Oho 10 P,5 —5• E A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ("GEORGETOWN") RELEASING APPROXIMATELY 27.869 ACRES OF LAND FROM THE CITY OF GEORGETOWN'S EXTRATERRITORIAL JURISDICTION ("ETJ"), SAID LAND IDENTIFIED BY THE WILLIAMSON COUNTY APPRAISAL DISTRICT AS PARCELS R038966, R472964, R330332 AND R338328 AND BEING LOCALLY KNOWN AS 700 EASTVIEW DRIVE, GEORGETOWN, WILLIAMSON COUNTY, TEXAS, RESULTING IN A REDUCTION OF GEORGETOWN'S ETJ; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on May 6, 2025, the City of Georgetown, Texas, received a petition requesting release from its ETJ of an approximately 27.869 acre tract of land in the John Berry Survey (the "Petition"), a true and correct copy of such Petition being attached hereto as Exhibit A and incorporated herein by reference; and WHEREAS, pursuant to Subchapter D of Chapter 42 of Local Government Code, landowners or residents may submit a petition seeking release of an area of land from the City's ETJ; and WHEREAS, the City Secretary has reviewed the Petition and confirmed that it meets the requirements of Subchapter D of Chapter 42 of the Local Government Code and the petition requirements of Chapter 277 of the Election Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: SECTION 1. The City Council of the City of Georgetown, Texas ("City Council"), does hereby find that the forgoing recitals are true and correct and adopts the recitals by this reference for all purposes. SECTION 2. To the extent required by state law, the City Council does hereby adjust the boundaries and limits of the ETJ of the City of Georgetown, Texas, such that the ETJ of the City of Georgetown, Texas, shall be and is hereby adjusted to release and remove the Area subject to the Petition, as such Area is more particularly described and depicted in Exhibit B attached hereto and incorporated herein by reference, from the ETJ of the City of Georgetown, Texas. SECTION 3. The City Council is not consenting to this reduction of its ETJ except as required by state law. SECTION 4. This Resolution shall take effect immediately upon its passage. REQUEST AND PETITION FOR RELEASE OF PROPERTY FROM THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF GEORGETOWN (27.869 ACRES) TO THE GOVERNING BODY OF THE CITY OF GEORGETOWN, TEXAS: The undersigned ("Petitioners'), acting pursuant to the provisions Sections 42.101-105 of the Texas Local Government Code, respectfully petition the City of Georgetown (the "CULP) to release the land described by metes and bounds on Exhibit "A" and depicted on Exhibit "A P (the "Lance'), from the extraterritorial jurisdiction ("ETJ") of the City. In support of this petition, Petitioners would show the following: I. Petitioners are the owners of all of the Land, comprised of 27.869 acres currently situated within the extraterritorial boundaries of the City in Williamson County, Texas, and is fully described by metes and bounds on Exhibit "A", attached hereto and incorporated herein by reference. Petitioners certify that the description of the Land attached as Exhibit "A" is true and correct. A map of the Land to be released is attached hereto as Exhibit "B". H. Pursuant to Section 42.102(b) of the Texas Local Government Code, Petitioners certify that they each own an undivided 50% in value of the Land (and together .own one hundred percent (100%) in value of the Land) pursuant to the tax rolls of the Williamson Central Appraisal District as evidenced by Exhibit "C" and are, therefore, authorized to file this Petition. Copies of the Deeds vesting title to the Land are attached as Exhibit "DI" (23.979 acres) and Exhibit "D2" (3.89 acres). The two tracts comprising the Land are contiguous to each other. III. Pursuant to Section 42.101 of the Texas Local Government Code, the property is not located: within five miles of the boundary of a military base, in an area that was voluntarily annexed into the ETJ, within an ETJ of a municipality with a population of more than 1.4 million, in an area designated as an industrial district under Section 42.044, or in an area subject to a strategic partnership agreement entered into under Section 43.0751. IV. This Petition satisfies the signature requirements described in Sections 42.103 and 42.104(a) of the Texas Local Government Code and Chapter 277 of the Texas Election Code in that it is being filed not later than the 180th day after the date the first signature for this Petition is obtained. V. If the City fails to take action to release the Land by the later of the 45th day after the date the City receives this Petition or the next meeting of the City's governing body that occurs after the 30th day after the date the City receives this Petition, the Land is released by operation of law. M Petitioners pray that (i) this Petition be verified by the City Secretary or other person at the City responsible for verifying signatures, (ii) Petitioners be notified of the results, and (iii) this Petition be granted, immediately releasing the Land from the City's ETJ. This petition for release from the City's ETJ is not, nor should it be constructed as, a voluntary request or consent for the Land to be included in or added to the ETJ or corporate boundaries of any other municipality.
