Regular Session Chair Dickey announced that item 1.13 will be postponed until the March 19, 2024 ZBA meeting due to a conflict of interest which will create a lack of a quorum. 1.A Meeting Minutes Consideration and possible action to approve the minutes from the November 21, 2023 meeting of the Zoning Board of Adjustment -- Erica Metress, Planning Specialist the November 21, 2023 meeting, Motion Approved: 4- 0 Voting For: Scott A Allen, Stephen F Dickey, Pierce P Macguire, Michael L Price Voting Against: None I.B 2023-3-SE 906 S. Elm Street Project Public Hearing and Possible Action on a Special Exception per Unified Development Code (UDC) Section 14.05.080 to allow an existing non -conforming structure to be expanded or enlarged in excess of 50 percent (50%) of its size for the property addressed at 906 S. Elm Street bearing the legal description of Lot 2, Block 19, Glasscock Addition (2023-3-SE) -- Maddison O'Kelley, Preservation and Redevelopment Manager Due to a conflict of interest which will create a lack of a quorum, a motion was made to postpone the item. Moved by Michael L Price; seconded by Scott A Allen to Continue the item to the March 19, 2024 ZBA Meeting. Motion Approved: 4- 0 Voting For: Scoff A Allen, Stephen F Dickey, Pierce P Macguire, Michael L Price Voting Against: None 1.0 2023-8-VAR Hemphill, LLC WTF Public Hearing arid possible action on Zoning Variances frorn the required setbacks from the San Gabriel River, residential districts, and the leased property boundary pursuant to Sections 5.10,010,A.3, 5.10.040.A.4, and 5.10.040.0 of the Unified Development Code (UDC), for the property located at 934 University Ave. West, Georgetown, TX 78626, bearing the legal description of Lot 12, Block A, Wolf Crossing Replat of Lot 1 Block A (2023-8-VAR) -- Haley Webre, Planner mmml= Ralph Wyngarden, Applicant, approached the podium to address the Commission and highlighted that staff found 6/7 criteria to comply. Wyngarden highlighted criteria 3 and expressed that conditions go beyond factors such as the unique shape of the parcel. Wyngarden further highlighted that the existing transmission tower and substation to the west of the property provides a visual context for the pole. Wyngarden clarified that this is the only buildable location with adjacent properties already developed, Wyngarden referred to section 5.10.010,D of the Unified Development Code and explained that it expresses a policy preference for a substation without an SUP. Wyngarden shared that he believes that the engineering letter addresses concerns such as the fall radius of the pole. Commissioner Allen asked if the second variance would be required if the electrical utility property was correctly zoned. Webre explained that the second variance would not be required due to the lack of residentially zoned properties which falls within a 287-foot buffer. mom =0 MCM 1111 Jill 1 1 �� I � l 1 Moved by Stephen F Dickey; seconded by Pierce P Macguire to Approve the variance request for 2023-8-VAR due to its compliance with the following approval criteria for a variance within UDC section 3.15.030: Extraordinary Conditions, No Substantial Detriment, Applicant's Actions, Comprehensive Plan, Utilization, and Insufficient Findings.
