HomeMy WebLinkAboutEasement Bartz 11.20.1970THE STATE OF TEXAS * KNOW ALL MEN BY THESE PRESENTS COUNTY OF WTLUAMSON RT'GHT 'OF WAX' AND EASEMENT That Eric Bartz and wife,' Pansy Mae Bartz, of Williamson County, Texas, hereinafter called Grantor, for and in considera- tion of the sum of Ten Dollars ($10.00) and other good and valuable consideration cash in hand paid by the City of George- town, the receipt of which is hereby acknowledged, confessed and deemed to be sufficient, do hereby grant and convey unto the City of Georgetown, Williamson County, Texas, hereinafter called Grantee, its successors and assigns, an easement for the installation and maintenance of sewer lines along, over, through upon, under and across the following land situated in the County of Williamson, State of Texas, said tract of land being described as follows: Being 0.110 acre of land out of a two acre tract conveyed to Eric Bartz from Charles E. Harris, Jr. et al by deed dated February 4, 1954 and recorded in Volume 393, Page 468 of the Williamson County Deed Records, said 0.110 acre tract is more particularly described by metes and bounds as follows: Beginning at the southeast corner of said two acre tract from which point the most northeast corner of the Lone Star Gas Co. tract bears north 70° 431 east a distance of 161.11 feet; Thence, north 76° 231 west along the southern line of the Bartz tract a distance of 213.74 feet to a fence corner; Thence, south 610 051 west a distance of 40 feet to the southwest corner of the Bartz tract and the southwest corner of this tract; Thence, north 200 17' west a distance of 15.17 feet to a corner; Thence, north 61° 051 east a distance of 42.57 feet to a corner; Thence, south 78° 10' east a distance of 230.26 feet to a slight turn; Thence, south 710 001 east a distance of 20.47 feet to the Bartz southeast property line; Thence, south 70° 43' west a distance of 36.00 feet to the place of beginning containing 0.110 acre of land out of the William Addison Survey, Abstract 21 in Williamson County, Texas. The City of Georgetown hereby agrees to clear said pre- mises and leave same•in as good a condition as same is now in. TO HAVE AND TO HOLD the said easement, the rights of way, and rights unto the said City of Georgetown, its successors and assigns, for the above stated property, and we do hereby bind ourselves, our heirs, executors and administrators to Warrant and Forever Defend, all and singular, the said right-of-way and easement unto the said City of Georgetown, its successors and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof.
