AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, AMENDING PART OF THE
OFFICIAL ZONING MAP TO REZONE 9.120 ACRES OF
LAND OUT OF THE JOHN BERRY SURVEY, ABSTRACT
NO. 51, LOCATED AT 737 COUNTY ROAD 152,
GEORGETOWN, TX, FROM AGRICULTURE (AG) TO
BUSINESS PARK (BP); REPEALING CONFLICTING
ORDINANCES AND RESOLUTIONS; INCLUDING A
SEVERABILITY CLAUSE; AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, an application has been made to the City for the purpose of amending the
Official Zoning Map, adopted on the 12th day of June, 2012, for the specific Zoning District
classification of the following described real property ("the Property"):
Being 9.120 acres of land, situated in the John Berry Survey, Abstract No. 51, in
Williamson County, Texas, said 9.120 acres being a portion out of a 57.169 acre tract
described in Exhibit A, Document No. 9868194, of the Official Public Records of
Williamson County, Texas, and of record to Thomas D. Stipanovic, Document No.
2021096227, of the Official Public Records of Williamson County, Texas, called the south
9.135 acres, Partition and Share Number 2, and being more particularly by metes and
bounds in Exhibit B attached hereto and incorporated herein by reference; and
WHEREAS, public notice of such hearing was accomplished in accordance with State
Law and the City's Unified Development Code through newspaper publication, signs posted on
the Property, and mailed notice to nearby property owners; and
WHEREAS, the Planning and Zoning Commission, at a meeting on February 18`h, 2025,
held the required public hearing and submitted a recommendation of approval to the City Council
for the requested rezoning of the Property; and
WHEREAS, the City Council, at a meeting on March 1 lth, 2025, held an additional public
hearing prior to taking action on the requested rezoning of the Property.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, THAT:
Section 1. The meeting at which this ordinance was approved was conducted in
compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.

Section 2. The facts and recitations contained in the preamble of this ordinance are hereby
found and declared to be true and correct and are incorporated by reference herein and expressly
made a part hereof, as if copied verbatim.
Section 3. The City Council hereby finds that this Ordinance implements the vision, goals,
and policies of the Georgetown 2030 Comprehensive Plan and further finds that the enactment of
this Ordinance is not inconsistent or in conflict with any other policies or provisions of the 2030
Comprehensive Plan and the City's Unified Development Code.
Section 4. The Official Zoning Map, as well as the Zoning District classification for the
Property is hereby amended from the Agriculture (AG) zoning district to the Business Park (BP)
zoning district, in accordance with the attached Exhibit A (Location Map) and Exhibit B (Legal
Description) and incorporated herein by reference.
Section 5. All ordinances or resolutions that conflict with the provisions of this ordinance
are hereby repealed, and all other ordinances or resolutions of the City not in conflict with the
provisions of this ordinance shall remain in full force and effect.
Section 6. If any provision of this ordinance, or application thereof, to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance, which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.
Section 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to
attest. This Ordinance shall become effective and be in full force and effect immediately in
accordance with the provisions of the City Charter of the City of Georgetown.

BEING 9.120 acres of land, situated in the John Berry Survey, Abstract No. 51, in Williamson County, Texas, said
9.120 acres being a portion out of a 57.169 acre tract, described in Exhibit A, Document No. 9868194, Official
Public Records Williamson County, Texas (OPRWCT), of record to Thomas D. Stipanovic, Document No.
2021096227, (OPRWCT), called the South 9.135 acres, Partition of Share Number Two. This tract was surveyed
on the ground in June of 2024 under the direction of William F. Forest, Jr., Registered Professional Land
Surveyor No. 1847. Survey note: The bearing basis for this survey is the State Plane Coordinate System, Texas
Central Zone (4203), and being more particularly described by metes and bounds as follows:
BEGINNING, at a 1/2" iron pin found (steel pin), in the North Right -of -Way line of County Road 152, said point
being the Southwest corner of said 57.169 acre tract, said point being the Southwest corner of said 9.135 acre
tracts, Partition Share Number Two, said point being on or near the common Survey line of said John Berry
Survey, Abstract No. 51, and the Antonio Flores Survey, Abstract No. 235, for the Southwest corner hereof,
THENCE, departing said Right -of -Way line, with the West boundary line of said 57.169 acre tract, said 9.135
acre tract, along or near the common Survey line of said John Berry Survey and the Antonio Flores Survey,
N 21109'03" W, passing the Southeast corner of Lot 13, Block A, a Drainage and Utility Easement Tract, of
Crystal Knoll Terrace, Unit Three, a subdivision in Williamson County, Texas, of record in Cabinet S, Slide 132,
Plat Records Williamson County Texas, (PRWCT), and continuing with the common boundary line of said
57.169 acre tract, said 9.135 acre tract, and said Crystal Knoll Terrace, passing at 451.24 feet, a'/Z" iron pin found,
N 68050'57" E 0.21 feet, at the common corner of Lot 13 and Lot 12, and passing at 551.07 feet, a'/z" iron pin
found, S 68°50'57" W 0.67 feet, in the South Right -of -Way line of Wisteria Drive, said point being the Northeast

the Northwest corner hereof, from which monumentation found in the common lines of said 57.169 Acre tract,
said Gateway 35, and Gateway 35, Phase 1, Document No. 2021142402, bear: N 21°09'03" W,134.14 feet to an 1"
iron pipe found, S 69°53'43" W 139.12 feet, to a 1/2" iron pin found, and N 20°57109" W 1735.36 feet, to a'/2" pin
found, said point being the common corner of said Gateway 35, and Gateway 35 Phase 1, and in the West line of
said 57.169 Acre tract,
THENCE, over and across said 57.169 acre tract, with the South boundary line of said Gateway 35, N 68°14'31"
E, 703.92 feet, to a '/Z" capped iron pin set, marked "RPLS 1847", being in the West line of a 20.630 acre tract, of

found, marked "TXDOT", for an angle point hereof,
2. S 26°51'04" E, 98.52 feet, a 1/2" capped iron pin, marked "WINDROSE", for an angle point hereof,
3. S 23°40'55" W, 95.95 feet, to a TXDOT Type III marker, a 1/2" capped iron pin with aluminum cap found,
marked "TXDOT", being a point in the North Right -of -Way line of County Road 152, for the Southeast
corner hereof,
4. S 68°16'31" W, 644.07 feet, to a TXDOT Type III marker, a 1/2" capped iron pin with aluminum cap
found, marked "TXDOT", for an angle point hereof,

THENCE, with said Right -of -Way line of County Road 152, with the South line of said 57.169 acre tract, along or
near a fence, S 69'03'18" W, 76.02 feet, to the POINT OF BEGINNING, and containing 9.120 acres, more or
less.
