A0;7.5 - 5g AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AMENDING SECTION 13.04.180, TITLED "RATES AND CHARGES — SOLID WASTE DISPOSAL — SCHEDULE," OF THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Georgetown (the "City") contracts with Texas Disposal Systems ("TDS") for solid waste disposal services; and, WHEREAS, the City approved a new agreement with TDS in November of 2021 (the "Agreement"), the First Amendment to the Agreement with TDS in September of 2022, the Second Amendment of the Agreement in October of 2023, the Third Amendment of the Agreement in October 2024, and the Fourth Amendment of the Agreement in March of 2025; and WHEREAS, TDS has requested a rate increase as provided in the contract; and, WHEREAS, the City has reviewed the request from TDS and determined that it is consistent with the terms of the contract; and, WHEREAS, the City has determined that the TDS requested rate increase is necessary in order to continue to maintain the high level of solid waste disposal services to which citizens have become accustomed; and, WHEREAS, the City has determined that continuation of annual cost of service studies as well as enhanced communication with customers all in -city solid waste customers is necessary; and, WHEREAS, the City has determined increased funding for facilities maintenance to maintain the City's transfer station is necessary in order to continue to maintain the high level of solid waste disposal services to which citizens have been accustomed; and, WHEREAS, the City undertook an update of the cost of service study in FY2024, and again in FY25, which projects the City's Solid Waste Fund providing for a payment in lieu of taxes and franchise fee payment to the City's General Fund in the amount of $1,520,136 in FY26, equal to 7 percent of revenues; and WHEREAS, the cost of service study projects fully complying with the fiscal and budgetary policy's provisions related to the payment in lieu of taxes and franchise fees by FY2028; and WHEREAS, the City has determined it necessary to fully recover the costs associated with Ordinance No.: A025 - —1$5 Page 1 of 4 Description: TDS Solid Waste Rates Date: A-6oa lye ?ffZS administering the utility and requires a 4.5 percent and 9.5 percent rate increase for residential and commercial customers, respectively. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Section 1. The meeting at which this ordinance was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. Section 13.04.180 of the Code of Ordinances, "Rates and charges — Solid Waste Disposal — Schedule" is hereby amended and replaced as shown in "Exhibit A." Section 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect on November 1, 2025 and apply to all billings after that date in accordance with the provisions of the Charter of the City of Georgetown. o� PASSED AND APPROVED ON FIRST READING ON THE 3 DAY OF SEPTEMBER 2025.
