HomeMy WebLinkAboutRES 120925-5.E - ETJ Disannexation - Caspian Properties LLC, 110 and 120 Wood Way, 9.996 acres, R338539 and R040030RESOLUTION NO.12 0 a 25 - 6 - E A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ("GEORGETOWN") RELEASING APPROXIMATELY 9.996 ACRES OF LAND FROM THE CITY OF GEORGETOWN'S EXTRATERRITORIAL JURISDICTION ("ETJ"), SAID LAND IDENTIFIED BY THE WILLIAMSON COUNTY APPRAISAL DISTRICT AS PARCELS R338539 AND R040030 AND BEING LOCALLY KNOWN AS 110 WOODY WAY AND 120 WOODY WAY, HUTTO, WILLIAMSON COUNTY, TEXAS, RESULTING IN A REDUCTION OF GEORGETOWN'S ETJ; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on November 12, 2025, the City of Georgetown, Texas, received a petition requesting release from its ETJ of an approximately 9.996 acre tract of land in the John McQueen Survey (the "Petition"), a true and correct copy of such Petition being attached hereto as Exhibit A and incorporated herein by reference; and WHEREAS, pursuant to Subchapter D of Chapter 42 of Local Government Code, landowners or residents may submit a petition seeking release of an area of land from the City's ETJ; and WHEREAS, the City Secretary has reviewed the Petition and confirmed that it meets the requirements of Subchapter D of Chapter 42 of the Local Government Code and the petition requirements of Chapter 277 of the Election Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: SECTION 1. The City Council of the City of Georgetown, Texas ("City Council"), does hereby find that the forgoing recitals are true and correct and adopts the recitals by this reference for all purposes. SECTION 2. To the extent required by state law, the City Council does hereby adjust the boundaries and limits of the ETJ of the City of Georgetown, Texas, such that the ETJ of the City of Georgetown, Texas, shall be and is hereby adjusted to release and remove the Area subject to the Petition, as such Area is more particularly described and depicted in Exhibit B attached hereto and incorporated herein by reference, from the ETJ of the City of Georgetown, Texas. SECTION 3. The City Council is not consenting to this reduction of its ETJ except as required by state law. SECTION 4. This Resolution shall take effect immediately upon its passage. We do hereby consent to the adoption of the following as if it was adopted at a specially called meeting of the Members for this Company. In support of this petition Petitioner represents the following: Section i. Pursuant to Local Government Code Section 42.102(b), Petitioner, being the owner of a majority in value of the Land, files this petition for the Land to be released from the City's ETJ. Section 2. Pursuant to Local Government Code, Section 42.104(a)(2), the signatory to this petition is the holder of title of a majority in value of the Land, as indicated by the current tax roll of the Williamson Central Appraisal District, and evidenced by the current tax certificates attached as Exhibit "B" hereto. Section 3. Exhibit "A" hereto includes a map of the Land and describes the boundaries of the Land by metes and bounds. Section 4. The Land is not subject to any of the exceptions to the applicability of Local Government Code, Chapter 42, Subchapter D, as amended, as described in Local Government Code, Section 42.101. Section 5. All signatories, if more than one, have signed this petition not later than the 180th day after the date the first signature for this petition was obtained. Section 6. This Petition shall be verified by the City Secretary of the City or other person at the City responsible for verifying signatures. Section 7. As required by Local Government Code Section 42.105(b), the City shall notify the residents or landowners of the Land of the results of this petition, which notification requirement may be satisfied by notifying the Petitioner in writing, and Petitioner requests such notification to be made in writing in accordance with Local Government Code Section 42.105(b). Section 8. 1f the City fails to take action to release the Land by the later of (a) the 451h day after the date the City receives this petition, or (b) the next meeting of the city council of the City that occurs after the 3rd, day after the date the City receives this petition, the Land shall be released by operation of law. The Petitioner requests that the City immediately release the Land from the City's ETJ and provide Petitioner with written notification thereof. This petition will be filed with the City Secretary in support of such release and recorded in the Official Public Records of Williamson County, Texas.
