Texas Tuesday, July 2,, 2024 The Georgetown Planning and Zoning Commission met on Tuesday, July 2, 2024 at 6:00 PM at Council and Court Building, 510 W. 9th Street. Regular Session 2.A 2024-4-WAV Airport Road Driveway Spacing Variance Public Hearing and possible action on a Subdivision Variance from non-residential driveway spacing pursuant to Section 12.08.020 of the Unified Development Code, for the property generally located at 2030 Airport Road, Georgetown, Texas 78628, bearing the legal description of a 2.885-acre tract, located in the David Wright Survey, Abstract No. 13 in Williamson County (2024-4-WAV) -- Caleb Fuhrer, Asst. Systems Engineering Director Ethan Harwell, applicant, approached the podium to address the Commission and ; ided an explanation for the request with a presentation. #rovj Wright confirmed that it was non -conforming. Moved by Michael L Price-, seconded by Pierce P Macguire to Approve 2024-4-WAV with the Comprehensive Plan and the purposes of this Code, that the conditions tl�at create the need for the variance do not generally apply to other property in the vicinity, and where literal enforcement of these regulations would result in an unnecessary hardship. B 2024-8-REZ CR 152 TH Public Hearing and possible action on a request for a Zoning Map Amendment to rezone 1.96 acres of land out of the John Berry Survey, Abstract No. 51, from the Agriculture (AG) zoning district to the Townhome (TN) zoning district, for the property located at 400 County Road 152, Georgetown, Texas. (2024-8-REZ) -- Colin Davidson, Planner Commissioner Heintzmann inquired about the use of the property to the north of t request property. Alternate Commissioner Charles inquired about evaluations of the traffic in the area. Davidson explained that the applicant plans on improving the road by County Road 152 by their site and clarified that they must dedicate right of way along their site. Commissioner Heintzmann inquired about the plan of the future structures for the property. Kirk Kemnitz, applicant, approached the podium to address the Commission and acknowledged that a third of the duplexes directly south of the property are two story. Kemnitz explained that the plan was to make the design very similar to the duplexes. Commissioner MacGuire inquired about the number of Units planned for the property. Kemnitz explained that they plan on building 18 units. for Country Road 152. Kemnitz explained that the plan was to widen both sides of County Kemnitz acknowledged that the entrance would be aligned with Stadium Drive. David Munk, Senior Utility Engineer, approached the podium to address the Commission and acknowledged that County Road 152 north and south of the site plan included in the presentation and acknowledged that the zoning designation may include hospice, a halfway house, event center, or food trucks. Shaw shared that he was not against change but was against changing the quality and character of what was alrea in the area. Shaw emphasized that there was no guarantee that townhomes would be buil on the property. Shaw highlighted that a corner on the street is a bus stop for several buses and mentioned that the traffic would be significant during the school year. Shaw acknowledged that he would welcome the idea if the intent was for a school or park. Alternate Commissioner Charles expressed his concern with traffic and shared that 18 townhome units would be akin to Austin Avenue and Williams Drive. Chair Dickey reminded the dais that there is a MF-1 zoned property at the end of the road. there would be a Right of Way dedication as well as Traffic Impact Fees to impro roadways and infrastructure in the area. I !111 1111pligirp 11111 00111�� Motion Approved: 5- 2 Voting For: Michael L Price, Stephen F Dickey, Pierce P Macguire, Lance A Morgan, Alice L York Voting Against: Chere Heintzmann, Michael D Charles 2.0 2024-2-PUD & 2023-10-ANX Berry Creek Townhornes Public Hearing and possible action on a request for a Zoning Map Amendment toz6ne, upon annexation, 9.992 acres in the William Roberts Survey, Abstract No. 524 to the Planned Unit Development Zoning District with a base zoning of Low -Density Multi -Family (MF-1) for the property generally located at 3601 Shell Road. The request, if approved, will also annex 2.022 acres of right-of-way of Shell Road. (2024-2-PUD and 2023-10-ANX) -- Ryan Clark, AICP, Senior Planner Ryan Clark presented the staff report. Alternate Commissioner Charles mentioned that seeing a note regarding the usage of the private road with homeowner approval. Clark explained that the plan was to construct a shared driveway with the school to the west of the property. Alternate Commissioner Charles mentioned that there wasn't dedication of green space in phase 1 and wondered if it would be included in the 2nd phase of construction. Clark confirmed that amenities would be included in the 2nd phase of construction. Commissioner Heintzmann highlighted that the applicant failed to comply with 9/12 criteria and expressed concern with street access. Commissioner Heintzmann highlighted that the plan appeared to be an apartment complex instead of townhomes. Commissioner Heintzmann shared her concern with disregard of tree preservation on site and shared that she would be more inclined to see this request postponed so the applicant can work with staff. Alternate Commissioner York inquired about the Planning Department's zoning district preference for the property. Clark explained that the Comprehensive Plan guides the development and further clarified that since the area is undeveloped and along a major roadway, the Future Land Use Map recommended a mixed density neighborhood. Aron Trevizo, applicant, approached the podium to address the Commission and provided a presentation. Alternate Commissioner York asked if the applicant would consider reclassifying to the townhome zoning district. Trevizo confirmed that they have considered the townhome zoning district, but the setback and platting requirements would drastically change the site. Commissioner Price and Commissioner Heintzmann encouraged the applicant to work with staff on preserving the trees on the site. Chair Dickey opened the public hearing. Robert Krebs, 3709 Shell Road, approached the podium to address the Commission and shared that he was surprised that the request included more structures than what was presented during the December 5, 2023, Planning and Zoning Commission Meeting. Krebs continued to explain that the plan showed little free space versus the architectural drawings that were presented. Krebs highlighted that multi -family makes him think of children and asked where they would be able to play. Krebs explained that what was highlighted should be considered for the quality of life for people who would live there.
