HomeMy WebLinkAboutMinutes_CVSVC_01.22.2013Minutes of Meeting of the Civil Service Commission City of Georgetown, Texas Tuesday, January 22, 2013 The Civil Service Commission will met on Tuesday, January 22, 2013 at 03:30 PM in the Georgetown Fire Station #3 Lobby, located at 5 Texas Drive, Georgetown, Texas Civil Service Commission Members: John William Wood, Sr., Place 2, James W. Montgomery, Place 3, Glenn Mautner, Place 1 Kevin Russell, Human Resources and Civil Service Director; Elizabeth Jones, Human Resources Generalist; Cory Tchida, Assistant Police Chief; Wayne Nero, Police Chief; Timothy Carroll, Police Officer Call to Order at 03:30 PM Regular Session to convene Executive Session, if necessary Executive Session In compliance with the Open Meetings Act, Chapter 551, Government Code, Vernon's Texas Codes, Annotated, the items listed below may be discussed in closed session and are subject to action in the regular session that follows. I. Sec.551.088: Deliberation Regarding Test Item Regular Session II. Approval of minutes from the last meeting(s). Motion by Montgomery to approve 11/14/12 minutes. Second by Mautner. Approved 3-0 III. Election of Chairman Wood nominates Mautner, who accepts nomination. Second by Montgomery. Approved 3-0 IV. Election of Vice-Chairman Wood nominates Montgomery, who accepts nomination. Second by Mautner. Approved 3-0 V. Discussion of any appeals of test questions. Kevin Russell advised that we administered a written test for Police Sergeant on January 10, five employees took the test and one person is appealing question 80. Question: For all collisions involving serious bodily injury or death, the investigating officer shall be: A) Advanced traffic investigator B.) Evidence Technician C.) The employee’s bureau commander D.) Employee operator’s supervisor or watch commander. Key answer is D. Appeal states that A is possible answer. (Appeal on file in Human Resources) Tim Carroll spoke to his appeal and discussed the ordinance to which the question came from (GO 002.00). Ordinance states “The investigating officer shall be the employee operator’s supervisor or watch commander or advanced accident investigator if the accident results in serious bodily injury or death.” The first sentence would answer the question, but if you continue on in general order the responsibilities of the watch commander is generally the investigating officer in collisions not resulting in serious bodily injury or death. Further on section 5 states “For all collisions involving serious bodily injury or death to any person, contact the on call Advanced Traffic Collision Investigator”. Jim Montgomery asked if there is anyone at the meeting who will speak to the fact that answer D is correct. Kevin Russell responded that the test writer is not here and advised that Chief Nero can speak. Chief Nero advised that Carroll makes a good point because when you look at the context to which the question is written it is “any or all collisions that involve injury or death”. When Chief Nero reviewed the question his initial response is “A- Advanced traffic investigator”. Had the question expressly talked about interdepartmental fleet accidents, but it does not isolate fleet vehicles, so in fact feels that D is not the correct answer at all with the way the question is written and given our current policy. Montgomery sought clarification as to what the commissioners are to do? Kevin Russell explained that if both Tim Carroll and Chief Nero have said everything they need to say the commissioners will go into executive session to discuss the appeal and then render a decision. No further comments. Wood announces adjourning to executive session. Adjourn at 3:40 PM Executive Session VI. Discussion/Deliberation on test questions. Regular Session 3:46 PM VII. Discussion and possible action from Executive Session. Decision of commission was to override question 80 and to determine that correct answer is in fact A, test scored accordingly. Motion by Montgomery to accept that action, second by Wood. Approved 3-0 VIII. Discussion and possible certification of Police Sergeant promotional list. A new list was established based on the ruling of the appealed question. Wood moved to certify, Montgomery second. Approved 3-0 IX. Discussion and possible action to set the date and time for the next meeting. Police entry test on February 1 and Fire test on February 23. If we can wait until after February 23 to certify both lists, we will, but Police is expediting process so we might have to meet to certify Police list before. Elizabeth will send out an email for scheduling a meeting. X. Adjourn Montgomery motions to adjourn, Wood seconds.
