AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, ADDING SECTION 13.04.145 RELATING TO
RATES AND CHARGES FOR SEWER SERVICE; REPEALING
CONFLICTING ORDINANCES AND RESOLUTIONS; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION; AND
SETTING AN EFFECTIVE DATE.
WHEREAS, the City wishes to implement a monthly surcharge to rates paid by customers who send
wastewater to the City that is higher in pollutants and costs more to treat;
WHEREAS, the City Council of the City of Georgetown wishes to amend the current wastewater
rates, effective for all utility services provided on and after June 1, 2025.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, THAT:
SECTION 1. The meeting at which this ordinance was approved was in all things conducted in
compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
SECTION 2. The facts and recitations contained in the preamble of this ordinance are hereby
found and declared to be true and correct and are incorporated by reference herein and expressly
made a part hereof, as if copied verbatim.
SECTION 3. Section 13.04.145, "Surcharge for High Strength Wastewater," is hereby added to
the Code of Ordinances to read as set forth in Exhibit A attached hereto and incorporated herein.
SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict
with this Ordinance are hereby repealed, and are no longer of any force and effect.
SECTION 5. If any provision of this ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.
SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to
attest. This ordinance shall become effective and be in full force and effect on June 1, 2025.

13.04.145 Surcharge for High Strength Wastewater
A. A Customer or Person discharging wastewater to the City Sewer System with BOD, TSS,
Ammonia -Nitrogen, and Phosphorus of concentrations higher than normal domestic wastewater
as defined in Section 13.24.010.4(KK) shall pay a monthly surcharge in addition to the monthly
sewer charges set forth in Section 13.04.140.
B. The City shall calculate the surcharge under this section using cost factors based on the capital
and operating cost of wastewater facilities necessary to treat the high strength wastewater and
equitable distribution of the cost of operation, maintenance, and improvement to the City Sewer
System.
C. Wastewater discharges to the City Sewer System that meet the following criteria for high -strength
wastewater will be assessed surcharge fees:
1. 5-day Biochemical Oxygen Demand (BOD) concentrations greater than 250 mg/1
2. Chemical Oxygen Demand (COD) concentrations greater than 450 mg/l.
3. Total Suspended Solids (TSS) concentrations greater than 250 mg/1
4. Total Kjeldahl Nitrogen (TKN) concentrations greater than 50 mg/l
5. Total Phosphorus (TP) concentrations greater than 8 mg/l
D. The surcharge will be assessed according to the following formula each month using the most
current pollutant concentration data and the current months' wastewater flow at the end of pipe_
(nutrient limits to be used in the in the fomiula's below are the higher of the recorded data or the
limits listed in 13.04.145. C above):
If COD concentration greater than 450 mg/l, surcharge will be calculated:
S = V * 8.34 * (A*[COD-450] + C*[TSS-250] + D*[TKN-50] + E*[TP-8])
If COD concentration is less than 450 mg/l, surcharge will be calculated:
S = V * 8.34 * (B*[BOD-250] + C*[TSS-250] + D*[TKN-50] + E*[TP-8])
S — Total monthly surcharge fee in dollars ($)
V — Monthly wastewater flow in million gallons (MG)
A — Unit cost of treatment per pound of COD ($0.26/lb COD)
B — Unit cost of treatment per pound of BOD ($0.46/lb BOD)
C — Unit cost of treatment per pound of TSS ($0.32/lb TSS)
D — Unit cost of treatment per pound of TKN ($1.26/lb TKN)
E — Unit cost of treatment per pound of TP ($2.93/lb TP)
COD — Average concentration of COD in discharge (mg/1)
BOD — Average concentration of 5-day BOD in discharge (mg/1)
TSS — Average concentration of TSS in discharge (mg/1)
TKN — Average concentration of TKN in discharge (mg/1)
TP — Average concentration of TP in discharge (mg/1)
E. The City may periodically reevaluate the unit cost of treatment for the pollutants and adjust the
surcharge rate accordingly to reflect changes in City Sewer System operation and maintenance
and other applicable costs.
F. Payment of any surcharge under this section does not constitute a waiver of any of the prohibited
discharge standards, pretreatment requirements and other regulations in Chapter 13.24.
