A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN,
TEXAS AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION RELATED TO CONSTRUCTION OF A
SHARED USE PATH ALONG FM 971 FROM GANN STREET TO STATE
HIGHWAY 130.
WHEREAS, in 2024, by way of resolution number 121024-5.H the City Council approved an
application for submission to the Capital Area Metropolitan Planning Organization (CAMPO) for
construction funding for shared use paths along FM 971 from Gann Street to State Highway 130; and
WHEREAS, June 9, 2025, the CAMPO's Transportation Policy Board approved the project
application for shared use paths along FM 971 from Gann Street to State Highway 130 as reflected in
Resolution 2025-6-7; and
WHEREAS, the funding approved by CAMPO is for construction; and
WHEREAS, on August 21, 2025 via Minute Order 116997, the Texas Transportation Commission
authorized FM 971-Gann St to SH 130(MPO TASA) project to receive TA funds for the engineering and
construction and Texas Department of Transportation (TxDOT) oversight; and
WHEREAS, the City of Georgetown (the "City") will be responsible for any cost overruns.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN TEXAS:
Section 1. The meeting at which this resolution was approved was conducted in compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551.
Section 2. The facts and recitations contained in the preamble of this resolution are hereby found
and declared to be true and correct and are incorporated by reference herein and expressly made a part
hereof, as if copied verbatim.
Section 3. The City Council of the City of Georgetown finds it to be in the best interest of the citizens
of the City to enter in the Advance Funding Agreement with the Texas Department of Transportation related
to the construction of shared use paths along FM 971 from Gann Street to State Highway 130.
Section 4. The City Manager is hereby authorized to negotiate and execute an Advance Funding
Agreement with the Texas Department of Transportation for preliminary engineering, utility relocation, right-
of-way acquisition, and construction of FM 971 from Gann Street to State Highway 130.
Section 5. If any provision of this resolution, or application thereof, to any person or circumstance,
shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this

resolution, which can be given effect without the invalid provision or application, and to this end the provisions
of this resolution are hereby declared to be severable.
Section 6. The Mayor is hereby authorized to sign this resolution and the City Secretary to attest. This
Resolution shall take effect immediately upon its passage and approval by the Georgetown City Council.
