HomeMy WebLinkAboutRES 05.13.1974 - Election Order393 RESOLUTION AND ORDER FOR ELECTION STATE OF TEXAS CITY OF GEORGETOWN WHEREAS, each and all of the members of the City Council of the City of Georgetown, Texas, was duly and sufficiently notified, officially and personally, in advance, of the time, place and purpose of this meeting; and WHEREAS, proper notice of this meeting has been duly and timely posted as provided by law; and WHEREAS, the City Council deems it advisable to call the election hereinafter ordered; therefore, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: That an election is hereby ordered to be held in the City of Georgetown on the 1st day of June, 1974, which date is not less than fifteen (15) nor more than thirty (30) days from the date of the adoption of this resolution and order. The entire City shall constitute one election precinct. Said election shall be held at the following place and the following named qualified persons are hereby appointed officers of said election. VOTING PLACE ELECTION OFFICERS Georgetown Fire Station L. R. McLaughlin - PRESIDING JUDGE W. E. Edmiston - ALTERNATE PRESIDING JUDGE The Presiding Judge shall appoint three clerks to assist in holding said election. Absentee voting shall be conducted at the Office of the City Secretary, in the City Hall in the City of Georgetown, for the period of time as permitted by law. The hours designated for absentee voting shall be from 8:00 a.m. to 5:00 p.m. on each day except Saturdays, Sundays, and official State holidays,, - That at said election the following propositions shall be submitted in accordance with law: PROPOSITION NO. 1 SHALL the City Council of the City of Georgetown, Texas be authorized to issue the bonds of said City in the amount of $250,000 maturing serially over a period of years not to exceed 30 years from their date, bearing interest at such rate or rates as shall be determined within the discretion of said City Council, for the purpose of constructing extensions and improvements to the City's electric light system; to be issued in accordance with and secured in the manner provided by Article 1111, et seq., VA.T.C.S., as amended, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation out of funds raised or to be raised by taxation, and secured by a lien on and plegde of the net revenues from the operation of the City's combined waterworks, sewer On this the 13th day of May, 1974, the City Council of the City of Georgetown, Texas, convened in regular session at the regular designated meeting place in the City with the following members present, to wit: JOE E. CRAWFORD, Mayor HARRY GOLD HUBERT BROCK J. D. WININGER Councilmen WILLIAM EANES W. L. WALDEN, City Secretary and the following members absent: Dee W. Scott. A quorum being present and after the following resolution and order for election was read, Councilman Gold moved its adoption. The motion was seconded by Councilman Brock. The motion, carrying with it the adoption of this resolution and order for election, prevailed by the following vote: AYES: Councilmen Gold, Brock, Wininger, Eanes NOES: None. PROPOSITION NO. 2 SHALL the City Council of the City of Georgetown, Texas, be authorized to issue the bonds of said City in the amountof $50,000 maturing serially over a period of years not to exceed 30 years from their date, bearing interest at such rate or rates as shall be determined within the discretion of said City Council, for the purpose of constructing extensions and improvements to the City's waterwords sytem; to be issued in accordance with and secured in the manner provided by Article 1111, et seq., V. A. T. C. S., as amended, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation out of funds raised or be raised by taxation, and secured by a lien on and pledge of the net revenues from the operation of the City's combined waterworks, sewer and electric light system? PROPOSITION NO. 3 SHALL THE City Council of the City of Georgetown, Texas, be'authorized to issue bonds of said City in the amount of $100,000 maturing serially over a period of years not to exceed 30 years from their date, bearing interest at such rate or rates as shall b3 determined within the discretion of said City Council, for the purpose of constructing a public building to be used as a Sub Fire Station, and to levy a tax sufficient to pay the interest on said bonds and create a sinking fund sufficient to redeem them at maturity? PROPOSITION NO. 4 SHALL the City Council of the City of Georgetown, Texas, be authorized to issue bonds of said City in the amount of $25,000 maturing serially over a period of years not to exceed 30 years from their date, bearing interest at such rate or rates as shall be determined within the discretion of said City Council, for the purpose of constructing street improvements, within Urban Renewal Area), and to levy a tax sufficient to pay the interest on said bonds and create a sinking fund sufficient to redeemthem at maturity? PROPOSITION NO.5 SHALL the City Council of the City of Georgetown, Texas, be authorized to issue bonds of said City in the amount of $25,000 maturing serially over a period of years not to exceed 30 years from their date, bearing interest at such rate or rates as shall be determined within the discretion of said City Council, for the purpose of constructing extensions and Improvements to the City's waterworks system (within Urban Renewal Area), and to levy a tax sufficient to pay the interest on said bonds and create a sinking fund sufficient to redeem them at maturity? PROPOSITION NO.6 SHALL the City Council of the City of Georgetown, Texas, be authorized to issue bonds of said City in the amount of $25,000 maturing serially over a period of years not to ex- ceed 30 years from their date, bearing interest at such rate or rates as shall be determined within the discretion of said City Council for the purpose of constructing extensions and improvements to the City's sewer system (within the Urban Renewal Area), and to levy a tax sufficient to pay the interest on said bonds and create a sinking fund sufficient to re- deem them at maturity? CITY Each voter shall place an "X" or other clear mark in the square beside the statement indicating the way the voter wishes to vote on each proposition. That said election shall be held and conducted in effect as two separate but simult- aneous elections, to wit: One election at which only the resident qualified voters who own taxable property in the City and who have duly rendered the some for taxation shall be entitled to vote, and another election at which all other resident qualified voters of the City shall be entitled to vote. The votes cast at each said separate but simultaneous election shall be recorded, re- turned and canvassed separately, Where the term "election" is used in this resolution and order for election, it shall mean the separate but simultaneous elections. In further explanation, if need be, the tax- paying voters vote in one box and the non -taxpaying voters vote in the other box. Regular voting will be from 7:00 a.m. to 7:00 p.m. That a substantial copy of this resolution and order for election shall serve as proper notice of said election and said notice shall be posted at the City Hall and at two (2) other public places within the City not less than fourteen (14) full days prior to the date on which said election is to be held, and said notice shall be published on the same day in each of two successive weeks in a newspaper in the City of Georgetown, the first of said publications to be made not less than fourteen (14) full days prior to the date set for said election. The manner of holding said election shall be governed, as near as may be, by the Texas Election Code, as amended, except as modifiztd by applicable law.
