RESOLUTION NO. 12,05Z-5. a A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION RELATED TO AUSTIN AVENUE AND DOWNTOWN SQUARE IMPROVEMENTS FROM 2ND STREET TO 18TH STREET. WHEREAS, on 08/21/2025, via Minute Order 16997 (MO), the Texas Transportation Commission authorized Austin Avenue and Downtown Square Improvements project (the "Project) to receive Transportation Alternatives Set -Aside Program (TASA) funds for project Plans, Specifications, and Estimates (PS&E) and Texas Department of Transportation (TxDOT) oversight; and WHEREAS, the City of Georgetown (the "City") commits to provide the match. WHEREAS, the local match is comprised of cash through the Georgetown Transportation Enhancement Corporation; and WHEREAS, the City of Georgetown is responsible for all non -reimbursable costs and 100% of overruns, if any; and WHEREAS, the Governing Body of the City desires to reaffirm its support of the Project, approve and authorize the execution of an Advance Funding Agreement (AFA) with TxDOT for the Project. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS: Section 1. The meeting at which this resolution was approved was conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. The City Council of the City of Georgetown finds it to be in the best interest of the citizens of the City to enter in the Advance Funding Agreement with the Texas Department of Transportation related to a highway improvement or other transportation project generally described as Austin Avenue and Downtown Square Improvements from 2nd Street to 18 h Street. Section 4. The City Manager is hereby authorized to negotiate and execute an Advance Funding Agreement with the Texas Department of Transportation for a highway improvement or other transportation Resolution No. IAA 125 — 5• 0 Subject: Austin Avenue and DT Square PS&E Date Approved IX 164 %-.6,Z5 Page 1 of 2 project generally described as Austin Avenue and Downtown Square Improvements from 2nd Street to 18' Street. Section 5. If any provision of this resolution, or application thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this resolution, which can be given effect without the invalid provision or application, and to this end the provisions of this resolution are hereby declared to be severable. Section 6. The Mayor is hereby authorized to sign this resolution and the City Secretary to attest.
