioration. However, numerous leaks have been discovered during the construction activities and repairs have shown significant deterioration in the water lines. Replacement of the line with a new 8" water line is necessary to preserve the new pavement that will be applied at the end of this project. Also, replacement of this line will provide enhanced fire protection due to the addition of fire hydrants. A Change Order to the contract between H. Deck Construction for 13th Street Water Line Improvements was preferred over a change in scope to the Church Street Project because water line unit costs are not included in the Church Street project, and the water line unit costs in the existing H. Deck contract are very competitive. GUS BOARD RECOMMENDATION: GUS Board met just prior to this meeting. Recommendation will be presented during presentation to Council. STAFF RECOMMENDATION: Staff recommends approval of the change order to the H. Deck Construction contract in the amount of $139,200.00. SPECIAL CONSIDERATIONS: None.
