A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS ("GEORGETOWN") RELEASING
APPROXIMATELY 35.35 ACRES OF LAND FROM THE CITY OF
GEORGETOWN'S EXTRATERRITORIAL JURISDICTION ("ETJ"),
SAID LAND IDENTIFIED BY THE WILLIAMSON COUNTY APPRAISAL
DISTRICT AS PARCEL R375696 AND BEING LOCALLY KNOWN AS 501
INDIAN SPRINGS ROAD, GEORGETOWN, WILLIAMSON COUNTY,
TEXAS, RESULTINGIN A REDUCTION OF GEORGETOWN'S ETJ; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on July 16, 2025, the City of Georgetown, Texas, received a petition requesting release
from its ETJ of an approximately 35.35 acre tract of land in the Lewis P. Dyches Survey (the
"Petition"), a true and correct copy of such Petition being attached hereto as Exhibit A and
incorporated herein by reference; and
WHEREAS, pursuant to Subchapter D of Chapter 42 of Local Government Code, landowners or
residents may submit a petition seeking release of an area of land from the City's ETJ; and
WHEREAS, the City Secretary has reviewed the Petition and confirmed that it meets the
requirements of Subchapter D of Chapter 42 of the Local Government Code and the petition
requirements of Chapter 277 of the Election Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS:
SECTION 1. The City Council of the City of Georgetown, Texas ("City Council"), does hereby
find that the forgoing recitals are true and correct and adopts the recitals by this reference for all
purposes.
SECTION 2. To the extent required by state law, the City Council does hereby adjust the
boundaries and limits of the ETJ of the City of Georgetown, Texas, such that the ETJ of the City
of Georgetown, Texas, shall be and is hereby adjusted to release and remove the Area subject to
the Petition, as such Area is more particularly described and depicted in Exhibit B attached hereto
and incorporated herein by reference, from the ETJ of the City of Georgetown, Texas.
SECTION 3. The City Council is not consenting to this reduction of its ETJ except as required
by state law.
SECTION 4. This Resolution shall take effect immediately upon its passage.

PETITION FOR RELEASE OF APPROXIMATELY 35.35 ACRES
FROM THE EXTRATERRITORIAL JURISDICTION
OF THE CITY OF GEORGETOWN, TEXAS
The undersigned petitioners ("Petitioners," whether one or more), acting pursuant to the
provisions of Texas Local Government Code, Chapter 42, Subchapter D, as amended, file this
petition and request that the City of Georgetown (the "City") release the area depicted and
described on Exhibit "A" attached hereto and incorporated herein (the "Land'), located within
the extraterritorial jurisdiction ("ETJ") of the City, and within Williamson County, Texas, from
the City's ETJ. In support of this petition Petitioners represent the following:
Section 1. Pursuant to Local Government Code Section 42.102(b), Petitioners, being the
owner or owners of a majority in value of the Land, file this petition for the Land to be released
from the City's ETJ.
Section 2. Pursuant to Local Government Code, Section 42.104(a)(2), the signatories to this
petition are a majority in value of the holders of title of the Land, as indicated by the current
tax roll of the Williamson Central Appraisal District, and evidenced by the current tax certificate
attached as Exhibit "B" hereto.
Section 3. Exhibit "A" hereto includes a map of the Land and describes the boundaries of
the Land by metes and bounds.
Section 4. The Land is not subject to any of the exceptions to the applicability of Local
Government Code, Chapter 42, Subchapter D, as amended, as described in Local Government
Code, Section 42.101.
Section 5. All signatories, if more than one, have signed this petition not later than the 180th
day after the date the first signature for this petition was obtained.
Section 6. This Petition shall be verified by the City Secretary of the City or other person at
the City responsible for verifying signatures.
Section 7. The City shall notify the residents or landowners of the Property of the results of
this Petition, which notification requirement may be satisfied by notifying the Petitioners in
writing.
Section 8. If the City fails to take action to release the Land by the later of (a) the 45th day
after the date the City receives this petition, or (b) the next meeting of the city council of the
City that occurs after the 30th day after the date the City receives this petition, the Land shall be
released by operation of law.
The Petitioners request that the City immediately release the Land from the City's ETJ
and this petition will be filed with the City Secretary in support of such release and recorded in
the Official Public Records of Williamson County, Texas.

property taxes; or (3) other non ad valorem taxes (such as paving liens, stand-by charges or maintenance assessments).
Data Trace Information Services LLC ("Data Trace") may have warranted the accuracy of this HOA Certificate to its customer (the "Data Trace Customer")
pursuant to the terms and conditions of a written tax service agreement between Data Trace and said Data Trace Customer (tho'Tax Service

Data Trace Customer and are subject to the terms and conditions set forth in the pertinent Tax Service Agreement (Including, without I'nnitelion, the filing

TRUST RESOLUTION REGARDING THE NAKA TRUST
CERTIFICATION AND RESOLUTIONS of Grant K. Nakashima and Michaelanne Briggs, Trustees of
the NAKA TRUST (the "Trust").
WE HEREBY certify that we are the duly appointed Trustees and keepers of the records of the Trust, as
the same may be amended, modified and restated from time to time, and that we are fully empowered to make
the representations, warranties and certifications herein contained:
1. Representations and Warranties:
A. As of the date hereof. the Trust, acting by and through the Trustees, has the full power and
authority to join in the filing of the attached Petition for Release of Approximately 35.35 Acres from the
Extraterritorial Jurisdiction of the City of Georgetown. Texas (the "Pefifion"). and request that the City of
Georgetown release the area depicted and described more particularly in Exhibit A to the Petition (the
`Property");
B. The Trustees of the Trust are authorized and directed on behalf of the Trust to execute and deliver
any and all documents necessary on behalf of the Trust to give effect to the purposes of these foregoing resolutions
and to execute and file the Petition; and
C. The terms and provisions of the Petition and the transactions contemplated thereby be, and they
hereby are, ratified and approved it being determined that filing of the Petition is in the best interests of the
Trust.
2. Certifications:
A. The foregoing representations and warranties arc inconformity with the Trust and there
are no provisions in the Trust limiting the authority of die Trustees to make the foregoing representations and
warranties that have not been complied with;
B. The Trust is in full force and effect as of the date hereof; and
C. The consent of the beneficiaries of the Trust or any named Successor Trustees of the
Trust is not required in order to bind the Trust in the manner and on the terms set forth in this Trust Resolution.

CERTIFICATION OF TRUST
The undersigned, for and on behalf of The Naka Trust (the "Trust"), delivers this
Certification of Trust (this " C rti c c") and certifies as follows:
1. Existence. The Trust exists. The Trust was created on November 19, 2014, by
that certain instrument trust created under the laws of Texas executed by Grant M. Nakashima
and wife Michaelanne Elizabeth Briggs for the use and benefit of Grant M. Nakashima and
Michaelanne Elizabeth Briggs, Trustees and Beneficiaries (the "17•ust reement").
2. Status of the Trust. The Trust Agreement is in full force and effect and has not
been revoked, modified, or amended that would cause the representations in this Certificate to be
incorrect.
3. Settlor/Grantor. Grant M. Nakashima and wife Michaelanne Elizabeth Briggs,
are the settlor and grantor of the Trust (the "Grnntor").
4. Current Trustees. We, Grant M. Nakashima and Michaelanne Elizabeth Briggs,
are serving as the Trustees of the Trust (the "Trus tee") and have served as the Trustee of the Trust
since its creation. Grant M. Nakashima's address is 501 Indian Springs Road, Georgetown Texas,
78633. Michaelanne Briggs' address is 5oi Indian Springs Road, Georgetown Texas, 78633.
5. Powers of the Trustee. Under the Trust Agreement, the Trustee is granted all
of the general powers conferred on trustees under the Texas Trust Code and has the power and
authority to purchase, sell, and hold real estate and execute the Petition for Release of
Approximately35.35Acres from the Extraterritorial Jurisdiction ofthe Cityof Georgetown, Texas
(the "Petitionl.
6. Approval.. Under the terms of the Trust, both of the currently acting Trustees
are required to sign documents in order to exercise the powers of the trustees
7. Revocability of the Trust. The Trust is presently revocable only upon
agreement by all then -existing current beneficiaries, which are the Trustees
8. Title to Trust Property. Title to Trust property shall be taken in the following
fashion: Grant K Nakashima and Michaelanne Elizabeth Briggs, Trustees of the Naka Trust;
Dated November 19, 2014.
9. Reliance on Certificate. This Certification is prepared and executed to Texas
Property Code Section n4.o86. Under the Trust Agreement and Section 114.o86 of the Texas
Trust Code, any person who acts in reliance on this Certificate without knowledge that the
representations contained herein are incorrect is not liable to any person for the action and may
assume without inquiry the existence of the facts in this Certificate. A person who in good faith
enters a transaction relying on this Certificate may enforce the transaction against the property of
the Trust.
