HomeMy WebLinkAboutRES 111225-5.N-2 - Abandonment of waterline easement across portion of 75.73 acres for HawesRESOLUTION NO. 1 11Z&6—.5.,n1 - 7— RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AUTHORIZING THE RELEASE AND ABANDONMENT OF A PORTION OF A GEORGETOWN WATER LINE EASEMENT. WHEREAS, in 1981, Jack and Matholee (Pat) Nitschke, a predecessor -in -title to Clint and Marlane Hawes ("Owner"), granted Chisholm Trail Water Supply Corp. a water line easement across a 75.73 acre, more or less, tract of land in Williamson County, Texas, said 75.73 acre tract being more particularly described in that certain instrument recorded in Volume 422, Page 277 of the Official Public Records of Williamson County, Texas, for the purpose of facilitating the extension of a water line across the property; said water line easement being dedicated in Volume 837, Page 666 of the Official Public Records of Williamson County, Texas (the "Easement"); and, WHEREAS, the above -referenced 75.73 acre tract has been subdivided, and Owner now owns a part of such 75.73 acre tract, such part owned by Owner being 3.22 acres of land, more or less, situated in Williamson County, Texas, as more particularly described in that certain warranty deed recorded in Document Number 1996038854 of the official public records of Williamson County, Texas (the "Property"); and, WHEREAS, Owner has requested that the City abandon the portion of the Easement that encumbers the Property (the "Portion to be Abandoned"); and, WHEREAS, Owner has conveyed a water line easement across a portion of the Property to the Chisholm Trail Special Utility District pursuant to the Water Line Easement and Right -of -Way recorded under Document Number 2006032555 of the Official Public Records of Williamson County, Texas, which water line easement has since been transferred to the City of Georgetown, thereby meeting the requirement of providing a replacement easement for the Portion to be Abandoned; and, WHEREAS, upon considering the request for the release and abandonment of the Portion to be Abandoned, the City Council finds that a public need for the Portion to be Abandoned no longer exists, and therefore the Portion to be Abandoned may be abandoned and released to Owner or a successor -in -interest to Owner. WHEREAS, nothing herein shall operate to release any other easement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The Mayor is hereby authorized to execute a Quitclaim in substantially the same form attached hereto as Exhibit "A" and any other conveyance document(s) necessary to complete the release and abandonment of the Portion to be Abandoned, and the City Secretary is hereby authorized to attest thereto on behalf of the City of Georgetown. SECTION 3. The Mayor is hereby authorized to sign this Resolution and the City Secretary to attest. This Resolution shall be effective immediately upon adoption and execution by the Mayor.
