RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS AUTHORIZING THE RELEASE AND
ABANDONMENT OF A PORTION OF A CITY OF GEORGETOWN
WATER LINE EASEMENT.
WHEREAS, in 1983, Jack and Matholee (Pat) Nitschke, a predecessor -in -title to Clint
and Marlane Hawes ("Owner"), granted Chisholm Trail Water Supply Corp. a water line
easement across a 68.096 acre, more or less, tract of land in Williamson County, Texas, said
68.096 acre tract being more particularly described in that certain warranty deed recorded in
Volume 717, Page 309 of the Official Public Records of Williamson County, Texas, for the
purpose of facilitating the extension of a water line across the property; said water line
easement being dedicated in Volume 954, Page 555 of the Official Public Records of
Williamson County, Texas (the "Easement"); and,
WHEREAS, the above -referenced 68.069 acre tract has been subdivided, and Owner
now owns a part of such 68.069 acre tract, such part owned by Owner being 3.22 acres of
land, more or less, situated in Williamson County, Texas, as more particularly described in
that certain warranty deed recorded in Document Number 1996038854 of the official public
records of Williamson County, Texas (the "Property"); and,
WHEREAS, Owner has requested that the City abandon the portion of the Easement that
encumbers the Property (the "Portion to be Abandoned"); and,
WHEREAS, Owner has conveyed a water line easement across a portion of the
Property to the Chisholm Trail Special Utility District pursuant to the Water Line Easement
and Right -of -Way recorded under Document Number 2006032555 of the Official Public
Records of Williamson County, Texas, which water line easement has since been transferred
to the City of Georgetown, thereby meeting the requirement of providing a replacement
easement for the Portion to be Abandoned; and,
WHEREAS, upon considering the request for the release and abandonment of the
Portion to be Abandoned, the City Council finds that a public need for the Portion to be
Abandoned no longer exists, and therefore the Portion to be Abandoned may be abandoned
and released to Owner or a successor -in -interest to Owner.
WHEREAS, nothing herein shall operate to release any other easement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, THAT:

SECTION 1. The facts and recitations contained in the preamble of this resolution are
hereby found and declared to be true and correct and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim.
SECTION 2. The Mayor is hereby authorized to execute a Quitclaim in substantially
the same form attached hereto as Exhibit "A" and any other conveyance document(s)
necessary to complete the release and abandonment of the Portion to be Abandoned, and the
City Secretary is hereby authorized to attest thereto on behalf of the City of Georgetown.
SECTION 3. The Mayor is hereby authorized to sign this Resolution and the City
Secretary to attest. This Resolution shall be effective immediately upon adoption and
execution by the Mayor.

receipt and sufficiency of which is hereby acknowledged.
PROPERTY:
All of Grantor's right, title and interest in and to a portioll of the Right of
Way Easement recorded in Volume 954, Page 555, of the Official Public
Records of Williamson County, Texas, such portion being the portion that
encumbers a certain 3.22 acre tract of land situated in Williamson County,
Texas, as more particularly described in that certain deed recorded under
Document Number 1996038854 of the Official Public Records of Williamson
County, Texas.
For the consideration, GRANTOR quitclaims to GRANTEE all of GRANTOR'S
right, title, and interest in and to the above described Property, to have and to hold it to
GRANTEE, GRANTEE'S successors and assigns, forever. Neither GRANTOR, nor
GRANTOR'S successors and assigns, shall have, claim or demand any right or title to the
Property or any part of it.
