Variances are requested for: 1. Waiver of stormwater detention requirements 2. Reduction of 25 foot side yard setback for Lots 1 and 8 to 15 feet FOREST COURT - FINAL PLAT Facts• Location: The site is located within the City limits. It is near the northeast corner of the intersection of Forest and 16th Streets and is within the Edwards Aquifer Recharge Zone. Surrounding Area: Surrounding zoning is RS Residential Single Family. Single family residences lie adjacent to the east and at the northwest corner as well as west across Forest Street. A 2.0 acre City park is adjacent to the south. A vacant 1.85 acre tract is adjacent to the north. Existing Site: Largely vacant with heavy overgrowth. However, one small single family structure in poor condition is on the northwest corner. Proposed Use: Eight single family detached residences. The site is presently zoned RS Residential Single family. Development Plan: District 8a. The plan recommends normal single family development for the subject property. The proposed use substantially conforms to the plan. Utilities: City services have been requested for water, wastewater, and electrical services. History: On May 5, 1986, the applicant submitted a preliminary plat, site development plan, and zone change request for the Old Town Park Planned Unit Development (PUD) for Planning and Zoning Commission review. The requested PUD was to have allowed for 20 small lot single family detached residences. The request was denied by the Planning and Zoning Commission by unanimous vote on the grounds that the request was incompatible with the surrounding residential development and did not meet all of the ordinance requirements. On September 2, 1986, the Planning and Zoning Commission recommended conditional approval for the Forest Court preliminary plat. On September 23, 1986, the City Council approved the preliminary plat request with those conditions specified by the Planning and Zoning Commission, subject to Planning Department staff verification that right-of-way does not exist through the proposed subdivision. A variance request for FOREST COURT - FINAL PLAT 3 a waiver of stormwater detention requirements could not be acted upon by the Commission nor Council until the applicant submitted sufficient information that indicated a variance would present no adverse impact on the existing system. Variances for the elimination of 10 foot rear yard PUE dedication requirements and excessive depth to width ratios for Lots 3-6 were approved. Analysis• Land Use: The applicant is attempting to create an economically viable infill project for this long neglected problem site. Single family detached housing has been chosen due to both market conditions and an attempt to be more compatible with surrounding uses. The subdivision would create eight single family residential lots ranging from 6500 to 11,500 sq. ft. with a gross density of 4.3 dwelling units per acre. Such a design appears to be consistent and compatible with the surrounding land uses. As required in Preliminary plat approval, screening should be placed along the eastern and southern boundaries of the proposed subdivision. Streets: The plat indicates a 50 foot wide public street ROW with 30 feet of paving, with a cul-de-sac . This configuration is acceptable for adequate access to the lots and the accommodation of emergency service vehicles. Research into deed restrictions of property owners adjacent to the proposed subdivision has indicated that no prior existing right-of-way or access easement exists adjacent to or across the proposed subdivision. (see Exhibit A) Drainage: The variance request for waiver of stormwater detention requirements has been recommended by the City Consulting Engineer, as runoff is to be increased only 3.6 cfs and the cul-de-sac stormwater is to be tied via an underground system into the recently installed City underground drain system downstream of this site. The Public Works Division recommends this underground system due to the very flat nature of the site. The Consulting engineer recommends that the variance from detention requirements be FOREST COURT - FINAL PLAT 4 granted conditional upon the submittal of a detailed grading plan with construction plans. Utilities: The items discussed in the Utilities section of the report for the preliminary plat are still applicable as well as the City Consulting Engineers comments. No participation in off-site water improvements is required nor participation in improvements to Interceptor 1 downstream. Capacity in the wastewater system immediately downstream of this project must be verified during review of construction plans. Improvements in addition to those shown on the "Utility Concept Plan" may be required. An electrical layout has been submitted indicating the use of underground electric located in the street R.O.W. This clears the way for granting a variance to eliminate side and rear yard P.U.E.'s so that these areas can be used for drainage and bufferyard requirements. However, staff recommends that a 10' P.U.E. be established along the R.O.W. of Forest Court street to accommodate phone and cable T.V. lines. Variances: An existing structure is located to the north of Lot 1 along the eastern side of and facing Forest Street. Part 6, Section 6.102 of the Zoning Ordinance requires that "where the rear yard of a corner lot abuts the side yard of an adjacent lot, such corner lot shall provide a side yard along the side street of such tract equal in width to the depth required for the front yard of such adjacent lot". The existing structure, however, is only setback 16 feet from the property line. The applicant, as a result, has requested a 15 foot setback, where the above Zoning Ordinance regulation specifies that a 25 foot setback is required. The Planning and Zoning Commission and Council, as a condition of the preliminary plat approval, required that this setback be 25 feet. However, a visual inspection of the site has revealed that the majority of the houses each side of Forest Street from 12th Street to 16th Street are setback 15 ft. to 20 ft. Therefore, it seems reasonable to conclude that a reduction of the setback is in keeping with the immediate neighborhood and would not violate the spirit and intent of the ordinance. The exact FOREST COURT - FINAL PLAT amount of this reduction should be no more than 10 ft. (i.e. 15' Building Line) but not less than the median of the existing structures on both sides of the street from 12th Street to 16th Street. Surveying: Minor surveying errors require correction prior to the recording of the Final Plat. Summary: The Forest Court subdivision, as proposed, represents a solution to a problem site which should also be compatible with surrounding neighbors. Approval of this request would also establish a precedent for future infill developments. As long as the existing infrastructure capacity for normal lot residential use exists, infill development should be encouraged, in order to maximize the utilization of these facilities. The Forest Court project appears to be far more compatible with surrounding land uses than did the Old Town Park PUD request that was denied by the Commission earlier in 1986. One condition of preliminary plat approval was the provision of a bufferyard along the eastern edge of the project. Applicant has not submitted a proposal for this feature. However, a Type "D" Bufferyard as shown on the attached Exhibit "B" would be sufficient to provide the necessary buffering. This exhibit is taken from the proposed Subdivision Ordinance currently under review. Additionally, a privacy fence is recommended along the south edge of the property adjacent to the City Park. Staff Recommendation: (October 27, 1986) Approval of the Final Plat with the following conditions: 1. All ordinance requirements being met, 2. Utilities being adequate, a. A 10 ft. P.U.E. shall be established along the Forest Court R.O.W. if same is needed to accommodate phone and cable utilities, b. The side and rear yard P.U.E. shall be relabeled as drainage easements as required in conjunction with construction plan review, C. Applicant shall install a manhole at the intersection of the three 6 -inch sewer lines near the Forest and Short Street intersection and provide additional line capacity if same is required, 3. A detailed site grading plan shall be included in the construction plans, FOREST COURT - FINAL PLAT 6 4. A Type "D" bufferyard shall be required along the eastern edge of the project and this requirement noted on the plat, 5. A variance from the setback requirements for Lots 1 & 8 should be granted such that the side building line of Forest Street is not less than 15 ft. but may be reduced to equal the median of the setbacks of existing structures each side of Forest Court from 12th Street to 16th Street, 6. Requested stormwater detention variance shall be granted conditional upon the submittal of sufficient information indicating no adverse impact on the existing system during construction plan review. P&Z Recommendation: (November 4, 1986) (5-0) Recommend approval of the Final Plat with the following conditions: 1. All ordinance requirements being met, 2. Utilities being adequate, a. A 10 ft. PO Box 858 Georgetown, Tx 78627 863-4521 Request: Approval for a variance from Section 5.04 Part 3 and Section 5.06 Part 2, to allow the existing home on Lot 9, Block C of the Resubdivision of Lots 6-10 Block C Turtle Bend Section One (201 Turtle Bend) to remain encroached into the side yard setback and encroachment into a Public Utility Easement. see Exhibit "A" attached.) 201 Turtle Bend 2 Facts: Location: Is within the ETJ, near the Corps of Engineers recreation area that lies between Cedar Breaks Road and the Turtle Bend subdivision. Surrounding Area: Single family residential. Existing Site: Single family residential. History: In December, 1982, the Final Plat for Turtle Bend Section One was filed with the County Clerk of Williamson County. In this plat, Lot 9 contained a 50 foot wide access easement that severely reduced the buildable area for this lot. The owner resubdivided Lots 6-10 Block C of this subdivision to remedy this situation. The resubdivision, filed on April 8, 1985, relocated the 50 foot access easement to Lot 7, leaving only a 5 foot side and a 10 foot rear P.U.E. The size of Lot 9 essentially remained the same, with only the lot sizes of Lots 6-8 changing significantly. A new home was then built onto Lot 9 in a manner that encroached upon the 5 foot P.U.E. and 7 foot side yard building line. Notification: The applicant has met ordinance notification requirements for this request and paid the required $250.00 fee. Analysis: This home and lot was purchased from the builder, Carl Luzius, in its present configuration with the southern most wall of the structure encroaching upon the 7 foot building line by 3.9 feet and a 5' PUE by 1.9 feet. The encroachment makes necessary a variance to prevent any further difficulties in refinancing or selling of the applicant's property. The Building Official has recommended approval, affirming adequate clearance between the applicants home and that of the neighbor next door. As of the date of this report no response from the Division of Public Works has been received. Schmidt and Company 600 Forest Street Georgetown, Tx 78626 863-4594 1"=2000' Request: A variance as required by Section 4.04 Part 15 of the Subdivision Ordinance, to allow a ninety day extension of Final Plat approval for Brangus Ranch, Section 2. A previous final plat extension will expire on November 12, 1986. Brangus Ranch 1 Facts• History: The final plat was approved by Council February 11, 1986. On August 12, 1986, the City Council granted a variance allowing for the extension of Final Plat approval for this subdivision to November 12, 1986 in order to complete requirements of the Williamson County Health Department and the Texas Water Commission, relative to the Water Pollution Abatement Plan for the Recharge Zone of the Edwards Aquifer. Analysis: Brangus Ranch Section 2 is location within the Georgetown ETJ and the Edwards Aquifer Recharge Zone. Electric service is provided by Pedernales Electric Co—op. Inc., sewage disposal by septic tank, and will use private well water for the water supply. Approval of the plat with individual water supply was granted by Council over a recommendation from staff that City water be required due to applicants testimony that extension of City water was not economically feasible. Even though this plat has not technically expired, Council is obligated to grant this extension of approval only as a result of past practice which has been lenient in this regard. However, due to recent concerns and changes in policy regarding the provision of fire protection, Council may elect to require that an eight inch diameter water link with fire hydrants be installed adjacent to the subdivision. This system would not be connected to a water source until some unknown future date. A tentative verbal agreement has been reached with the Williamson County Health Department relative to the Water Pollution Abatement Plan. The Texas Water Commission, upon receipt of the signed plat from the Williamson County Health Department, must conduct a final review before giving final approval to the Water Pollution Abatement Plan. The applicant seeks a 90 day extension of Final Plat approval to secure this approval. Brangus Ranch 2 Granting of request and extending Final Plat approval for three months, which shall be February 11, 1987. If plat has not been recorded by this date, then all prior approvals by City shall be void. City Council Action: (November 25, 1986) Approved as recommended by staff above by consent. Parker McCollough PO Box 438 Georgetown, Tx 78626 863-4576 Request: A variance from Section 2.0203 Part 1 and Sections 6.101 and 6.106 of the Zoning Ordinance to allow building and parking in required front yards. A variance from Ordinance #82-30 (Fee Schedule 6) to allow a waiver of fees is also being requested. Facts: Location: On Martin Luther King Boulevard, bounded by Eighth Street to the north, Ninth Street to the south and West Street to the west. Surrounding Area: To the immediate east is the Central Business District, with nearby City of Georgetown offices and facilities and commercial establishments. To the south and west are residential land uses. Existing Site: Is within an RS rezoning district and vacant land. Site lies within a transition area, between commercial and residential land uses and City of Georgetown offices and facilities. Analysis: The Zoning Ordinance, Section 6.101, requires that on lots fronting two non—intersecting streets, a front yard is to be provided on both streets. As a result, a setback of 25 feet is required along West Street and Martin Luther King Blvd. The Zoning Ordinance Section 6.106 states, furthermore, that the required front yards shall only be used for landscaping, walkways, and driveways necessary for access to parking areas. Parking is prohibited in the required front yard. The site plan submitted for the Library indicates four parking spaces within the required front yard along MLK Blvd. and 14 spaces within the required front yard along West Street. To minimize the impacts of these parking areas, the applicants propose a 24 to 30 inch high hawthorne hedge row, surrounding the outer perimeter from front yard and side yard view. Crepe myrtle trees and street lamps will also provide aesthetic relief around the parking areas. The Library will provide 68 off—street parking spaces, far in excess of Ordinance requirements for a public building of this size. Parking in this area of the City is generally deficient and vital for the long term success of a commercial operation or a public use facility, such as a Public Library. Sufficient parking is necessary as the City grows and the level of service for the Public Library increases. Parking is difficult and expensive to acquire after the CBD has been fully developed. The applicants also request a front yard setback variance. The front yard setback of 25 feet, as required by Section 2.0203 Part 1 of the Zoning Ordinance is requested by the Georgetown Library 2 applicant to be reduced to 10 feet. To off -set the impact of locating a structure in such close proximity to the street, the applicant has proposed to plant 12' shumard oak trees. These trees would be 8-10 feet in height and spaced every 20 feet, along the entire length of the front wall, with street lamps spaced between every other tree. Applicant has also proposed a 10 ft. sidewalk along M.L.K. Blvd and an 8 ft. sidewalk along a portion of 8th Street. These walks are to utilize brick pavers similar to the City's Sesquicentennial Sidewalk Project. New curb and gutters along M.L.R. Blvd and 9th Street is indicated in the site plan. Applicant should consider the addition of sidewalks along the remainder of 8th Street as well as along West Street in order to facilitate pedestrian traffic from the residential area to the west. Additionally, the applicant requested that all fees be waived, due to the public nature of the development. this includes plan review fees, building and utility permit fee and Capital Recovery Fees. Planning Staff Recommendation: (November 18, 1986) Granting of variances, conditional upon staff approval of site plan based upon the following findings: 1. The landscaping proposed for the project far exceeds that required by Ordinance and serves to mitigate the negative aesthetic impacts of parking in the required front yard area, 2. The building as varied does not encroach upon the minimum site triangle or otherwise pose a hazard to traffic safety, 3. Substantial improvements are proposed which, in combination, produce an attractive and useable pedestrian space along Martin Luther Ring blvd. and Eight Street and are coordinated with the City's Sesquicentennial Sidewalk Project such that future similar connection of the two projects will create a truly unique urban design feature which will be beneficial to the City as a whole. Box 409 Georgetown, Texas 78727-0409 Re: Georgetown Public Library Dear Mayor and Council Members: The architects for the Georgetown Public Library are requesting variances from the Zoning Ordinance in regard to front yard requirements. We have at times found ourselves wishing the ordinances were less restrictive. Also, we are often in the position of convincing our clients that the ordinances are just and reasonable and that every effort should be made to work within them. There are times when pre-existing conditions or other critical physical constraints can make strict compliance difficult. The site for this project is virtually an entire block, however, and is hardly a situation that warrants special consideration or imposes any particular hardship. The City has established the ordinances. It expects the public to conform to them. Every effort should be made on City projects to observe those ordinances to the letter and to vary from them only when conformance poses an undue hardship. The nature of this variance request appears drastic when one twenty-five foot front yard would be reduced to ten feet and the other would be eliminated to provide parking in all of the front yard. We understand that some attempt is being made to provide some yard on Eighth Sreet or to .justify the variance because special paving or lights are being provided or extra trees planted. The front yard requirements are clear and should be met, lacking a hardship, regardless of the amenities provided. We had looked at the site enough to be able to express doubt about building a one-story facility and re:..ain in compliance with the City ordinances. Because the site appeared less than spacious when considering long term needs, we offered the suggestion that the first phase be two-story and that expansion be accomplished horizontally. The architects who were selected apparently felt otherwise and may have been hired at least partly because they promoted a one-story design. When the present library was built there was no provision to expand vertically, necessitating a bond issue for a new building at this time. We feel it would be a serious mistake if that scenario were being repeated. Local architects, builders, and developers are expected to meet the ordinance requirements. Is it unreasonable to expect the City to exercise at least the same diligence? On this project the drawings have been completed and bids received, reaching a point where this variance request may be a mere formality. How is it that a project has reached this point without the required variances? No matter what the Council's action on this issue is, we as local architects will continue to support the validity of local ordinances. We do object to the way this project has evolved. Analysis: The residence at 201 Pin Oak Drive was placed onto Lot 13 seven feet nearer to the side yard setback along Woodway Drive than shown on the building permit issued by the Building Department in August, 1986. (see Exhibit A.) Placement of the home in this manner results in a 0.9 foot encroachment of a bay window into the required 15 foot side yard. The bay window is constructed as an extension of the slab of the applicant's home, and does not overhang the required setback. The remaining wall on which the bay window is located does not encroach upon the side yard. The encroaching portion of the bay window extends a length of 6 feet within the side yard, 0.9 feet within the building line. see Exhibit B) Section 6.202 of the Zoning Ordinance lists architectural exceptions common in many homes that are permitted to extend one foot into a required yard. These exceptions include sills, beltcourses, cornices, and ornamental features. Bay windows are not expressly stated as an exception by this section and have not been interpreted as an ornamental feature. The encroaching bay window on the subject property is designed as an extension of the building slab, rather than an overhang, as is typical of most ornamental features. To: City of Georgetown Greetings: This letter constitutes a recommendation from the Oak Crest II Homeowners Association concerning access roads into the area. It is our recommendation that the city and/or county: 1) Provide no additional access roads into this area at the present time. Spring valley Road presently serves the area. 2) Plan for the connection of the Booty Road with the D. B. Woods Road (presently under construction) at the earliest possible time. 3) Advise the Oak Crest Homeowners Association of any serious proposal/request to build additional roads into the Oak Crest II area. 11/25/86 regular council meeting page 9 of 12 The Oak Crest II homeowners value the security, low traffic, etc., of a somewhat secluded area more than any benefits additional roads might provide. Early completion of this connection would allow access to Williams Drive by those west of oak Crest II, such as the Woods Ranch residents. This road should virtually eliminate any pressure/need for Ithru traffic" through the Oak Crest II area. Dated this day of 19 City Seal) ty Secretary 11/25/86 regular council meeting page 12 of 12 RESOLUTION CONCERNING IMPLEMENTATION OF CORE CITY THOROUGHFARE PLAN: WHEREAS, a Thoroughfare Plan concerning the City of Georgetown has been presented; and WHEREAS, that Thoroughfare Plan fails to address a solution to the needs of the Core City, the Core City being that area East of Interstate Highway 35, West of the Eastern City limits sign on State Highway 29, South of Farm to Market Road 971 and North of GRR 6 MKT Railroad tracks on the South part of town; and WHEREAS, it is recognized that the City of Georgetown desires that traffic flow and safety in the Core City Area be and remain safe and convenient to the citizens, NOW THEREFORE, be it resolved that the City Manager using the Planning Department of the City of Georgetown, the Public Works Department of the City of Georgetown, the Parking and Traffic Safety Committee of the City of Georgetown, and any other staff reSourse of the City of Georgetown, are hereby directed to prepare a Thoroughfare Plan for the Core City Area to address needs through the year 2000 concerningtrafficflowandsafety. The report shall include proposed improvements and areas needed to be condemned to implement those improvements. This plan shall be returned to the CityCouncilmembersandtheMayorwithinsixty (60) days from thedateofthisResolution. 16.
