ORDINANCE NO 86-48 AN ORDINANCE FIXING AND DETERMINING THE GENERAL SERVICE RATE TO BE CHARGEDFORSALES OF NATURAL GAS TO RESIDENTIAL AND COMMERCIAL CONSUMERS IN THE CITY OF GEORGETOWN, WILLIAMSON COUNTY, 11/10/86 regular council meeting page 1 of 11 TEXAS; PROVIDING FOR THE MANNER IN WHICH SUCH RATE MAY BE CHARGED, ADJUSTED, AND AMENDED; AND PROVIDING FOR THE RECOVERY OF ANY CURRENT AND UNRECOVERED PRIOR RATE CASE EXPENSE, PROVIDING FOR A SCHEDULE OF SERVICE CHARGES, AND PROVIDING FOR A MAIN LINE EXTENSION RATE. Benold M.D. (Term to expire 11/10/88) Library Board Winfr Bonner (Second term to expire 12/10/89) Parker McCollough (Second term to expire 12/10/89) Motion by Connor and second by Shell to nominate Charlie Laing to represent Georgetown on the Williamson County Tax Appraisal Review Board. Motion carried by unanimous vote. Mayor Colbert deferred the appointments to the Parks and Recreation, and the Historic Preservation Committees until a latter date. 6. ORDINANCE, U.S. 81 NORTH SPEED LIMIT, EMERGENCY READING Motion by Connor and second by Lackey to adopt, by emergency reading, the following captioned ordinance. Motion carried by unanimous vote. Ordinance NO. 86-49 AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS, ZONING FOR TRAFFIC AND RATE OF SPEED THEREIN, ON LOOP 418 IN THE CITY LIMITS OF THE CITY OF GEORGETOWN; DEFINING SPEEDING AND FIXING A PENALTY THEREFORE; DECLARING WHAT MAY BE A SUFFICIENT COMPLAINT IN PROSECUTIONS HEREUNDER; WITH A SAVING CLAUSE REPEALING CONFLICTING LAWS, A PUBLICATION CLAUSE, AND DECLARING AN EMERGENCY. BRA LONG RANGE PROJECTION APPROVAL Motion by Shell and second by Connor to approve the Consolidated Williamson County Raw Water Line Combined Surface Water Requirements Projections as prepared by the Brazos River Authority. (This information is an attachment to a Letter Dated October 30, 1986 from the Brazos River Authority, a copy of which is filed in the office of the city secretary.) RESOLUTION, INDIGENT HEALTH CARE AND TREATMENT ACT Motion by Shell and second by Connor to adopt the following resolution. Motion carried by unanimous vote. a RESOLUTION OF THE CITY COUNCIL OF GEORGETOWN, TEXAS, ENCOURAGING AND PROMOTION ANY AND ALL LEGISLATIVE ACTION AND INFLUENCE ON STATE LEGISLATORS TO ASK THAT THE CITY;S LIABILITY UNDER THE INDIGENT HEALTH CARE AND TREATMENT ACT BE REMOVED IN ORDER TO PROTECT THE CITIZENS OF GEORGETOWN FROM DOUBLE TAXATION FOR THE DELIVERY OF SUCH SERVICES. WHEREAS, Georgetown, Texas, is an incorporated municipality within Williamson County, Texas; and WHEREAS, by enactment of the Indigent Health Care and Treatment Act (Article 4438f, Vernon's Texas Civil Statutes), the residents and taxpayers of the City of Georgetown are being taxed by Williamson County to provide for the cost of delivery of health care to indigent residents not residing within the City of Georgetown; and WHEREAS, Williamson provide funds for residents within the the existence of a this City that is operated exclusively and County has elected not to indigent health care to City of Georgetown due to Hospital Authority within neither tax supported nor for Georgetown residents; WHEREAS, upon the creation of the Georgetown Hospital Authority it was clearly intended and ordained that: The City shall not be liable or in any way legally responsible for any part of the operation, construction, maintenance, or other activities of the Hospital Authority or for any debts or obligations created by such Authority and hereby represents the 11/10/86 regular council meeting page 9 of 11 the City shall in no way assume such liabilities. and, WHEREAS, the City of Georgetown, as the agency having created the Georgetown Hospital Authority, is made liable for the cost of delivery of health care to indigent residents of the City under Indigent Health Care and Treatment Act; and, WHEREAS, IT IS THE OPINION OF THE CITY COUNCIL OF GEORGETOWN that payment of taxes to Williamson County for the delivery of services to non-residents of Georgetown, coupled with total responsibility for the cost of such services within the City of Georgetown, subjects the residents of this City of double taxation; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN: That all residents of the City of Georgetown, Texas, be and are hereby urged to bring this situation to the attention of any and all legislators of the State of Texas, urging upon them such modifications in the Indigent Health Care and Treatment Act as shall remove the liability of Cities, having created Hospital Authorities, for the payment for services for which counties shall have collected tax revenues. Furthermore, that hospitals created under Hospital Authorities not be classified as Public Hospitals and Hospital Authorities not be considered Government Entities as defined in Section 102 (6) of the Act. BE IT FURTHER RESOLVED: That the Mayor and City Council hereby authorize and direct the City manager to participate with Hospital Authority and other municipalities in the State of Texas now known and to be known, which suffer the the same or similar iniquities related to the provision of indigent health care, in such a manner to gain relief in the most effective way, form this unjust state imposed legislation. 11/10/86 regular council meeting page 10 of 11 10. CORE CITY THOROUGHFARE PLAN DISCUSSION The council held a discussion with Development and Planning Director Ed Barry concerning the creation of a Core City Thoroughfare Plan. It was indicated that such a plan should be ready for council review by spring of 1987. 11. EXECUTIVE SESSION UNDER ART. 6252-17 SEC. 2 (G) PERSONNEL Mayor Colbert announced that the council would meet in executive session under Art. 6252-17 Section 2 (g) Personnel. After the executive session the meeting was again open to the public. 12. FIRE PROTECTION FOR PARR CENTRAL ONE SUBDIVISION The council held a discussion regarding the City's right to require adequate protection for Park Central One Subdivision.
