HomeMy WebLinkAboutRES 042225-5.D - AFA with TxDOT re: Hazard EliminationRESOLUTION NO. - 5--L) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION RELATED TO A HIGHWAY IMPROVEMENT PROJECT FOR HAZARD ELIMINATION AND SAFETY IMPROVEMENTS AT THE INTERSECTION OF COUNTY ROAD 245 AND RONALD REAGAN BOULEVARD. WHEREAS, the Texas Transportation Commission passed Minute Order Number 116752 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as Hazard Elimination and Safety Improvements; and WHEREAS, in 2021, City of Georgetown voters approved bond propositions authorizing road intersection improvement projects; and WHEREAS, the portion of the project work covered by this Agreement is identified in the Agreement, Article 3, Scope of Work (Project); and WHEREAS, the City desires to enter into an Advanced Funding Agreement with the Texas Department of Transportation for highway improvements related to hazard eliminations and improvements on Ronald Reagan Boulevard at CR 245. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS: Section 1. The meeting at which this resolution was approved was conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. The City Council of the City of Georgetown finds it to be in the best interest of the citizens of Georgetown to enter in the Advance Funding Agreement with the Texas Department of Transportation related to a highway improvement or other transportation project generally described as Hazard Elimination and Safety Improvements at the intersection of Ronald Reagan Boulevard and County Road 245. Section 4. The City Manager is hereby authorized to negotiate and execute an Advance Funding Agreement with the Texas Department of Transportation for a highway improvement or other transportation project generally described as Hazard Elimination and Safety Improvements at the intersection of Ronald Reagan Boulevard and County Road 245. Section 5. If any provision of this resolution, or application thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Resolution No. 2�'j — $ • n e Page 1 of 2 Subject: «-• Date Approved ACY6 � 2Z% 7,92-5 _ resolution, which can be given effect without the invalid provision or application, and to this end the provisions of this resolution are hereby declared to be severable. Section 6. The Mayor is hereby authorized to sign this resolution and the City Secretary to attest.
